Review: Because this construction is within 100 feet of 3
the high water line of the river, it is before you S
for stream margin review. It is, however, a relatively Q_
small addition (150 square feet) to the existing
. house and the house is in a downstream location
from the proposed wine cellar. The lot is not

impacted by a trail plan or the' Roaring Fork Greenway
Plan. The construction of the wine cellar will `"-r

require very minimal excavation for footings and -
foundation walls and will not require removal of
vegetation or slope grade changes. The stream cat
will not be affected and there will be no
increase in stream sedimentation. This construction
will have no negative effect on the stream as a
. natural feature.

RE: Pogliano Stream Margin Review
The requirements of Section 24-6. 3 are mandatory, not permissive.
I recommend that we obtain a proper development plan for our files
clearly indicating the location of the relevant water lines (flood
hazard, high water line, 100 ' from high water line) .
The map submitted is a copy of a 1970 survey with a pencilled-in
outline of the wine cellar apparently showing the removal of two
trees. In addition, I'm informed that the carport has been con-
verted to living space. Obviously, 150 sq. feet is not much, but
we don't have enough information to determine if there is a F.A.R.
impact.
Many of these issues are premature and will arise naturally at
building permit time. However, to avoid the "why didn't you tell
me earlier problem" I raise them now.
For this review, we need at least a proper development plan pursu-
ant to Section 24-6. 3. The detail of the plan should be up to the
engineering and building departments' standards for such things.
In my mind, it involves a level of detail somewhere between a
stamped improvements survey and a pencil sketch on a 1970 blue-
print.
You may want to add the Building Department to the referral list.

RE: Pogliano Stream Margin Review
This memorandum is an addendum to my memorandum of August 17.
The City Attorney' s Office and the City Engineer have taken
exception to the contents of my first memorandum, therefore
this memorandum is a correction of the memorandum of August
17 and a clarification of Engineering Department policy.
The comments of the previous memorandum are hereby rescinded,
and the following comments are to be taken as the current
comments of the Engineering Department:
1. The development plan does not meet the requirements
of Section 24-6. 3 of the Municipal Code. A blueprint of
a current document is required. The plan must show the
existing structure and the proposed improvements, as
specified in 24-6. 3 (b) , as well as the remaining informa-
tion required in that section. The plan must show the
100-year floodplain. The plan must be stamped by one of
the following professionals registered in the State of
Colorado:
a. Land Surveyor
b. Civil Engineer
c. Architect
2. A 150 square foot addition to the southwest side of an
existing structure is proposed. This is the side of the
existing structure which is away from the stream, there-
fore it is understood that there will be no construction
activity on the stream side of the existing structure and
no impacts of any sort on the stream.
3. The Engineering Department anticipates that it will have
no objections to the proposed addition once a proper
development plan is submitted.

Having reviewed the above application and having made a site

comments:

We propose to add a wine cellar consisting of 150 square feet
to the existing residence of Mr. Felix Pogliano, 1110 Black
Birch Drive.
The Review Criteria are all met. There is no involvement with
any trail plan; the extent of excavation is for footings and
foundation walls only; no vegetation will be removed or slope
grade changes made nor any changes to the stream channel.
After discussing the project with Colette Penne of your office
and being then referred to Jay Hammond of the Engineering Depart-
ment, his recommendation was as follows : As the main body of
the existing house is already located closer to the river than
the proposed addition, and is also downstream therefrom, Mr.
Hammond deemed it unnecessary to set a flood plane line on
the property plot, the same not shown on hia master plot plans.
He thus indicated his approval of the project.
