OWNER: AT&T Mobility SUBJECT & SITE OF APPROVAL: Temporary Use Permit for Lot 51, Maroon Creek Subdivision, commonly known as 10 Club Circle, involving the erection of a temporary cellular tower, known as Cell on Wheels (COW), from January 17th - 3001, to support cellular service during the X-Games event. The applicant is requesting an extended Temporary Use Permit, pursuant to Land Use Code Chapter 26.450, Temporary and Seasonal Uses. SUMMARY: The Applicant has requested a Temporary Use Permit to erect a cellular tower that would serve area AT&T customers from January 17th - 30th. The intent is to provide additional service for the temporary increase in population during the duration of the X-Games event. The temporary trailer and tower (Cell on Wheels, aka COW) will be located in the parking lot of the Maroon Creek Club. The COW will measure 14'5" in height. The top of the telescopic mast will measure 60' in height, with two antennas mounted on a telescopic mast at approximately 51 ' and 57', respectively. Temporary chain link fencing will be erected around the COW, comprising an area approximately 20'x45'.A sled mounted auxiliary fuel tank with spill containment and a portable generator will be located inside the temporary fencing. The COW will be located on the Maroon Creek Club rear parking lot, occupying approximately three parking spaces. This temporary facility will be in operation 24 hours a day during the requested days of use, save for January 30% when the COW will be disassembled and removed from the property. STAFF EVALUATION: Pursuant to Chapter 26.450, Temporary and Seasonal Uses, of the City of Aspen Land Use Code, the request has been examined in terms of Section 26.450.030, Criteria applicable to all temporary uses. Staff finds that the request of the tower is acceptable due to the limited use of the golf course parking lot during the winter season, and its minimal impact on the operation of the golf course and visual impacts on the surrounding area. The proposed use will have no significant impact on traffic, municipal services, or noise levels. The proposed temporary use will have no foreseeable negative impacts on the general public health, safety or welfare, and will provide additional services to the general public. pg. 1 The applicant has provided verification from the property owner granting permission to operate, and a determination of no hazard to air navigation from the Federal Aviation Administration. The operation may begin on the approved date. DECISION: The Community Development Director finds the request for a temporary cellular tower and accompanying trailer to be erected at 10 Club Circle as noted above and in Exhibit 'A' is consistent with the review criteria (Exhibit A) and thereby, APPROVES the exemption as specified below. Criteria applicable to all temporary uses. When considering a development application for a temporary use or an insubstantial temporary use, the Community Development Director or City Council shall consider, among other pertinent factors, the following criteria as they or any of them, relate thereto: A. The location, size, design, operating characteristics and visual impacts of the proposed use. AT&T proposes to locate their Cell on Wheels (COW) unit on Lot 51 of the Maroon Creek Subdivision, 10 Club Circle, in Aspen, Colorado. The COW will be located in the Maroon Creek Club parking lot. It will measure 14'5" in height, with an extended telescopic mast measuring 60' in height. Two antennas will be mounted on the mast at approximately 51' and 57', respectively. A chain link fence will be erected around the unit, comprising an area of approximately 20'x45'. The bulk of the unit will not be visible to the majority of motorists or users in the area; however, the mast will be visible due to its height. An on-site generator will serve as backup to the operation should power fail, with the main source of power coming from the existing maintenance facility, run to the COW by a pair of Telco cables, measuring approximately 600' in length. B. The compatibility of the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. The proposed COW unit is intended to serve AT&T customers during the X-Games. The immediate vicinity is a public golf course. The proposed temporary use is supportive of the recreational nature of the immediate vicinity, as it will support the nearby X-Games. C. The impacts of the proposed temporary use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels and neighborhood character. There are no anticipated impacts in regard to this temporary use on pedestrian and vehicular traffic, traffic patterns, municipal services, noise levels and neighborhood character. The COW will be located within a parking lot of the Maroon Creek Golf Course, and will occupy approximately three parking spaces. D. The duration of the proposed temporary use and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the application. The temporary use is proposed for 14 days, from January 17th - 30% 2012. There is no temporary use already approved for this location. pg. 3 F. The relation of the temporary use to conditions and character changes which may have occurred in the area and zone district in which the use is proposed. The proposed temporary use is on the Maroon Creek Club golf course, adjacent to nearby multi-family residences. However, the COW unit will not interfere with the residences, or the ability of users to interact with the golf course lands. E. The purposes and intent o f the zone