This Order allows development of a site-specific development plan pursuant to the provisions of the land use approvals, described herein. THIRD STREET, LOT lA AND LOT lB, ASPEN MEADOWS SUBDIVISION, ASPEN, COLORADO Parcel ID No. 2735-121-29-008 and 2735-121-29-809 APPLICANT: The Aspen Institute, represented by Vertical Real Estate Consulting and AT&T Mobility. SUBJECT & SITE OF APPROVAL: The subject site is 845 Meadows Road and 1000 N. Third Street, Lot 1A and Lot 1B, Aspen Meadows Subdivision, Aspen, Colorado. The Applicant requests approval for wireless equipment which will only service the Aspen Institute property. This is an administrative review. SUMMARY: The Applicant has requested approval for a new equipment room located within a storage area of the Aspen Meadows Parking Garage, one panel antenna mounted to an existing mechanical equipment screen wall on the rooftop of the Reception Center (845 Meadows Road), and two panel antenna concealed by a shroud on the roof of Paepeke Auditorium (1000 N. Third Street). Substantial trenching will be required to run conduit from the Parking Garage to the two meeting facilities. The Aspen Meadows is a Specially Planned Area (SPA). That designation includes requirements to protect the existing landscape to the greatest extent possible. In addition to the important natural vegetation on the site, there are historic landmark structures and cultural landscapes located on the property. The Reception Center and Anderson Park are the two historic areas affected by the proposed work. This Notice of Approval will address both Wireless Communication requirements and Historic Preservation requirements. STAFF EVALUATION: Pursuant to Section 26.575.130 of the Municipal Code, Wireless telecommunications services facilities and equipment must comply with a list of general provisions and review standards. The requirements seek to ensure that the placements of these facilities are compatible with surrounding development. Depending on the type of telecommunication device installed (i.e. monopole, whip antenna, ground tower, etc.), specific requirements apply. This plan involves the installation of small (25"H x 13"W x 8"D) panel antennas, therefore many of the criteria are not relevant. The majority of the compliance standards address screening and aesthetic considerations to limit the visual impact of the equipment. 1 Y j The panel antenna proposed to be attached to an existing screen wall at the Reception Center will have minimal to no visual impact. This area of the building is somewhat obscured from public view and is utilitarian in nature. The panels proposed to be mounted on Paepcke Auditorium will be visible to the public, however they are relatively low profile and located to the far side of the structure. All support equipment is located in the Parking Garage and/or in underground conduit, with minimal exposed wall mounted conduit to be added to the south wall of the Auditorium, where other conduit already exists. For Staffs response to the Wireless Communications review criteria see "Exhibit B." Approval of a Certificate of No Negative Effect is required for the Reception Center and Anderson Park. The review criteria of Section 26.415.070 of the Municipal Code require a finding that the proposed work will not diminish, eliminate or adversely affect the significant historic and/or architectural character of the subject property. DECISION: Staff finds that the application for a new equipment room located within a storage area of the Aspen Meadows Parking Garage, one panel antenna mounted to an existing mechanical equipment screen wall on the rooftop of the Reception Center (845 Meadows Road), and two panel antermas concealed by a shroud on the roof of Paepcke Auditorium (1000 N. Third Street), provided by AT&T, should be granted. The project includes trenching for installation of underground conduit. The applicant shall be required to receive Parks Department permits for work within the dripline of existing trees, particularly near the Reception Center, the berm to the north of the Parking Garage, the northwest corner of the Arco Building, and the area to the west of Paepcke Auditorium. The type of equipment proposed to construct the trenches, and the depth and width of the trenches shall be specified. Hand digging may be required in some areas. The applicant shall work with the Parks Department to possibly redesign the trench as it crosses Meadows Road and runs towards the northeast corner of the Parking Garage in order to minimize disturbance to existing trees and the substantial berm in that area. Regarding Historic Preservation approval, the Scope of Work qualifies for a Certificate of No Negative Effect, which shall be encompassed in this Notice of Approval. As a condition of approval, the pull boxes flanking the bridge in Anderson Park shall be fully buried, with the pull box covers entirely concealed from view with sod. The following standards are designed to foster the City's safety and aesthetic interests without imposing unreasonable limitations on