Galena 611 j 13 Aspen, CO 81611 I Re: Gant storage shed Dear Leslie: I am counsel for The Gant Condominium Association. The Gant is relocating a storage shed, and I understand is processing a small land use approval. The area of the new shed is shown on The Gant's condominium plat as a common element. As you know, common elements are owned by all individual owners in accordance with their percentage interests under the condominium declarations. However under that declaration The Gant Condominium Association has the following authority: "4.1 Association As Attorney-in-Fact for Owners. The Association is hereby irrevocably appointed attorney-in- fact for the Owners of all Condominium Units and each of them to manage, control and deal with the interest of such Owner in Common Elements so as to permit the Association to fulfill all of its duties and obligations hereunder and to exercise all of its rights hereunder; to deal with the Project upon its destruction or obsolescence as hereinafter provided; and to deal with and handle insurance and insurance proceeds and condemnation and condemnation awards as hereinafter provided. The acceptance by any person or entity of any interest in any Condominium Unit shall constitute an appointment of the Association as attorney-in-fact as herein provided. 4.2 Common Element Maintenance. The Association shall be obligated to provide for the care, operation, management maintenance, repair and replacement of *Member. Colo. (1971). Calif. (1969), and D.C. (1966] bars J. Without limiting the generality of the foregoing, said obligations shallinclude keeping the Common Elements in good, clean, attractive and sanitary condition, order and repair; removing snow and any other materials from the Common Elements to permit access to the Project and to the Individual Space of each Condominium Unit; keeping the Project safe, attractive and maintained in ia manner desirable as a residential community; and making necessary or desirable alterations, additions, betterments or improvements to or on the Common Elements." The reconstructed shed will be the same size, shape and construction of the original shed. We would like to locate the new storage shed on the east side of the property. A site plan and architectural rendering are attached. The reconstructed shed will be more than ten feet from the property line to accommodate the required set-backs. The original shed was 72 square feet and the new shed will also be 72 square feet. We would appreciate your assistance with any necessary approvals so we can proceed with the building permit application. Thank you.
