RE: Planning and Zoning Action on Wedum-Pardee and
Miller Stream Margin Reviews
DATE: July 6, 1977
At their July 5th meeting, the Aspen Planning and Zoning Commission
approved stream margin review of fill work within the 100 foot setback
of the Roaring Fork River at the Pardee house site. Their approval
included the condition that the site be graded to ground level and be
restored to its natural condition as soon as possible.
Also, at that meeting, Planning and Zoning passed a motion approving
stream margin review for additions to the Miller residence on Lot
13, Black Birch Estates. The approved additions were as shown on the
attached plans.

RE: Miller Stream Margin Review
DATE: June 30, 1977
This is a request by Bill Meyers representing Mr. and Mrs. R.P. Miller
for Stream Margin review. The plans call for expansion of an existing
house in Black Birch Estates. The house, as well as the proposed
improvements, are located outside of the 100 year floodplain of the
Roaring Fork River. The applicant's agent represents that no vegetation ___
will be removed on areas of the additions, since vegetation was pre-
viously removed at the time of house construction. Because of the
removal of excavated fill from the property and the generally flat
topography, there will be no erosion-causing slope changes.
We have not yet inspected the site, but from the available representation
of the applicant, it appears that the proposal will not affect the natural
course of the Roaring Fork River and we therefore recommend approval .
The applicant has prepared an extensive application which is available
in the Planning Office.

Collins said that he had no objections to this application. He said
they needed some plans to review. Baranko requested plans for the
next meeting. Yaw said this was possible.
r . Hedstrom questioned the use determination code. Smith quoted the
:� code. Ensign noted that it was a permitted use in the CC(under the
SPA overlay) . Baranko noted that the determining factor was the
SPA overlay. Smith said that there were no guidelines since there
was no SPA plan adopted. .
': : Baranko said he objected to the loss of the ski shops in this location.
. He said that although there were no restrictions in the CC zone, the
SPA took precedent and had no guidelines. They had to decide what
`i they wanted .there. Klar asked if they permitted this use if they
would see it again. Smith said no. ' Baranko said they needed con-
ceptual plans. Baranko also asked Yaw to produce information as to
Whether the ski shops will re-lease or not. He stated that if the
ski shops stayed, he was in favor of the proposal. If they did not,
he was opposed.
Baranko asked to table the-,request to the next meeting. Collins said
he felt the Board had no objections to the request but they did need
to see plans. Yaw said he would produce the floor plans.
Ensign asked if it was appropriate to discuss SPA matters without
going through the SPA process. Smith said 'Nuttall interpreted it
as a technicality without an SPA plan and that they could proceed.
Hedstrom quoted the memo with Nuttall's recommendations.
- Yaw asked if they could move to approve this use subject to the in-
. elusion of the ski shops so they then could proceed under the time
--I. constraints. Baranko said he needed to see a conceptual design before
he could approve.
Baranko moved to table the case until there was a determination from
Dorothy Nuttall and a conceptual design. Schuhmacher seconded the
' :'' motion. Collins, aye, Schuhmacher, aye, Hedstrom, aye, Isaac, aye,
Baranko, aye, Ensign, nay, Klar, aye. The motion passed.
• IX Miller Stream Collins excused himself from the meeting. Hedstrom assumed Chairman.
Margin Review
P & Z granted a stream margin review.on July 5, 1977,. for additions to
the R.P. Miller residence in the Black Birch Estates. Approval was
granted because all additions were determined to be outside the 100
year floodplain, no additional vegetation was to be removed, and no
erosion would be caused because the site is relatively flat. The
• new application is for a garage, and breezeway which again are located
. outside the 100 year floodplain and in areas where vegetation has been
previously removed. Smith recommended approval if the previous con-
dition regarding removal of excavated fill is adhered to.
Ensign moved to grant approval of the Miller Stream Margin Review
for the Miller residence on the condition that no vegetation is re-
: ;; moved and no dumping is,made in the general area. Klar seconded the
motion. All in favor; motion approved. .
Isaac moved to adjourn the meeting, seconded by Klar. All in favor;
meeting adjourned at 7:10 PM. .