wireless telecommunication services facilities and equipment: 1. Setbacks. At a minimum, all wireless telecommunication services facilities and equipment shall comply with the minimum setback requirements of the underlying zone district; if the following requirements are more restrictive than those of the underlying zone district, the more restrictive standard shall apply. a. All facilities shall be located at least fifty (50) feet from any property lines, except when roof-mounted (above the eave line of a building). Flat-roof mounted facilities visible from ground level within one-hundred (100) feet of said property shall be concealed to the extent possible within a compatible architectural element, such as a chimney or ventilation pipe or behind architectural skirting of the type generally used to conceal HVAC equipment. Pitched-roof-mounted facilities shall always be concealed within a compatible architectural element, such as chimneys or ventilation pipes. Response: The proposed antennas will be roof-mounted and screened from view. b. Monopole towers shall be set back from any residentially zoned properties a distance of at least three (3) times the monopole's height (i.e., a sixty (60) foot setback would be required for a twenty (20) foot monopole) and the setback from any public road, as measured from the right-of-way line, shall be at least equal to the height of the monopole. Response: Monopole towers are not a part of this application. c. No wireless communication facility may be established within one-hundred (100) feet of any existing, legally established wireless communication facility except when located on the same building or structure. Response: This proposal serves only the Aspen Meadows and is not within 100 feet of any other wireless communication facility. d. No portion of any antenna array shall extend beyond the property lines or into any front yard area. Guy wires shall not be anchored within any front yard area, but may be attached to the building. Response: No portion of the proposed antennas extend beyond property lines or into any front yard area. Guy wires are not part of the application. 2. Height. The following restrictions shall apply: 3 a. Wireless telecommunication services facilities and/or equipment not attached to a building shall not exceed thirty-five (35) feet in height or the maximum permissible height of the given Zone District, whichever is more restrictive. Response: The proposed wireless equipment will be attached to buildings. b. Whenever a wireless telecommunication services antenna is attached to a building roof, the antenna and support system for panel antennas shall not exceed five (5) feet above the highest portion of that roof, including parapet walls and the antenna and support system for whip antennas shall not exceed ten (10) feet above the highest portion of that roof, including parapet walls. Response: The antennas are approximately 2' tall and are below the maximum allowable height. c. The Community Development Director may approve a taller antenna height than stipulated in b. above if it is his or her determination that it is suitably camouflaged, in which case an administrative approval may be granted. Response: Not applicable d. If the Community Development Director determines that an antenna taller than stipulated in b. above cannot be suitably camouflaged, then the additional height of the antenna shall be reviewed pursuant to the process and standards (in addition to the standards of this Section) of Chapter 26.430 (Special review). Response: Not applicable e. Support and/or switching equipment shall be located inside the building, unless it can be fully screened from view as provided in the "Screening" standards (26.475.130 and 26.575.130.F.5) below. Response: Equipment cabinets will be enclosed within the Parking Garage. 3. Architectural compatibility. Whether manned or unmanned, wireless telecommunication services facilities shall be consistent with the architectural style of the surrounding architectural environment (planned or existing) considering exterior materials, roof form, scale, mass, color, texture and character. In addition: a. If such facility is accessory to an existing use, the facility shall be constructed out of materials that are equal to or o f better quality than the materials o f the principal use. Response: Not applicable. Only antennas are proposed to be installed. b. Wireless telecommunication services equipment shall be of the same color as the building or structure to which or on which such equipment is mounted or as required 4 by the appropriate decision-making authority (Community Development Director, Historic Preservation Commission, Planning and Zoning Commission or City Council, as applicable). Response: The proposed antenna at Paepeke Auditorium will be concealed by a shroud that matches the roof color. c. Whenever wireless telecommunication services equipment is mounted to the wall of a building or structure, the equipment shall be mounted in a configuration designed to blend with and be