From June 18 until June 22 we cleared the area south of the building site. The clean -up included removing a dump and an old burnt out trailer. 2. On June 20th we began excavation in anticipation of receiving a building permit. 3. On June 23rd we dumped and graded a few truck loads of fill from the building site to level out a depression south of Spring Street. This area was to be used as storage for lumber and building supplies. 4. On June 23rd our excavation operation was closed down by the building inspector because we had dumped fill within 100 feet of the Roaring Fork. We were told we must get a Stream Margin Review. 5. During our dumping and grading we did not remove or damage any trees and only a few small bushes were removed. 6. The Building Inspector agreed that even in its present condition (filled and graded) the area in question is more pleasing to the eye than before we began our activities. 7. We do not plan to use the area south of Spring Street for anything other than storage of building supplies. If agreeable to the Commission, we will drop a few loads of fill in that area, but not within 100 feet of the Roaring Fork, for use as backfill at the building site. lmk M E M O R A N D U M TO: Aspen Planning and Zoning Commission FROM: Planning Office (KS) RE: Pardee Stream Margin Review DATE: July 1, 1977 As the attached memo from the applicant explains, this request is for stream margin review of filling taking place within 100 feet of the Roaring Fork River at a site South of Spring Street. The applicant began his excavation for a house site (located well beyond the 100 foot setback) and filling activity unaware of the Code requirement that any excavation and fill within 100 feet is subject to stream margin review by the Planning and Zoning Commission. The Planning Office has reviewed the matter with the applicant and has observed the site. Major vegetation has not and is not intended to be disturbed: smaller varieties of scrub brush will likely re- vegetate naturally. No threat of change is posed by the filling activity to the existing stream channel. In general, we find no reason to deny stream margin review and, in fact, see this and other modifications to the site (including removal of an old trash heap) as constituting improvements in the general area. We recommend approval with the additional suggestion that the fill area be seeded as quickly as possible so as to prevent possible erosion and sedimentation. lmk MEMORANDUM TO: Clayton Meyring, Building Inspector FROM: Karen Smith, Planning Office 4-A RE: Planning and Zoning Action on Wed"um- Pardee and Miller Stream Margin Reviews DATE: July 6, 1977 At their July 5th meeting, the Aspen Planning and Zoning Commission approved stream margin review of fill work within the 100 foot setback of the Roaring Fork River at the Pardee house site. Their approval included the condition that the site be graded to ground level and be restored to its natural condition as soon as possible. Also, at that meeting, Planning and Zoning passed a motion approving stream margin review for additions to the Miller residence on Lot 13, Black Birch Estates.