district in which the temporary use is proposed. The zone district where the temporary use is proposed is known as Public (PUB), with Specially Planned Area (SPA) and Planned Unit Development (PUD) overlays. The purpose of the Public zone district is to provide for the development of governmental, quasi-governmental and nonprofit facilities for cultural, educational, civic and other nonprofit purposes. The intent of this specific area is to be used for public recreational purposes. G. How the proposed temporary use will enhance or diminish the general public health, safety or welfare. There is no foreseeable diminution of general public health, safety or welfare associated with this temporary use. Galena St. Aspen, CO 81611 RE: 10 Club Circle Temporary Cell Site DearJennifer: The Aspen-Pitkin County Airport has received sketches and copies of data sent to the FAA regarding installation of a temporary cell tower near the Maroon Club at 10 Club Circle. Based on initial review, there does not appear to be any concern with the installation of this 60 foot structure assuming the FAA Notice of Proposed Construction process is adhered to. The tower is approximately 120 feet higher than the current end of runway but a significant distance from the airfield. As has been customary with the Winter X-Games, we expect more structures of similar height will be installed in this vicinity. If you have any questions feel free to give me a call. However, i f marking/ lighting are accomplished on a voluntary basis, we recommend it be installed and maintained in accordance with FAA Advisory circular 70/7460-1 K Change 2. See attachment for additional condition(s) or information. It is required that the manager of Aspen-Pitkin Co/Sardy Field, Aspen, CO Dustin Havel at 970-379-8472 be notified at least 3 business days prior to the temporary structure being erected and again when the structure is removed from the site. This determination expires on 02/11/2012 unless extended, revised or terminated by the issuing office. NOTE: REQUEST FOR EXTENSION OF THE EFFECTIVE PERIOD OF THIS DETERMINATION MUST BE E-FILED AT LEAST 15 DAYS PRIOR TO THE EXPIRATION DATE. AFTER RE-EVALUATION OF CURRENT OPERATIONS IN THE AREA OF THE STRUCTURE TO DETERMINE THAT NO SIGNIFICANT AERONAUTICAL CHANGES HAVE OCCURRED, YOUR DETERMINATION MAY BE ELIGIBLE FOR ONE EXTENSION OF THE EFFECTIVE PERIOD. However, this equipment shall not exceed the overall heights as indicated above. Equipment which has a height greater than the studied structure requires separate notice to the FAA. This determination did not include an evaluation of the permanent structure associated with the use of this temporary structure. If the permanent structure will exceed Title 14 of the Code of Federal Regulations, part 77.9, a separate aeronautical study and FAA determination is required. This determination concerns the effect of this temporary structure on the safe and efficient use of navigable airspace by aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, or regulation of any Federal, State, or local government body. Any failure or malfunction that lasts more than thirty (30) minutes and affects a top light or flashing obstruction light, regardless of its position, should be reported immediately to (877) 487-6867 so a Notice to Airmen (NOTAM) can be issued. As soon as the normal operation is restored, notify the same number. A copy of this determination will be forwarded to the Federal Aviation Administration Flight Procedures Office if the structure is subject to the issuance of a Notice To Airman (NOTAM). The trailer and tower would be in place from January 17th 2012 until January30th 2011. Currently the there are two cellular towers which serve the AT&T customers in the Aspen Area. The proposed temporary trailer and tower would serve the AT&T customers for the duration of the X-Games. The added demand for both voice and data service is due to the increase in population during the games. The proposed schedule would be as follows: set up January 17, m,2012, 2012, duration o f the event January 26 unit January 29 and breakdown January 30 If approved the proposed trailer and tower would also require a building permit and an electrical permit. Items required for the building permit include but are not limited to: site plan, survey, HOA approval, and structural information. The size of the trailer is 30'x 30. The tower requires stabilization wires and the proposed height of the tower is 60'. The electricity will be provided by a generator. Contact information will be posted on the outside o f the trailer in case of emergency. Temporary uses may be granted by the Community Development Director for seven (7) days, with the ability to request one 7 day extension. Staff recommends that the applicant request an extension as part of the temporary use application since it is already anticipated that the set up, operation, and breakdown is approximately 13 days. The Community Development Director must find that the criteria listed at Section 26.450.030 ofthe Municipal Code are met. The criteria are: A. The location, size, design, operating characteristics and visual impacts of the proposed use. B. The compatibility o f the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. C. The impacts of the proposed temporary use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels and neighborhood character. D. The duration of the proposed temporary use and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the application. E.