architecturally integrated into a building or other concealing structure, be as flush to the wall as technically possible and shall not project above the wall on which it is mounted. Response: The antenna at the Reception Center will be painted to blend in with the surrounding surfaces. d. Monopole support buildings, which house cellular switching devices and/or other equipment related to the use, operation or maintenance of the subject monopole, must be designed to match the architecture of adjacent buildings. If no recent and/or reasonable architectural theme is present, the Community Development Director may require a particular design that is deemed to be suitable to the subject location. Response: Not applicable. e. All utilities associated with wireless communication facilities or equipment shall be underground (also see "Screening" below). Response: All utilities associated with wireless communication facilities or equipment will be underground or in existing structures. 4. Compatibility with the natural environment. Wireless telecommunication services facilities and equipment shall be compatible with the surrounding natural environment considering land forms, topography and other natural features and shall not dominate the landscape or present a dominant silhouette on a ridge line. In addition: a. If a location at or near a mountain ridge line is selected, the applicant shall provide computerized, three-dimensional, visual simulations of the facility or equipment and other appropriate graphics to demonstrate the visual impact on the view of the affected ridges or ridge lines; an 8040 Greenline Review, pursuant to the provisions of Section 26.435.030, may also be required. Response: Not applicable. 5 b. Site disturbances shall be minimized and existing vegetation shall be preserved or improved to the extent possible, unless it can be demonstrated that such disturbance to vegetation and topography results in less visual impact to the surrounding area. Response: The approval includes requirements for protection of the existing landscape. c. Surrounding view planes shall be preserved to the extent possible. Response: The antenna will not interfere with any existing view planes. d. All wireless telecommunication services facilities and equipment shall comply with the Federal Communication Commission's regulations concerning maximum radio frequency and electromagnetic frequency emissions. Response: The applicant represents that the proposed wireless telecommunication services facilities and equipment are in compliance with the FCC's regulations. 5. Screening. Roof-and-ground-mounted wireless telecommunication services facilities and equipment, including accessory equipment, shall be screened from adjacent and nearby public rights-of-way and public or private properties by paint color selection, parapet walls, screen walls, fencing, landscaping and/or berming in a manner compatible with the building's and/or surrounding environment's design, color, materials, texture, land forms and/or topography, as appropriate or applicable. In addition: a. Whenever possible, i f monopoles are necessary for the support of antennas, they shall be located near existing utility poles, trees or other similar objects; consist of colors and materials that best blend with their background; and, have no individual antennas or climbing spikes on the pole other than those approved by the appropriate decision- making authority (Community Development Director, Historic Preservation Commission, Planning and Zoning Commission or City Council, as applicable). Response: No monopoles are proposed in this application. b. For ground-mounted facilities, landscaping may be required to achieve a total screening effect at the base of such facilities or equipment in order to screen the mechanical characteristics; a heavy emphasis on coniferous plants for year-round screening may be required. Landscaping shall be of a type and variety capable of growing within one (1) year to a landscape screen which satisfactorily obscures the visibility of the facility. Response: Not applicable. 6 c. Unless otherwise expressly approved, all cables for a facility shall be fully concealed from view underground or inside of the screening or monopole structure supporting the antennas; any cables that cannot be buried or otherwise hidden from view shall be painted to match the color of the building or other existing structure. Response: The proposed coaxial cable will be underground. There will be minimal surface mounted conduit at Paepeke Auditorium, painted to match the building. d. Chain link fencing shall be unacceptable to screen facilities, support structures or accessory and related equipment (including HVAC or mechanical equipment present on support buildings); fencing material, if used, shall be six (6) feet in height or less and shall consist of wood, masonry, stucco, stone or other acceptable materials that are opaque. Response: No fencing material is proposed in this application. e. Notwithstanding the foregoing, the facility shall comply with