During the P & Z work session on February 28th, it was discovered that two
members of the Planning Office had scored the recycling facilities and
handicapped design sections using different assumptions. Therefore, those
point sections will have to be amended accordingly for the Goodnough and
Park Central West applications:

RE: Park Central West - Amendment to the Growth Management Score Recom-
mended by the Planning Office
DATE: February 24, 1978
Due to an error in evaluation, the Park Central West Project is due an extra
three points in its scoring under ordinance 48, as recommended by the Plan-
ning Office. The project should score a 9 instead of 6 under the employee
housing section since the applicant has allocated three out of the ten units
to low income rentals. The Planning office had scored the application as
if they were in the moderate income category, and we were in error. The
project will then have a total of 40 points and thus has met the minimum
of 60% of the total possible points. The change will not, however, affect.
its rank (2nd) with respect to all of the residential projects.

TO: Aspen Planning and Zoning Commission

RE: Park Central West Townhouse Condominiums - Preliminary Plat
DATE: July 27, 1978
This proposal is for construction of a two-story building, including
10 residential units (7 one -bedroom, free market units and 3 low-cost
studios) plus 2,781 sq. ft. of office space, for a total building area
of 11,211 sq. ft. The project is proposed for location on a 15,000 sq.
ft. parcel including 5 lots at the NE corner of Hyman and Aspen Streets.
It is currently zoned 0-Office, which allows multi -family residences,
professional and business offices, and accessory moderate -income housing
by special review.
The proposal scored the second highest number of points which was 42 out
of 65 possible, at the conceptual/GMP review stage. Scoring and referrals
indicated no problems with access to or impact on public services and
facilities. The housing category received 30% of possible points based
on 3 low-income units out of 10. In addition, social services (e.g. police;
childcare; and recycling facilities; bike paths; and handicapped design
features) scored adequately.
Having confirmed that the plat has not changed since conceptual submission,
the Planning Office recommends acceptance of the proposal. It is located
in close proximity to the commercial core and to bus routes which would
help to minimize traffic impact. Recycling bins will be provided on -site.
There is handicapped access to a number of units. Necessary utilities
services are located within a 2 to 3 block radius. Most referrals (sub-
mitted to the record) indicated that no problems are anticipated. These
include: the Fire Marshall, Rocky Mountain Natural Gas, Water Dept., Aspen
Metro Sanitation District, and City Engineering Dept.
Two conditions on acceptance however, have been requested by utilities
companies. These should be considered before final plat acceptance:
1. The electric company needs to know the power load and when power
will be needed.
2. J.C. Kilmer of Mountain Bell suggests the following language be
used for dedication of easements:
"And hereby dedicate to the PUBLIC all the streets, avenues
and roads as shown on the accompanying plat, forever, and ded-
icate to the PUBLIC UTILITIES those portions of real property
which are labeled as utility easements on the accompanying
plat, as easements for the installation and maintenance of
utilities and drainage facilities, including, but not limited
to, electric lines, gas lines, telephone lines; together with
the right of ingress and egress for installation, maintenance
and replacement of such lines; together with the right to trim
interfering trees and brush; said easements and rights shall be
utilized in a reasonable and prudent manner."
A final condition,specified in conceptual review, is control of inflation
and rent on the 3 low-income units. The accompanying memo from Mark Danielsen

RE: Park Central West Townhouse Condominiums
The housing requirement for the three low income units
involves specifying terms for an agreement for main-
taining prices and controlling rental adjustment over
the next five years. These units shall all fall under
the "low income" category.
It is recommended that the rental price guideline fall
under the proposed "1978 Growth Management Housing
Price Guidelines", a copy of which is attached.
These guidelines shall be presented before the City
Council on August 14th. Consequently, $175/month
rent is suggested, increased annually according to
the National Consumer Price Index for "all items",
under the Clerical and Wage Earners revised index,
which uses 1967 as the base (100s) year. This index
is the national rate of inflation and has increased
6.8%, 5.2% and 6.7% for the past three years respectively.

