MEMORANDUM TO: Amy Margerum, Planning Director FROM: Leslie Lamont, Planner RE: Aspen Club Condominium Insubstantial Amendment to the PUD and Stream Margin Exemption DATE: May 2, 1990 SUMMARY: The applicant is proposing to expand an existing deck located in the Aspen Club PUD, Unit E-1. The deck is currently 325 square feet and the applicant wishes to add another 178 square feet. This unit also has a 198 square foot front deck. the total deck space will equal 701 square feet. The representative, Sharon Kahn, of this proposal was able to identify specific documentation regarding the deck area allowed in the Aspen Club PUD. That documentation substantiates that the allowed square footage of a deck in this PUD, based upon the allowed floor area of each unit, is 701 square feet. It is staff's interpretation that because the deck expansion does not increase the actual living space of the unit and the square footage for the deck is in substantial compliance with the PUD. Section 7-908 of the Land Use Code enables the Planning Director to review an amendment to an approved development order for a Final Development Plan. The location of the unit is within the 100 horizontal feet of the highwater line and subject to Stream Margin Review. FINDINGS: The existing deck area of the unit is 523 square feet. The applicant proposes to extend the deck by another 178 square feet for a total of 701 square feet. Insubstantial Amendment: Section 7-908 outlines the criteria for an insubstantial amendment. This proposal does not change the character of the development, increase the overall coverage of structures by 3% or reduce the open space by more than 3%, increase trip generation or reduce the off-street parking and required pavement widths or rights-of-way for streets and easements. In addition the proposal does not increase by greater .. than 1% the approved density or is inconsistent with the original approval. Research of the many files for the Aspen Club PUD revealed a very thorough review of allowed floor areas done by Alice Davis in 1983. Alice, using parcel size and existing development determined the allowed floor area of each unit to be 4,672 square feet. According to the Code, a deck may be no greater than 15% of the maximum allowable floor area of the unit size before the deck area is counted in the overall allowable floor area for that unit. Thus the maximum allowable floor area for a deck in this PUD is 701 square feet. Please see attached Planning Director sign-off for a deck expansion in 1983. This application requests a deck expansion up to 575 square feet. The expansion complies with the review criteria for an insubstantial amendment. Stream Margin Review: In addition, the location of the unit is within the 100 horizontal feet of the highwater line and subject to Stream Margin Review. The Engineering Department has determined that this application qualifies as an exemption. The Engineering Department does however require that no vegetation be disturbed between the building envelope and the edge of the river and that the applicant submit a letter which outlines the construction procedure to the Engineering Department before any building permit is issued. Please see attached Engineering referral. RECOMMENDATION: Staff recommends that the Planning Director approve the Stream Margin Exemption and the Insubstantial Amendment for a deck expansion with the following conditions: 1. No vegetation shall be disturbed between the building envelope and the edge of the river. 2. Prior to the issuance of a building permit, the applicant shall submit a letter which outlines the construction procedure to the Engineering Department. 3. This approval is for a 250 square foot addition to the existing deck only. As you know, any change to this complex requires amendment of the adopted PUD plan for the property, pursuant to Section 7-907 of the Code. The homeowners' representative, Chuck Frias, has worked with me to evaluate whether or not the amendment Will be considered insubstantial. He has provided me the attached two documents to assist in this evaluation. First, labeled, "Exhibit A" is the Asite data tabulation for the original PUD approval for the project. Second, labeled "Exhibit B" is a recent takeoff of existing conditions, done by Shae Lee, on behalf of the homeowners. The key criterion which needed to be analyzed is whether through prior or pending amendments, the overall coverage of structures in the project increases by more than 3%. The analysis demonstrates that the townhomes cover 28,000 sq. ft. Of land (note the consistency between this measurement and the original approval shown on Exhibit A), while covered parking amounts to an additional 15,168 sq. ft. Therefore, 3% of this total would permit a cumulative expansion of 1,295 square feet to occur. To date, we have permitted 5 deck expansions to occur, amounting to 1,022 sq. ft. I thereby find that you may approve one or more deck expansions to the Aspen Club Townhomes, provided the total expansion does not exceed 273 sq. ft. Please let me know if you require any additional information to process the permits which have been awaiting completion of this 1 analysis. If, during your review of the permits, you are unable 4 to verify any of the findings made herein, please let me know.