all additional measures deemed necessary to mitigate the visual impact of the facility. Also, in lieu of these screening standards, the Community Development Director may allow use of an alternate detailed plan and specifications for landscape and screening, including plantings, fences, walls, sign and structural applications, manufactured devices and other features designed to screen, camouflage and buffer antennas, poles and accessory uses. For example, the antenna and supporting structure or monopole may be of such design and treated with an architectural material so that it is camouflaged to resemble a tree with a single trunk and branches on its upper part. The plan should accomplish the same degree of screening achieved by meeting the standards outlined above. Response: The proposed antennas will match the color of surrounding surfaces. 6. Lighting and signage. In addition to other applicable sections of the code regulating signage or outdoor lighting, the following standards shall apply to wireless telecommunication services facilities and equipment: a. The light source for security lighting shall feature down-directional, sharp cut-off luminaries to direct, control, screen or shade in such a manner as to ensure that there is no spillage of illumination off-site. Response: Security lighting is not proposed in this application. b. Light fixtures, whether free standing or tower-mounted, shall not exceed twelve (12) feet in height as measured from finished grade. Response: Security lighting is not proposed in this application. 7 e. The display of any sign or advertising device other than public safety warnings, certifications or other required seals on any wireless communication device or structure is prohibited. Response: Signs or advertising devices are not proposed in this application. d. The telephone numbers to contact in an emergency shall be posted on each facility in conformance with the provisions of Chapter 26.510, Signs, of this Title. Response: The facility is not owned by a separate entity. The Aspen Meadows manages the property. 7. Access ways. In addition to ingress and egress requirements of the Building Code, access to and from wireless telecommunication services facilities and equipment shall be regulated as follows: a. No wireless communication device or facility shall be located in a required parking, maneuvering or vehicle/pedestrian circulation area such that it interferes with or in any way impairs the intent or functionality of the original design. Response: The wireless antennas are roof mounted. b. The facility must be secured from access by the general public but access for emergency services must be ensured. Access roads must be capable of supporting all potential emergency response vehicles and equipment. Response: The general public will not have access to the roof top antennas, or the equipment room. c. The proposed easements for ingress and egress and for electrical and telephone shall be recorded at the County Clerk and Recorder's Office prior to the issuance of building permits. (Ord. Project description & Loading configuration: Paepcke Building: The roof upon which (2) antennas will be installed is framed with 2x10 roof joists @ 16" on center. The top of the roof parapet is approx. 22'-2" H, and the top of antennas will be at a height of 24'-9". The proposed antennas will be mounted on a non-penetrating roof top tripod mount. The proposed coax cable will be run up through an existing conduit from the attic to the roof top. (4) proposed RF distribution units will be installed in the existing attic. The existing attic is steel and concrete framed. The RF units add a load of approximately 145 psf over a footprint of approx. 2.5 square feet. Reception Building: There is an existing steel framed, perforated screen wall on the north end of the reception building with a top height of approx. 25'. The proposed single antenna will be mounted to this existing steel frame. For wind loading purposes, since perforated screen panels are calculated as a solid structure, and the antenna will be within the area of the screen wall, there is no increase of wind load on the screen. The proposed coax cable will be routed from the existing telco room in the reception building through the exterior wall (following existing exterior mounted conduit), under the mechanical screen to the antenna. (2) proposed RF distribution units will be installed in the existing telco room in the reception building. They will be wall mounted to an existing 2*4 framed wall and add a weight of 88 lbs each. Cellular and PCS base station antennas transmit and receive radio signals to and from wireless phones. These radio signals are radiofrequency (RF) emissions that are transmitted intermittently at very low power levels within radiofrequency bands that formerly included UHF television and now include cellular, PCS, public safety service, and other telecommunication services. AT&T Mobility's antenna facilities comply with the rules established by the Federal Communications Commission (FCC) to limit