We have reviewed the plat of "Park Central West" and found the easements to be
adequate.
However, May we suggest the following phraseology be used for the dedication of
easements within said subdivision.
"And hereby dedicate to the PUBLIC all the streets, avenues and roads as
shown on the accompanying plat, forever, and dedicate to the PUBLIC UTILITIES
those portions of real property which are labeled as utility easements on the
accompanying plat, as easements for the installation and maintenance of util-
ities and drainage facilities, including, but not limited to, electric lines,
gas lines, telephone lines; together with the right of ingress and egress for
installation, maintenance and replacement of such lines; together with the
right of trim interfering trees and brush; said easements and rights shall be
utilized in a reasonable and prudent manner."
We believe all preliminary, as well as final plats, should show the dedication
or reference to the particular "Protective Covenants" which will run with the
property. Also, all "Private Roads" should be dedicated to the utilities for
the installation, maintenance and operation of gas, lights, power and telephone
lines. No easements should be dedicated tothe property owners, cities or
counties exclusively; all easements should be dedicated to the public utility
companies.
The preceding request is in accordance with C.R.S. 106-2-34 (3) (d) (viii) and
the Colorado Land Use Commission's paragraph 5-2, Item #G-7.

land dedication as required by the provisions of

at the rate of 9% from the date of issuance of the
building permit, and the interest and principal sum
shall be due and payable on or before the ,late of

This proposal is for construction of a two-story building, including 10 resi-
dential units (7 one --bedroom, free market units and 3 low-cost studios) plus
2,121 sq. ft. of office space, for a total building area of 11,211 sq. ft.
The project is proposed for location on a 15,000 sq. ft. parcel including 5
lots at the NE corner of Hyman and Aspen Streets. It is currently zoned
0-Office, which allows multi -family residences, professional and business
offices, and accessory moderate -income housing by special review.
The proposal scored the second highest number of points (42 out of 65 possible)
at the conceptual/GMP review stage. Scoring and referrals indicated nc pro-,
blems with access to or impact on public services and facilities. The housing
category received 30% of possible points based on 3 low-income units out of
10. In addition, social services (e.g. police, childcare and recycling
facilities, bike paths, and handicapped design features) scored adequately.
It is located in close proximity to the commercial core and to bus routes
which would help to minimize traffic impact. Recycling bins will be provi-
ded on -site. There is handicapped access to all ground -level units. Necessary
utilities and services are located within a 2 to 3 block radius. Most re-
ferrals (submitted to the P&7_ record) indicated that no problems are antici-
pated. These include statements from the Fire Marshall, Rocky Mountain Natural
Gas, Water Dept., and Aspen Metro Sanitation District.
The City Planning and Zoning Coinr•iss•ion reviewed the application at a regular
meeting on August 1, 1978. The Coanission recommended preliminary plat
approval subject to the following conditions:
1. Holy Cross Electric needs to knew the power load required and when
power will be needed.
The applicant has discussed this with Holy Cross and gained approval.
A letter confirming approval will be entered into the record when
received.
2. Mountain Bell suggests that a dedication of easements for roads and
utilities be made. Appropriate language will be placed in the "Sub-
division Improvements Agreement." before the final plat is recorded.
3. In an effort to control the low -rent studio units. P&Z recommended
that final approval be given conditioned on a -covenant adopting what-
ever price guidelines City Council adopts. The City Attorney, however
has reviewed previous actions of City Council and determined that a con-
tract regarding housing has been made. City Council minutes record an
agreement that the applicant will fulfill his employee housing obli-
gation (Ordinance 53) by holding the rent of the three studio units
at $175 per year for five years. A housing agreement will be written
to bind the property to this restriction.
In, addition to fulfilling the P&Z conditions for final plat approval, the app-
licant has also received approval from the City Engineer. The problems cited
on Dave Ellis' memo (see attached, dated 9/15/78) were settled in a revision
of the plat (except for a couple of semantic problesm).
The applicant is submitting for City Council approval a "Subdivision Improve-
ments Agreement" which includes:
1. Agreement to joino, any special utility improvement district which may
be formed.
2. Agreement to pave the remainder of the alley of Block 75 by October 1,
1978 (as requested by Dave Ellis).
3. Agreement to establish a cash escrow fund to cover default in payment
of the allay pavement. (Dave will PKe an estimate to be included in
the Agreement before the plat is recorded.)

4. Agreement to pay a par', c'ed-ication fee, equ.,l to 1% of the assessed
property value mulit.ipiied by the number cif residents (13.5), as
defined by Ordinance 13 (1978). An appraisal will be made and appro-
ved by City Manager, Hick Mahoney, and the fee calculated prior to
recording of tho plat.
5. Dedication of road and utility easements to the public and to utility
companies, respectively.
6. Agreement to duly record the final plat.
7. Agreement that the covenants and agreements run with the land.
The Planning Office recommends approval of the final plat conditioned on the
above -mentioned clarifications and approvals, including:
1. Final approval of the plat by Dave Ellis;
2. Clarification for Holy Cross Electric of power load requirements;
3. Revision of the "Subdivision Improvements Agreement" to include the
engineer's estimate of paving costs, calculation of a park dedication
fee, and language covering dedication of utility easements and roads;
4. A "housing Agreement" which meets the approval of the City Attorney;
and
5. Provision of the original plat and copies for recording as specified
in Section 20.14 of the Municipal Code.

