MEMORANDUM TO: Bill Drueding, Zoning FROM: Leslie Lamont, Planning RE: Insubstantial Amendment for Clarendon PUD - Fifth Amendment to the PUD DATE: September 9, 1991 0 SUMMARY: The Clarendon Homeowners Association seeks to amend their PUD Agreement to install skylights and enclose an interior light well. Staff has determined that this is an insubstantial amendment to the PUD. Staff recommends approval of the amendments to the PUD plan and agreement. REVIEW STANDARDS: Pursuant to Section 24-7-907 an insubstantial amendment to the PUD may be authorized by the Planning Director if the change does not: 1. Change the use or character of the development. 2. Increase by greater than 3% the overall coverage of structures on the land. 3. Will not substantially increase trip generation rates of the proposed development, or the demand for public facilities. 4. Reduce by greater than 3% the approved open space. 5. Reduce by greater than 1% the off-street parking and loading space. 6. Reduce the required pavement widths or rights-of- way for streets and easements. 7. Increase by greater than 2% the approved gross leasable floor area of commercial buildings. 8. Increase by greater than 1% the approved residential density of the proposed development. 9. Create a change that is inconsistent with a condition or representation Of the project's original approval or which requires granting a further variation from the project's approved dimensional requirements. FINDINGS: The homeowner's seek to substitute a sloping roof and skylights for a deck off of the master bedroom of each unit. The sloping roof will add a small amount of volume to the living room .. below thereby adding approximately 3.3 square feet of floor area per dwelling unit and a total of 49.5 square feet of floor area for the entire PUD. The sloped roof will affect exterior elevations by deleting the handrail and substituting sill height windows for sliding doors in the master bedroom end wall. In addition to the skylight addition, the applicants wish to fill in part of an existing light well in front of the chimney at the second floor level. This will add space for built-in shelving or entertainment equipment. The filled area equals approximately 13.6 square feet of floor area for a total of 202.5 square feet for the entire project. The area to be converted for shelving space is located within the existing building envelope of the master bedroom. Please see attached drawings of the proposed amendments. The City Council approved the fourth amendment to the Clarendon PUD at their July 22, 1991 meeting. That amendment approved additional floor area for an expanded master bedroom and bay windows for all fifteen units, and a third bedroom for five of the units. The fourth amendment represents an additional 6,715 square feet of floor area. This proposal will add an additional 252 square feet of floor area. The approval of this PUD amendment will increase the total amount of floor area of the entire PUD to 32,897 (24,358 sq. ft. = existing free market units, 684 sq. ft. = on-site deed restricted employee unit and 888 sq. ft. = on-site storage/office space). As part of the review process of the fourth amendment, staff calculated the allowable floor area for the entire parcel. Please see attached calculations. As the figures show the allowable floor area for a parcel this size in the R-6 zone is 38,270 square feet. Therefore, because this amendment does not exceed the allowable floor area for the R-6 zone, staff recommends approval of this amendment. The proposal complies with above standards for an insubstantial amendment to the PUD development plan and is consistent with the recent review and approval of the substantial amendment to the PUD that was approved July 22, 1991. RECOMMENDATION: Staff recommends approval of the insubstantial amendment to install skylights and a sloping roof and enclose an indoor light well for all 15 units for a total additional floor area of 252 square feet with the condition that prior to the issuance of any building permits: 1. the additional floor area shall be confirmed by the Zoning Officer; 2. the total floor area on the parcel shall not exceed 38,270 square feet and a note to this affect shall be included in the amended PUD Agreement and amended PUD Plan; 2 .. 3. an amended PUD agreement and amended PUD Plan shall be filed with the Pitkin County Clerk and Recorder within 180 days of approval by the PLanning Director; and 4. all representations that the applicant has made regarding this fifth amendment to the PUD shall be adhered to during the renovation. This location is below an existing sloping roof and at the highest point the roof is approximately 5' above the floor.
