A RESOLUTION OF THE CITY COUNCIL OF ASPEN, COLORADO
GRANTING SUBSTITUTION OF CORTINA LODGE EMPLOYEE UNITS
FOR ON-SITE HOTEL JEROME EMPLOYEE UNITS
WHEREAS, pursuant to Article 8 , Amended and Restated Planned
Unit Development Agreement ; Hotel Jerome - Renovation and
Addition, the Hotel Jerome Limited Partnership (hereinafter
"Applicant" ) did submit a request for elimination of the appli-
cant ' s on-site employee bedroom requirement in exchange for
provision of additional Cortina Lodge employee units, which may
be acceptable to the City; and
WHEREAS, the Housing Authority reviewed the proposed
employee housing substitution and recommended approval on
December 10 , 1986 ; and
WHEREAS, on January 12 , 1987 City Council reviewed the
proposed employee housing substitution and did pass a motion
granting its approval subject to the condition stated below.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Aspen,
Colorado, that it approves the substitution of Hotel Jerome on-
site employee housing units 1,2 ,3 and 4 with Cortina Lodge units
6 and 7 subject to the following conditions:
1) Units 6 and 7 of the Cortina Lodge shall be deed
restricted to the low income employee housing guide-
lines for rental use for Hotel Jerome employees. Deed
restrictions shall be filed to the satisfaction of the
City Attorney with the Pitkin County Clerk and Record' s
Office prior to the issuance of a Certificate of
Occupancy for the Hotel Jerome Addition.
2) All conditions of approval stated in Council ' s December
9 , 1985 approval of the exemption from the Growth
Management Quota System for the change in use of the
Cortina Lodge and subdivision exception for the purpose
of condominiumizing the Cortina Lodge shall be met
prior to issuance of a Certificate of Occupancy for the
Hotel Jerome Addition, including but not limited to the
following: upgrading and improvements to the Cortina
facility and grounds , employee housing deed restric-
tions of all units, and recordation of a condominium-
ization plat.

SUMMARY: The Planning Office recommends approval of Resolution
1 , ( Series of 1987) , substituting units at the Cortina for
on-site employee housing units. However, use of the Rio Grande
parking lot for Hotel Jerome guests is not supported by the
Engineering Department or Planning Office as presented.
APPLICANTS REQUEST: The applicant requests approval of substitu-
ting 4 on-site employee bedrooms for two 2-bedroom units in the
Cortina , and use of the Rio Grande parking lot for overnight
guest parking of up to 25 cars until the garage is built.
PREVIOUS COUNCIL ACTION: City Council approved an amended Planned
Unit Development agreement for the Hotel Jerome renovation and
addition on July 28, 1986 . The Cortina employee housing conver-
sion (GMP exemption for change in use and condominiumization) was
approved on December 9 , 1985 by Council .
BACKGROUND: Article 8 of the Hotel Jerome PUD Agreement described
the Jerome employee housing program as follows, in part:
"With regard to Phase I, Owner hereby agrees that Rooms No.
"1" , "2", "3" and "4" in the hotel annex, as such rooms are
designated on the amended plat , shall be and hereby are
restricted exclusively to use as employee housing under and
in accordance with such City of Aspen employee housing use,
occupancy, rental and sales price guidelines as may be in
effect and applicable from time to time, sufficient to house
four (4 ) employees of the Project and restricted to a
maximum occupancy of one (1) employee per bedroom.
. . . Further, should Owner secure more units than are
necessary to house fifteen (15) employees off site, Owner' s
on-site employee bedroom requirement for Phase I ( i. e. , the
annex Rooms No. 1 ,2 ,3 and 4) shall be reduced and deed
restrictions released by the exact amount of housing as may
be acceptable to as reflected by resolution of the City
Council. "
A number of conditions were set by Council in approving the
Cortina 's conversion to an employee housing project . Included
were: employee housing deed-restriction of all units, some to be
reserved for future employee housing needs , restriction that
units be rental and not for sale, and a schedule of improvements
to the grounds and facility.
PROBLEM DISCUSSION:
A. Referral Comments:
1. Engineering Department: Elyse Elliott stated in a
December 17 , 1986 memorandum that the Engineering
Department is not inclined to restrict a portion of the
Rio Grande parking lot for the sole use of the Hotel
Jerome ' s guests because it is a public parking lot.
Further mentioned is that if the construction workers
would park in the Rio Grande as was required in the
original review of the Jerome PUD, it would make more
neighborhood parking available.
2 . Housing Authority: Approval for the requested off-site
housing substitution was recommended by the Housing
Authority , as documented in Ann Bowman' s January 5,
1987 memorandum.
3 . City Attorney: The City Attorney stated in his December
22 , 1981 memorandum that the necessary documents
reflecting the employee housing approval should be
recorded in the Pitkin County Clerk and Recorder ' s
Office .
B. Planning Office Comments:
The employee housing substitution consists of deed restricting
two 2-bedroom units, both approximately 228 s.f. , in the Cortina
instead of four 1-bedroom units , containing approximately 229
s.f. each, in the Jerome. The formula of employee generation and
employee housing obligation was calculated for the 1983 Jerome
PUD Agreement, and carried forward in the amended PUD plan and
Cortina conversion approval . This formula will not change by the
proposal, although the quality of the Cortina units is probably
less than the on-site units. The Housing Authority has continued
to support the dormitory use of the Cortina. It is reasonable to
expect the Cortina to provide decent accommodations at low rents
(less than $90/month) for Jerome employees. In total, nine units
of the Cortina ' s 17 units would be deed-restricted for Jerome
employees. Corrections of deficiencies, upgrading and improve-
ments to the Cortina set in Council ' s conditions of approval must
be accomplished prior to recording the Cortina condominiumization
plat and issuing the Hotel Jerome Addition ' s Certificate of
Occupancy.
Please also note that the change in use of the Jerome units to
offices for the hotel is exempt from GMP and not subject to
review as the Hotel is a designated historic structure.
The applicant' s proposed short-term parking arrangement consists
of reserving up to 25 parking spaces in the Rio Grande parking
lot for overnight guest parking. The use would be terminated
upon completion of the 51 space garage in the Jerome Addition.
The Engineering Department has not favorably received this
proposal. Their concerns are the exclusively private use of
public property, and the problem of neighborhood parking that is
likely to persist. We also note that the current level of use of
Rio Grande parking is high; and therefore, there may be added
parking pressures elsewhere. If Council believes that the
Jerome ' s use of Rio Grande parking lot is appropriate and will
help solve parking problems, then we suggest that a user' s fee be
charged to the applicant.