THIS AGREEMENT, made and entered into this

("Subdividers"), and THE CITY OF ASPEN, COLORADO, a
Municipal Corporation ("City"),
W I T N E S S E T H:
WHEREAS, Subdividers are owners and subdividers
of a tract of land within Pitkin County, Colorado,
consisting of Lots K, L, M, N and 0, Block 75, City and
Townsite of Aspen, and
WHEREAS, Subdividers have submitted to City for
approval, execution and recording a subdivision plat
of the above -described property, such subdivision to be
known and designated as "Park Central West Condominium
Subdivision"; and
WHEREAS, the City has fully considered such sub-
division plat, the proposed development and the improve-
ment of the subject property shown thereon, and is
willing to approve, execute and accept said plat for
recordation upon the agreement of Subdividers to the
matters hereinafter described, which matters are deemed
necessary to protect, promote and enhance the public
welfare; and
WHEREAS, Subdividers and the City wish to reduce
said agreement to writing,
NOW, THEREFORE, in consideration of the premises,
the mutual covenants herein contained, the parties hereto
hereby agree as follows:
1. Subdividers covenant and agree to and with the
City that they will affirmatively consent to and join in

the formation of any special improvement district, en-
compassing all or any part of Park Central West Condominium
Subdivision, that may hereafter be proposed or formed
for the construction of drainage improvements, or any
other such utility, or street improvements abutting
Lots K, L, M, N and 0, Block 75, City and Townsite of
Aspen. Subdividers hereby waive and further covenant
and agree to waive any right of protest against the forma-
tion of any such district.
2. Subdividers covenant and agree to and with
the City that they will pave the unpaved portion of the
alley of Block 75 with asphalt (approximately 150 lineal
feet) no later than October 1, 1979.
3. The City Engineer has estimated the cost of
the improvements provided for in Paragraph 2 above to be
Subdivider agrees with this estimate
and further agrees to provide a guarantee for no less
than one hundred (100%) percent of the total of this
estimate prior to recordation of this instrument. The
guarantee shall be in the form of a cash escrow with the
City or a bank or savings and loan association, or an
irrevocable sight draft or letter of commitment from a
financially responsible lender, such guarantee shall be
completed prior to recording the Final Plat. The guarantee
shall give the City an unconditional right, upon default
by Subdividers and after 30 days written demand to sub-
dividers, to withdraw funds upon demand to partially or
fully complete and/or pay for the improvements provided
for in Paragraph 2, or pay any outstanding bills for work
done with reference thereto by any party.
4. Subdividers agree to execute a promissory note
in favor of the City of Aspen prior to issuance of a Building
Permit for the herein named subdivision for the sum of
dollars as full payment for all obligations

for payment of cash in lieu of land dedication as required
by the provisions of Section 20-18 of the City of Aspen,
as amended by Ordinance 13, 1978. Such note shall bear
interest at the rate of 9% from the date of issuance of
the building permit, and the interest and principal sum
shall be due and payable on or before the date of issuanc
of the Certificate of Occupancy for the Park Central Wes -
Condominium Subdivision.
5. The subdividers hereby dedicate to the PUBLIC
all the streets, avenues and roads as shown on the accom -
ing plat, forever, and dedicate to the PUBLIC UTILITIES
those portions of real property which are labeled as
utility easements on the accompanying plat, as easements
for the installation and maintenance of utilities and
drainage facilities, including, but not limited to,
electric lines, gas lines, telephone lines; together with
the right of ingress and egress for installation, main-
tenance and replacement of such lines; together with the
right to trim interfering trees and brush; said easements
and rights shall be utilized in a reasonable and prudent
manner.
6. Upon execution of this Agreement by all parties
hereto, City agrees to approve and execute the final plat
of Park Central West Condominium Subdivision and accept the
same for recording in the real property records of Pitkin
County, Colorado, upon payment of recording fees and costs
to City by Subdividers.
7. The Covenant of the Subdividers contained in
paragraph 1 and agreements of the Subdividers herein
shall be deemed covenants that run with the land, shall
burden the land included within the Park Central West
Condominium Subdivision, and shall bind and be specifically
enforceable against all subsequent owners thereof, including
Subdividers, their heirs, personal representatives, suc-
cessors in interest and assigns.

