Revised foundation and site coverage plans shall be pre- pared which continue to leave the steep slope of the River bank undisturbed and eliminate the need to remove more than the four cottonwood trees identified. 2 . The applicant shall replant, or replace with new trees the four cottonwood trees prior to occupancy of the addiion. A -revised site plan showing relocation of three cottonwood trees, specifying the caliper at a minimum of 2 1/2" - 3" , and planting one blue spruce a minimum of 8 ' tall shall be submitted to the satisfaction of the Planning Office prior to issuance of a Building Permit. 3 . The lower deck shall either be removed or anchored for the purpose of not breaking loose in case of a flood. Design of the anchoring shall be approved by a professional engineer and it shall be installed prior to occupancy of the addit- ion. 4 . The application is submitted pursuant to Section 24-6. 3 of the Municipal Code by Mr. Harlan Lee, the prospective purchaser of the property. Consent to the application has been obtained from the property' s current owners, Mr. and Mrs. Luis Sneider, and is attached hereto as Exhibit A. A commitment for title insurance from Stewart Title Guaranty Company evidencing the Sneiders ' ownership is attached as Exhibit B. Project Description As the accompanying improvement survey illustrates, the Applicant wishes to construct an approximately 400 square foot addition to an existing two story residence located on Lot 12 of the Calderwood Subdivision. The existing residence contains approximately 2 , 100 square feet while the lot, which is zoned R-15 , contains approximately 8,700 square feet. While the existing residence may constitute a non-conforming structure, the proposed addition will comply with all applicable area and bulk requirements. In addition, the resulting 2, 500 square foot structure will be well within the maximum allowable floor area of ap- proximately 4 ,000 square feet which is attributable to the lot in question. P.O. Approval was granted in April of 1978 for miscellaneous additions to the existing structure. A condition of that approval was the granting of a trail easement along the river bank in the event one was required by the Trail System Master Plan. No provision for such a trail was apparently contained in the Master Plan and no easement was dedicated as evidenced by the attached title informa- tion. Review Requirements With respect to the specific review criteria of Section 24-6. 3 (e) , the following comments are provided in support of the Applicant' s request for stream margin review approval. 1. As the accompanying improvement survey il- lustrates, the proposed addition is located well beyond the 100 year flood boundary. 2. To the best of the Applicant' s knowledge, no trail has been designated across the property in question. 3 . The Roaring Fork Greenway Plan contains no site specific recommendations with respect to the property in question. 4. The proposed addition is expected to utilize a caisson and bond beam foundation in order to minimize slope disruption. In the event detailed soil analysis requires a different foundation technique, the Applicant will submit excavation drawings to the City' s Engineering Department for review. Appropriate safeguards will be used during construction to prevent sedimentation of the River, and all disturbed areas will be revegetated. While the addition may require the removal of two ( 2) or three ( 3 ) existing cottonwoods, no significant alteration of the River bank will be required. Appropriate permits for the removal of the trees will be obtained as required. 5. The proposed addition will have no adverse effect upon the natural changes normally experienced by the Roaring Fork River. As noted previously, all dis- turbed areas will be revegetated to preclude erosion and . . No alteration or relocation of the water course will be required as a result of the Applicant' s proposal. 7. Based on the above, the Applicant believes that the proposed addition is in compliance with the intent and requirements of Section 24-6 . 3 and, as such, will have no detrimental impact upon the Roaring Fork River. ZONING: R-15 APPLICANT'S REQUEST: Harlan Lee, contract purchaser of the subject property, requests approval to build an addition of approximately 400 square feet to the existing single family residence. Present owners, Luis and Sylvia Sneider, have con- sented to the application. PREVIOUS COMMISSION ACTION: Lot 12 of the Calderwood Subdivision was subject to a stream margin review in 1976. Applicant Ben Deane was given approval for construction of an addition and a new deck, subject to preservation of as many large trees in the new deck area as practical and with the advice and assistance of the county agricultural agent to ensure their preservation, and subject to granting of trail easements on the bank of the Roaring Fork River provided that it is warranted by the Adopted Trail System Master Plan. The deck was constructed with holes to allow the trees to grow through. PROBLEM DISCUSSION: A. Referral Comments: 1. Engineering Department: Jim Gibbard noted in his September 22 memorandum that the two or three cotton- wood trees (over 6" in caliper) contribute signifi- cantly to the stabilization of the bank. It should be demonstrated that removal of the trees will not cause problems with erosion in this area. In addition, an existing small wood deck down the bank extends over into the 100 year flood plain and should be properly anchored, as determined by a Professional Engineer. B. Staff Comments: The Planning Office has the following comments in response to the review criteria of the stream margin and flood hazard review in Section 24-6. 