HomeMy WebLinkAboutminutes.council.20120228 Special Meeting Aspen City Council February 28, 2012 Mayor Ireland called the special meeting to order at 4:35 PM with Councilmembers Torre, Johnson, Frisch and Skadron present. Councilman Torre said this meeting was noticed to discuss the adoption of Ordinance #8, Series of 2012, which was voted 3 to 2 at last night's regular meeting. An emergency ordinance requires 4 affirmative votes to be adopted. Councilman Torre handed out a revised ordinance #8; Councilman Torre noted he would like to bring maximum allowable heights below the current 50' limit, which is of importance to the community. Councilman Torre said the revised Ordinance #8 will allow three -story buildings; it will allow residential use of a .5:1 FAR, which is about half a floor of a three story building. The setbacks at 20' will address shadows and icing and visual impact. Councilman Torre said there are a lot of issues with the land use code for Council to tackle and the first thing should be to bring the allowable height below 50'. City Attorney Jim True told Council after the vote at last night, the city clerk took down the notices. True noted there is a waiver provision in the charter that allows all five Council to waive notice of a special meeting. True suggested Council get a waiver and continue the meeting. Council agreed to sign a waiver and to give Councilman Torre an opportunity to state his case. Councilman Torre reiterated bringing the height below 50' is the first step and it is something the community has been asking for. Councilman Johnson said he has not changed his mind from the previous meeting; he does not favor adopting this emergency ordinance but will support bringing this forward in the regular process. Councilman Frisch agreed he would like to see this go to P &Z and then to Council for discussions on bulk and mass. Councilman Johnson moved to adjourn at 4:45 PM; seconded by Councilman Torre.