Dear Alan:
The Amended and Restated Planned Unit Development Agreement for
the Hotel Jerome , Article 8 , Employee Housing states that
" . . . should Owner secure more units than are necessary to house
fifteen ( 15) employees off-site, owner ' s on-site employee bedroom
requirement for Phase I ( i .e . the Annex rooms No . 1 ,2, 3 , and 4)
shall be reduced and deed restrictions released by the exact
amount of housing as may be acceptable to City as reflected by
resolution of the City Council" .
It has become apparent that the top floor of the Annex be used as
offices for the operation of the Hotel. To this end we have met
with Ann Bowman of the Housing Office and have agreed to restrict
two units in the Cortina Lodge to accommodate the four employees
housed in the Annex of the Hotel . Specifically they are units 6
and 7 and the deed restrictions shall specify low income
guidelines with a monthly rental per person of ninety ($90 .00)
dollars. This will benefit the City' s low income inventory as
currently the restriction on the Annex housing is only for Hotel
employees and does not specify a guideline .
I am herein requesting a hearing before City Council to seek
approval for this change in the PUD by resolution of City
Council .
Also, I would like to address the problem of guest parking for
the Jerome this winter . Because the Hotel addition is under
construction guests staying in the renovated portion will be
forced to park on the streets. During the public hearing on the
Amendment of the PUD many neighbors complained about the cars of
the laborers on the Hotel. This winter the inconvenience will be
aggravated by the snow and the need for guest parking. We have
instructed the workmen to use the Rio Grande Lot but much of the
construction equipment will necessarily be on the streets
surrounding the hotel.
I would like Council to consider allowing the Jerome to use a
specific portion of the Rio Grande Lot to accommodate overnight
guest parking for up to twenty-five cars . This would be
accomplished by the Jerome having permit cards for guest ' s
automobiles and restricting those cars to a specific section of
the Rio Grande Lot. Because the cars will be there overnight ,
snow removal for that area of the Rio Grande will be the
responsibility of the Hotel. In the alternative the City could
bill the Jerome for a portion of the snow removal . Any
arrangement would probably work , as determined by the City
Engineer .
Thank you for your attention in this matter . Please find
enclosed the application fee of $405 .00.

We are not inclined to restrict a portion of the Rio Grande
Parking Lot for the sole use of Hotel Jerome's guests. The Rio
Grande is a public parking lot and should not be restricted for
private use.
The laborers on the construction portion of the Hotel Jerome
continue to park on the neighborhood streets instead of in the
Rio Grande Lot. If the laborers would park in the Rio Grande
Lot, it would make neighborhood parking available.

The employee housing request is dependent upon approval of the
appropriate reviewing bodies, and we have no comment except to
request that the necessary documents reflecting the approval be

The request for parking must be approved by the City Council, and
we will defer comment until the Council has considered the
request. We assume that any allocation of the Rio Grande lot
would be short-term only.