3 (e) of the Municipal Code: Criteria (1) :"No development shall occur within a special flood hazard area unless it can be demonstrated that there will be no increase in base flood elevation as a result of the, development, as shown by an elevation certificate prepared by a professional engineer registered to practice in the State of Colorado. " Response: The proposed addition does not occur within the special flood hazard area; however, an existing deck, for which no building permit was issued, is located in the flood hazard area. Following the Engineering Department's suggestion, this deck should be properly anchored. Criteria (2) : "In the event there is a trail designated by an approved trail plan within the development site, such trail shall be dedicated for public use. " Response: The Aspen Area Comprehensive Plan: Parks/Recreation/- Open Space/Trails Element indicates no trail along the west (south) side of the River in this vicinity. A trail is shown on the east side of the River, opposite from Lot 12 . Criteria (3) : "All attempts should be made to implement the recommendations of the Roaring Fork Greenway Plan prepared by the Roaring Fork Greenway Committee. " Response: The Roaring Fork Greenway Plan, prepared in 1973 , makes general recommendations on the protection of the natural environ- ment of flood plains and adjacent areas. Recommendation B. 9 states: "Strive to maintain the Greenway as a natural area by keeping construction to a minimum. " The south portion of Lot 12 contains five cottonwood trees that would be effected by the new addition. Two trees, each approxi- mately 4" in caliper and 20 ' tall, are situated on the flat area south of the house, and would be removed. An 8" caliper cotton- wood is located on the flat area at the edge of the bank; and two cottonwoods, 17" and 11" caliper, grow on the steep bank. Staff believes that it is reasonable for the two 4" caliper and the 8" caliper cottonwoods to be either relocated or replaced alongside the proposed addition. The two trees on the steep bank should not be disturbed, as the addition can be designed to jog around these trees and, with piers and cantilevering construction, damage to the roots can be avoided. Revised piers and cantilevered construction plans and site coverage plans presented by the applicant make the situation no better by requiring six trees to be removed (possibly two mature cottonwoods on the slope could be saved) . This would remove six of the eight trees on the south side of the lot within the vicinity of the house and significantly alter the natural hillside woods. The changed plans also bring the structure up to the setbacks when previously it was to jog, leaving more of a 2 • • side yard area. A revised site plan should be presented showing the addition located in a way to require removal of no more than three trees. Relocation or new planting of three trees in the south sideyard should also be accomplished. Criteria (4) : "Vegetation shall not be removed nor any slope grade changes made that may produce erosion of the stream bank. " Response: .Saving of the two trees growing on the bank and using pier construction would minimize erosion of the stream bank. Loss of a third tree on the bank shown in revised plans would appear to further destabilize the bank. Excavation and construction techniques should be used to ensure that no undue disturbance is caused to the bank or Roaring Fork River. Criteria (5) : "All efforts shall be made to reduce pollution and interference with the natural changes of the river, stream or other water course, and to enhance the value thereof as an important natural feature. " Response: As the addition is not within the flood plain, no interference with the course of the river should result. Construction activity should stay out of the River. Criteria (6) : "Written notice shall be given to the Colorado Water Conservation Board prior to any alteration or relocation of the water course, and a copy of said notice shall be submitted to the Federal Emergency Management Agency. " Response: The water course is unaffected by the proposed development; therefore, this criteria does not apply. Criteria (7) : "In the event a water course shall be altered or relocated, the applicant and applicant's heirs, successors and assigns shall provide maintenance to assure that the flood carrying capacity is not diminished. " Response: This criteria does not apply. Criteria (8) : "Copies shall be submitted of all necessary federal and state permits relating to work within the one hundred year floodplain. " Response: The Engineering Department indicates no federal or state permits are necessary for the proposed development. Planning Office Recommendation: The Planning Office recommends approval of the Lee Stream Margin Review subject to the following conditions: 1. MEMORANDUM w SEP 2 5 1987 TO: Steve Burstein, Planning Office FROM: Jim Gibbard, Engineering Department qv DATE: September 22, 1987 RE: Lee Stream Margin Review Having reviewed the above application and made a site inspection, the Engineering Department has the following comments : 1 . The applicant has indicated that there will be two or three cottonwoods removed from an area of the river bank in the southeast part of the property. Since these trees contribute significantly to the present stabilization of that bank, it should, be demonstrated that their removal will not cause problems with erosion in this area. 2 . The Building Department has no record of a permit being issued for the small wood deck which presently extends out over into the 100 year flood plain on the southeast part of the property. This deck, if improperly secured, has some potential for producing damage downstream in a 100 year flood. My conclusions, based on an inspection of the site, are as follows: 1. Three ( 3 ) separate cottonwoods, and the smaller half of a twin trunk cottonwood, will require removal as a result of the proposed addition. 2. The smaller half of the twin trunk cottonwood, which is approximately seven (7 ) inches in diameter, and the eight ( 8 ) inch cottonwood located within the proposed building envelope are infected with a fungal organism. The remaining two ( 2 ) trees affected by the expansion are approximately four ( 4) inches in diameter and are healthy. It should be noted that the fungal organism does not appear to have spread to neighboring healthy trees. 3 . The smaller half of the twin trunk cottonwood can be removed safely if proper horticultural practices are employed. Removal of the diseased trees should help the general health of the existing cottonwood grove. Compensation, however, would appear to be appropriate for the removal of the two healthy specimens. Specificly, I would recommend that three ( 3 ) two and one-half to three inch caliper narrowleaf cottonwoods (Populus angustifolia) be planted on the site, two ( 2) of which should be located in the northeast corner of the property between the hundred year flood line and the existing deck. In addition, I would recommend that an eight ( 8 ) to ten ( 10 ) foot high spruce Picea pungens) be planted in the northeast corner of the property in order to provide genetic diversity. ! i I hope this information is helpful in the design of the addition to the Lee residence.