exposure to RF emissions from FCC-licensed antenna facilities. Who is responsible for setting safety standards for radio signals from antenna facilities? The National Environmental Policy Act of 1969 (NEPA) requires agencies of the Federal Government to evaluate the effects of their actions on the quality of the human environment. To meet its responsibilities under NEPA, the FCC has adopted requirements for evaluating the environmental impact of its actions, including the licensing and regulation of FCC-regulated transmitting antennas. One of several factors addressed by these requirements is human exposure to RF energy emitted by FCC-regulated transmitters. In its 1996 Report and Order and its 1997 Second Memorandum Opinion and Order in ET Docket 93-62 (http://www.fcc.gov/oet/dockets/et93-62/), the FCC established guidelines for evaluating the environmental effects of RF radiation. The FCC's primary jurisdiction is not in the health and safety area. Thus, the guidelines for Maximum Permissible Exposure (MPE) to RF emissions adopted by the FCC were derived from the recommendations of two expert organizations - the National Council on Radiation Protection and Measurements (NCRP) and the Institute of Electrical and Electronic Engineers (IEEE). The NCRP and IEEE exposure criteria were developed by expert scientists and engineers after extensive review of the scientific literature related to RF biological effects. The FCC also consulted with the Environmental Protection Agency (EPA), Food and Drug Administration (FDA), Occupational Safety and Health Administrations (OSHA), and National Institute for Occupational Safety and Health (NIOSH) and obtained their support for the guidelines the FCC is now using. What are the RF safety standards for wireless antenna facilities? The FCC rules define two exposure environments with MPE limits designed to provide a large margin of safety. The more restrictive General Public (or Uncontrolled) environment applies to locations where exposure to RF emissions of persons who have no knowledge or control of their exposure may occur. The MPE limits for this environment are 5 times more restrictive than those for the other environment, the Occupational (or Controlled) environment. The Occupational environment applies to locations where exposure to RF emissions may be incurred by persons who have been made fully aware of the potential for exposure and are able to exercise control over their exposure. MPE limits are normally expressed as power densities and are dependent upon the frequencies used for RF emissions. Power density is normally expressed as microwatts per square centimeter or milliwatts per square centimeter, where a microwatt is one-millionth of a watt and a milliwatt is one-thousandth of a watt. The chart below shows the most restrictive FCC MPE limits for each exposure environment in each ofthe two AT&T frequency bands. Yes. The FCC RF exposure guidelines are based on exposure criteria recommended in 1986 by the NCRP and on the 1991 standard developed by the IEEE, which was later adopted as a standard by the American National Standards Institute (ANSI). These organizations are internationally recognized for their expertise in establishing radiation protection standards. The FCC rules constitute a consensus of the federal agencies responsible for public health, occupational safety, and the environment, including the EPA, FDA, OSHA, and NIOSH. As the landlord, am I responsible for ensuring that antenna facilities on my premises comply with the FCC RF exposure guidelines? No. FCC licensees are generally responsible for compliance with FCC rules, including the RF exposure guidelines. However, because site owners and landlords have significant control over allowable activities on their properties by FCC-regulated entities, the FCC has asked site owners to allow FCC-regulated entities to take steps necessary to comply with the RF exposure rules and to encourage common solutions for controlling access to areas where RF exposure levels may exceed the FCC's exposure limits. This will enable AT&T Mobility to coordinate with all operators on your property to collect the data needed to evaluate RF exposure at sites with multiple transmitters. At some sites, AT&T may need to conduct on-site measurements. Allowing these measurements will help to expedite the evaluation process and ensure that AT&T Mobility antenna facilities located on your premises comply with the FCC rules. What are on-site measurements? On-site measurements are frequently needed for evaluation of compliance with the FCC RF exposure rules at sites where multiple transmitters are collocated. Measurements are performed using a probe that senses levels of RF emissions and a connected meter that displays those levels as power densities. The power densities are displayed on the meter as percentages of the FCC's MPE limits. The on-site measurements may be conducted by either AT&T Mobility employees or consultants who are trained in the use of the measuring equipment and the application of the FCC rules.
