consent agenda item, the Stream Margin Review subject to the
following conditions:
1. The high water line be drawn and labeled on the submitted
plan subject to approval by the Engineering Department.
2. The 5" caliper birch tree be relocated.
3. The applicant shall dedicate a fisherman's easement in the

Response: The lowest point of the closet addition is
at least 8 feet above the flood elevation.

This letter is intended discuss the effects upon the Roaring Fork Flood -
plain of the proposed closet addition and the deck addition to the above
mentioned residence.
The residence is located on Jot 15 of Black Birch Estates, Aspen, Colo-
rado, (1150 River Drive). The residence is pre -FIRM regulations. The
proposed additions are located such that they will not affect the flood -
plain as it now exists (in essence, each addition will not introduce any
additional floodplain blockage to further prohibit the base flood from
flowing through this area).

SUMMARY: The applicant proposes 2 small additions - a closet and
shower added onto an existing bath and a deck added onto an
existing lap pool. Section 7 -504, Stream Margin Review, of the
Aspen Municipal Code requires development review of proposals
within the Special Flood Hazard Area. The closet and shower
addition is within the Special Flood Hazard Area thus requiring
Stream Margin Review. The proposed deck is outside of the
Special Flood Hazard Area and more than 100 feet from the high
water line of the Roaring Fork River.
APPLICANT: Kathleen D. Smith, represented by Michael Gassman.
LOCATION: Lot 15 Black Birch Estates, 1150 River Drive, City of
Aspen
ZONING: R -30
APPLICANT'S REQUEST: Stream Margin Review approval for the
construction of a closet and shower addition onto an existing
single family home.
REFERRAL COMMENTS:
Engineering: In a memo dated April 20, 1989 Jim Gibbard of the
Engineering Department had the following comments:
1. The high water line needs to be drawn and labeled on the
submitted plan.
2. We recommend that the 5" birch tree on the north side of
the development be relocated rather than replaced.
3. We recommend that the applicant grant a fisherman's
easement in the Roaring Fork River and for a width of 5 feet
along the west side of the river.
No other referral comments have been received by the Planning
Office.
STAFF COMMENTS: Section 7 -50 outlines the criteria for Stream
Margin Review as follows:

columns which will have no effect on the base flood elevation.

Although the applicant is not required to obtain a tree
removal permit for removing the 5" caliper birch tree, we
encourage the applicant to attempt to relocate the tree rather
than replace it.
Section 7 -507 (C) (2) (d) of the Aspen Land Use regulations,
recently amended by ordinance 6, requires a description of
proposed construction techniques to be submitted with the
application. When submitting her application the applicant did
not have a chance to comply with these recent code amendments.
However the proposed addition is small and setback from the river
bank on a flat portion of the site, therefore sedimentation and
erosion is not a concern.

pollution or on natural changes of the river.

Having reviewed the above application and made a site visit, the
Engineering Department has the following comments:
1. The high water line needs to be drawn and labeled on the
submitted plan.
2. We recommend that the 5" birch tree on the north side of the
development be relocated rather than replaced.
3. We recommend that the applicant grant a fisherman's easement
