At their August 15, 1989 meeting the Planning and Zoning
Commission approved the Stream Margin Review for Donald Lefton at
1440 North Red Butte Drive subject to the following conditions:
1. No trees shall be removed within 24 feet of the
floodway location and removal of trees 6" caliper or
more shall require a tree removal permit from the Parks
Department.
The applicant has consented to these conditions.

DATE: August 15, 1989
SUMMARY: The applicant . proposes to construct a single family
residence. The proposed development is located 24 feet from the
100 year floodplain line and 48 feet from the ordinary high
waterline. Section 7-5-4, of the Land Use Code requires stream
margin review for development that is within 100 feet of the high
water line.
APPLICANT: Donald Lefton, represented by Stan Mathis.
LOCATION: 1440 North Red Butte Drive, City of Aspen.
ZONING: R-15.
APPLICANT'S REQUEST: Stream Margin Review approval for the
construction of a single family home.
REFERRAL COMMENTS:
Engineering: In a memo dated August 3 , 1989, the Engineering
Department recommended approval.
STAFF COMMENTS:
Section 7-504 outlines stream margin review criteria as follows:
Criterion 1: It can be demonstrated that any proposed develop-
ment which is in the Special Flood Hazard Area will not increase
the base flood elevation on the parcel proposed for development.
This shall be demonstrated by an engineering study prepared by a
professional engineer registered to practice in the State of
Colorado which shows that the base flood elevation will not be
raised, including, but not limited to, proposing mitigation
techniques on or off-site which compensate for any base flood
elevation increase caused by the development.
RESPONSE: The parcel is very flat. The proposal will not
increase the base flood elevation on the parcel. The flood
elevation of this parcel is 7715. 7 and the lowest floor elevation
is 7717. 5.
Criterion 2: Any trail on the parcel designated on the Aspen
Area Comprehensive Plan: Parks/Recreation/Open Space/Trails Plan
map is dedicated for public use.
RESPONSE: There are no public trails designated for this site.
The Rio Grande pedestrian and bike trail is across the river from
this site.
Criterion 3: The recommendations of the Roaring Fork rk G reenway
Plan are implemented in the proposed plan for development, to the
greatest extent practicable.
RESPONSE: The Greenway Plan does not include this parcel.
Criterion 4: No vegetation is removed or slope grade changes
made that produce erosion and sedimentation of the stream bank.
RESPONSE: According to the application, no trees shall be
removed within 24 feet of the floodway location. Similarly, no
trees of 6" caliper or more shall be removed without a tree
removal permit from the Parks Department. The parcel is very
flat thereby diminishing the potential of erosion from
development.
Criterion 5: To the greatest extent practicable, the proposed
development reduces pollution and interference with the natural
changes of the river, stream or other tributary.
RESPONSE: Development of a new home on the site will cause no
pollution or interference with the river.
Criterion 6: Written notice is given to the Colorado Water
Conservation Board prior to any alteration or relocation of a
water course, and a copy of said notice is submitted to the
Federal Emergency Management Agency.
RESPONSE: Not applicable.
Criterion 7. A guarantee is provided in the event a water course
is altered or relocated, that applies to the developer and his
heirs, successors and assigns that ensures that the flood
carrying capacity on the parcel is not diminished.
RESPONSE: The applicant has agreed to provide a guarantee in the
event a water course is altered or relocated.
Criterion 8. Copies are provided of all necessary federal and
state permits relating to work within the one hundred (100) year
floodplain.
RESPONSE: Not applicable as no work is being conducted in the
100 year floodplain.

RECOMMENDATION: The Planning Office recommends that the Planning
and Zoning Commission approve the Stream Margin Review subject to
the following conditions:
1. No trees shall be removed within 24 feet of the
floodway location and removal of trees 6" caliper or

This letter requests a stream margin review (sec.7-504) for the
construction of a single family residence located at 1440 N. Red Butte
Drive. The area is zoned R-15. The owner is Donald Lefton, c/o the
applicant Stan Mathis, P.O. Box 1984, Aspen, CO 81612; (303)920-1434.
The new residence will be 24'0" from the 100 year flood plane line, 44'0"
from the floodway location and 48'0" from the ordinary high waterline at
the Northeast corner of the residence. At the Southeast corner of the
residence the distance to the 100 year flood plane line is 40'0", to the
floodway location, 600 to the ordinary high water line, 70'0". There is
no planned construction or earthwork within 20'0" of the 100 year flood
plane line other than landscaping. The lowest floor elevation at the
garage and family room is 7717.7' .
Stream Margin Review Standards:
1 . The new residence will not increase the base flood elevation on the
parcel .
2. Trails-there are no public trails dedicated.
3. Greenway plan-no effect.
4. Vegetation-no vegetation will be removed within 24' of the floodway
location.
5. The residence will cause no pollution or interference with the river.
6. Not applicable.
7. Agreed.