This letter confirms our conversation of last week.
Mr. Nicholson has voluntarily agreed to rent three studio
apartments for the price of $175 per month for a period
of five years. It is understood that these studios will
have no less than 400 square feet per unit. In return for
receiving this consideration, the City granted your client
special points at review under the Growth Management Plan.
I agree that the City has no authority to unilaterally
modify the term provision of this agreement. However, there
is no provision for the modification of the price of the
studios due to increased utility or tax costs. The City
and your client may agree to modify the price term to allow
for such increases, but I believe that they would demand in
return an increase of control which may not be acceptable

J. Meeker (hereafter "covenators"), for themselves, their
heirs, executors, administrators, and assigns, hereby jointly
and severally covenant with the City of Aspen, Pitkin County,
Colorado, that:
1. Covenators are the owners of the following described
property together with the improvements thereon:
RESIDENTIAL: Units 8, 9, and 10, Park Central West
Condominium Subdivision, City of Aspen,
Pitkin County, Colorado
2. The above -described property shall be restricted to
six (6) months minimum leases with no more than two (2) tenancies
in any calendar year and the monthly rental for each such unit
shall be not more than $175.00, unless the duly constituted
Housing Authority of the City of Aspen shall consent to an in-
creased rental to reflect increased expenses of the owner in
operating the premises, adjustments in cost of living indices
and other similar factors.
3. At the time the property is offered for sale, in whole
or in part, the tenant or tenants shall be given notice of such
offer together with the offered price. Each tenant shall have
a ninety -day non -assignable option to purchase the portion of
the property he has under lease at the price stated in the offer
of sale.
4. At the time a bona fide offer to purchase is made and
accepted, the tenant or tenants shall have a ninety -day exclusive
non -assignable right of first refusal to purchase the portion of
the property which he has under lease. In the event that such
offer is made while the ninety -day option is still in effect, the
tenant may purchase the unit for the amount of the bona fide offer
or offered price, whichever is less.

5. In the event that any improvement of improvements required
by Section 20-16 of the Code of the City of Aspen become, in the
sole judgment or discretion of the City Council of the City of
Aspen, necessary or desirable, no objection will be made to any

ments, nor on the basis that the premises will not be served

Subject: Park Central West Townhouse Condominiums
Dear Ms. Smith,
This is to confirm that it is my intention to put the 3 studio
units in the 10 unit project under the "low cost" category of
the growth management point system, and that the points for
this section would be 9 rather than the 6 as shown on item
C-3 of the point allocation form. The 9 points are based
on a figure of 30% of the units allocated to low cost housing.
This would put the project in compliance with the requirement
that it have at least 39 points (it will have 40 points) and
that each of the three sections have at least 30% of available
points.
My figures are as follows:
1. Public Facilities: 100%
2. Social Facilities: 70%
3. Housing: 30%
Since this project fully complies with the minimum requirements
as set forth in the existing growth management plan, I am request-
ing that it be processed under the existing P & Z procedures,
while those not complying be subject to whatever ordinance re-
visions are made in the future.

Existing City water system in Hyman Ave. adjacent to
the project. Main size 6"C.I., water pressure 80 P.S.I.
Approximately 50 to 60 plumbing fixtures. There is ade-
quate pressure and capacity in existing system, and the
City water deoartr►ent says there will be no problem
supplying the project.
b. Type of sewage treatment system to be used and, if public,
the existing excess capacity available from such Dublic system;
the nearest location to the building site of a trunk or
connecting sewer line; the expected demand of the development
or building.
According to the Metro Sanitation District, the 50 to
60 plumbing fixtures

extinguisher on site as required by code. Distance to
City of Aspen fire station is 2 112 blocks. Response
time is. 3 to 4 minutes, with'the possibility it could
be less according to the fire chief. Buildings are
easily accessible to fire equipment.

Distance to schools: Elementary- 3 blocks, Middle &
High School- 2 miles. Bus stops within 2 blocks.

from the proposed development; description of type and condition
of roads to serve such development; total number of motor
vehicles expected to use or be stationed in such development;
hours of principal daily usage of adjacent roads; on and off
site parking to be supplied; location of alternate transit

will work in the central core or adjacent office building
and would walk to work, the traffic count added to the
