PROBLEM DISCUSSION: The primary issue is whether the proposed 340 eq•'Af"Y* square foot addition complies with the provisions of the planned 6,4 4 /6- unit development regulations. Staff finds no probl em with the - )+L,£*,64'effect of this proposal on existing vegetation, the character of the neighborhood, or architectural character of the existing /1, slyk.·M residence. We concur with the applicant's comments listed next to Section 24-8.13(a)(attached) that there are no significant impacts from this proj ect. Staft also supports the deci sion made by the Board of Adj ustment addressing the setback issue, allowing a 4.5' encroachment into the 15' rear yard setback and no encroachment in the western setback. If the applicants desire any further variations in setback requirements, they can only be considered through the full PUD review process and not the exemption. We do not recommend this course of action. 4 RECOMMENDATION: The Planning Office recommenks approval of exemption form mandatory PUD for the requested 329 s.f. addition to the Gleason residence subject to the condition that it be located no less than five feet from the west property line and no less than 10.5 feet from the south property line. Galena Aspen CO 81612 . , Dear Sir, The purpose of this letter is to request an exemption for mandatory PUD so that we may be *ranted a building permit to enclose an existing 10'x 32'deck at 861 Ute Ave. (Lot 11 Ute Subdivision.) Our house contains a studio apartment which as added in 1974 while we · were zoned multi-family. We are currently zoned R-6 -- single family, which seems incongruous considering the nature of the neighborhood. Adjacent to use are Aspen Alps condominiums (south), Black Swan condos (west), Clarendon condos (north) and Gant (east). The new 30-unit lodge at Aspen Condominium Hotel will be a block west. The Ski Co. hotel/convention center at the base of little Nell and the Aspem Club Lodge are only two blocks away. (See location map, figure A.) Our house was built in 1961 as a family vaction home. We have retired to Aspen and require space and facilities for fulltime living. The proposed remodel is shown as the shaded portions of Figure B 1-4. Living space will increase from 850 square feet to 1,190 square feet -- a modest size for this neighborhood but a crucial allowance for our needs. The spiral staircase (steep, narrow and dangerous for seniors and below standards for the current code) will be replaced with a conventional staircase. Also, the present 450 square feet of single-glazed windows will be replaced with 300 square feet of double-glazed windows for increased energy efficiency. SURVEY INEQUITIES -- Subsequent surveys have shifted lot lines, leaving questionable boundaries to west and south (See Figure B). Surveyor claims all boundaries in that neighborhood are subject to dispute. IMPACT -- Proposed enclosure of existing deck will not have negative impact on neighborhood or comprehensive plan. Aspen Alps open space lies to rear where alteration will occur, condominiums surround us, new hotels at base of Little Nell are one block and two blocks away, etc. Hardships RESTRICTED SPACE -- House was built as family vacation home; owners now have retired and require space and facilities for fulltime living. For example, there are no closets. The proposed renovation will include six closets and increase living space from 860 sqaare feet to 1190 square feet. SAFETY -- Spiral staircase is steep, narrow and dangerous for senior citizens. Present code requires 7' diameter, ours is 4 ' . This will be replaced with a conventional staircase in new design. ENERGY EFFICIENCY r- Present house has 450 square feet of single-glazed windows, with a 40 percent meat loss. New design has 300 square feet of double-glazed south-facing windows. MEDICAL -- Enlarged master bedroom with slab floor will accommodate water bed which has provided great relief in the past for owner's rheumatoid arthritis.
