SUMMARY:
Bruce Hazzard of Design Workshop and Scott Erwin of Maroon Creek Club,
representing the Maroon Creek Club, owner, is requesting an insubstantial
amendment to a Planned Unit Development (PUD) approval. As part of the
initial Maroon Creek Club approvals, the Club was granted (and mitigated for)
1200 square feet for golf course ancillary structures. To date only 312 square feet
has been used for a starter shack and comfort station. The applicant is requesting
to transfer the remaining square footage to be used for the clubhouse and for a
10'x10' summer -only food tent on the golf course.
Staff has reviewed this proposed amendment and recommends administrative
approval by the Director, with conditions.

STAFF COMMENTS:
Review criteria and Staff Findings have been included as Exhibit "A." The
applicant's request is Exhibit `B."
RECOMMENDATION:
Staff recommends the Community Development Director approve this Insubstantial
PUD Amendment to transfer square footage from "golf course ancillary structures"
to the clubhouse and seasonal food tent.
APPROVAL:
1 hereby approve this Insubstantial Amendment to the Maroon Creek Club Planned
Unit Development to transfer a total of 888 square feet of commercial floor area
from the golf course ancillary structures to allow 788 square feet to transfer to the
clubhouse for an expansion and 100 square feet for a seasonal food tent on the golf
course, with the following conditions:
I . The applicant shall obtain all necessary approvals from the Environmental
Health Department for the food service operations.
2. Building permit applications will be submitted for any additions to the
clubhouse.
3. Any request to move the food tent from its location between the 1 Oth and
I Ith holes will require approval from the Community Development
Department.
4. The food tent will be limited to 90 days of operation during the summer
months.

Review Criteria
Insubstantial PUD Amendment.
A change in the use or character of the development.
Staff Finding:
With this proposed amendment, the use and intensity remains the same as approved.
The change does not alter the character of the development.
2. An increase by greater than three (3) percent in the overall coverage of structures on
the land.
Staff Finding:
This proposal may actually reduce the overall coverage of structures as a large portion
of the FAR is being absorbed into an existing building.
Any amendment that substantially increases trip generation rates of the proposed
development, or the demand for public facilities.
Staff Finding:
Trip generation and demand for public infrastructure are not affected by this change.
4. A reduction by greater than three (3) percent of the approved open space.
Staff Finding:
There is no reduction in required open space.
5. A reduction by greater than one (1) percent of the off-street parking and loading
space.
Staff Finding:
The applicant is not requesting an amendment to the existing or required number of
parking spaces.
6. A reduction in required pavement widths or rights -of -way for streets and easements.
Staff Finding:
The applicant is not proposing changes to right-of-way widths.
7. An increase of greater than two (2) percent in the approved gross leasable floor area
of commercial buildings.
Staff Finding:
The square footage will remain the same as approved and mitigated for with the initial
PUD approvals.
8. An increase by greater than one (1) percent in the approved residential density of the
development.
Staff Finding:
The applicant is not proposing a change in the residential density.
9. Any change which is inconsistent with a condition or representation of the project's
original approval or which requires granting a further variation from the project's
approved use or dimensional requirements.
Staff Finding:
The proposed amendment does require an alteration to the dimensional requirements
as established in the PUD.

Temporary/ Seasonal Use: The Applicant is requesting an insubstantial amendment to the
development approvals for the Maroon Creek Club such that a seasonaV temporary tent structure
would be allowed during, and only during operational times for the golf course. This tent, shade
structure would be a 10' x 10, tent structure located (see graphic) between the 10d' and 11'l holes
of the golf course and would provide limited food service to golfers.
1. It'a size and location will not cause visual impacts from public roads.
2. The tent will serve a limited menu for a limited time frame and is appropriate as a use
for a golf course.
3. There will be no impacts on traffic, municipal services, noise levels or neighborhood
character. eeial use permit that will expire
4. The Applicant has previously requested a temporary sp
on or about July 6, but the request is for an annual period of 90 days of operation.
5. The use falls within the nature and intent of the Park (P) zone district of the PUD,
6. There are no required additional changes in the surrounding land uses within the PUD
that would prohibit this use.
7. The teat and limited food service are solely for the use of golfers, but the Applicant will
fully comply with the appropriate regulations and standards sat forth by the
Environmental Health Department, thereby protecting the health, safety and welfare of
the general public.
Pleasc review these items with the Community Development Director and let me know, if this is
feasible and whether it can be done as an administrative action as a minor amendment to a
development permit.
