RE: Ogilvy Stream Margin Exemption
SUMMARY: The Ogilvy's have received stream margin review and have
amended that review. They now request an amendment to the stream
margin review to extend a fence to the 100 year flood plain
boundary, ' and to locate benches and a picnic table next to the
river.
Staff recommends approval of the stream margin exemption.
APPLICANT: Jeanette Ogilvy
LOCATION: 1490 Red Butte Drive
ZONING: R-30
APPLICANT'S REQUEST: Stream Margin Exemption for the extension of
a fence, and the placement of benches and a picnic table near the
river.
REFERRAL COMMENTS: Please see attached referral from the
Engineering Department.
STAFF COMMENTS: The applicant has done an extensive remodel on her
single family home and has received a stream margin approval for
that remodel. As part of finishing the home, the applicant
proposes to extend the existing fence to the 100 yr. flood plain
and install three benches and a picnic table near the river.
Pursuant to Section 24-7-504 B. the expansion, remodeling or
reconstruction of an existing development shall be exempt from
stream margin review if the development:
a. does not add more than 10% to the floor area or increase the
amount of building area exempt from floor area calculations by more
than 25%;
RESPONSE: N/A
b. does not require the removal of any tree;
RESPONSE: The applicant is working with the Parks Department to
secure a tree removal permit for a large tree next to the house.

The plans also indicate the removal of dead vegetation along the
river bank. The applicant shall be advised that any removal of
vegetation greater than 6" in caliper must be accompanied by a tree
removal permit.

than is the existing development;
RESPONSE: The fence shall not be extended beyond the 100 yr. flood
plain boundary. The benches and picnic table must be anchored to
prevent flotation in the event of a flood.
d. does not fall outside of an approved building envelope; and
RESPONSE: The development does not fall outside of the existing
approved building envelope.
e. is located completely outside of the Special Flood Hazard Area
and more than one hundred feet from the high water line of the
Roaring Fork River or the expansion, remodeling or
reconstruction will not cause an increase to the amount of
ground coverage of structures within the Special Flood Hazard
Area.
RESPONSE: As a condition of approval the benches and table must
be anchored to prevent flotation in the event of a flood.
RECOMMENDATION: Staff recommends approval of the amended Ogilvy
stream margin review to extend the fence and install benches and
picnic table with the following conditions:
1. The fence shall not encroach into the 100 yr. flood plain.
2 . The picnic table and benches shall be anchored to prevent
flotation in the event of a flood. These items may be anchored
only at one point.
3 . No significant disturbance of live vegetation shall occur
without a tree removal permit.

Re: Ogilvey Stream Margin Review Amendment
Having reviewed the above referenced application, and having made a site inspection, the
Engineering Department has the following comments:
1. As we discussed, the benches and picnic table located within the 100-year floodplain
must be anchored to prevent flotation. Other staff have suggested that these items only
be anchored at one point so that in the event of a flood, floodborne debris may have a
better chance of passing and not accumulating on the obstructions (the benches and table).
2. The installation of fence to the 100-year floodplain is acceptable in terms of floodplain
management since the fence will not encroach into the floodplain.
3. The Engineering Department comments of 1992 are attached for reference and are still
valid.
- Is the public receiving a fisherman's easement?
- We agree that removal of dead vegetation is acceptable with the condition that
there be no significant disturbance of live vegetation.
4. Work in the Public Right-of-way - Given the continuous problems of unapproved work
and development in public rights-of-way adjacent to private property, we advise the
applicant as follows:
The applicant shall consult city engineering (920-5080) for design
considerations of development within public rights-of-way, parks department
(920-5120) for vegetation species, and shall obtain permits for any work or
development,including landscaping,within public rights-of-way from city streets
department (920-5130).

Re: Ogilvy Exemption from Stream Margin Review
Having reviewed the above application, and having made a site
inspection, the engineering Department`has the following
comments:
1. The application survey has a red dashed line around a tree in
the spa area scope of work. It is unclear whether this tree is
to remain or be removed. If it is to be removed, does it fall
under Section 13-76 of the municipal code?
2 . The applicant is requested to grant a fisherman' s easement
for the river or stream and for a width of five feet along the
bank.
3 . A construction site drainage plan and procedure should be
considered prior to the issuance of a demolition, excavation or
building permit. The construction procedures employed must be
such that no runoff from rain or snowmelt be permitted to drain
to the river from contact with disturbed earth. The construction
procedure used will in no way impact the stream.
5. It appears that the proposed development will create
additional impervious surfaces. The engineering staff requests
that the applicant give consideration to maintaining historic
storm runoff; and maintaining any increased storm runoff on-
site, preventing it from entering the Roaring Fork River.
Recommended Conditions of Approval
1. There shall be no disturbance of vegetation between the fence
and the Roaring Fork River.
