Regular Meeting Planning and Zoning Commission July 19, 1977

The Aspen Planning and Zoning Commission held a regular meeting on July 19,
1977, at 5: 00 pm in the .City Council Chambers. Member s present were Chic
Collins, Roger Hunt, O of Hedstrom and John Schuhmacher. Also present'-from
the Planning Office were' Bill Kane and Karen Smith and County Attorney Sandy
Stuller.and City Attorney Dorothy Nuttall. •
Approval of Hunt moved to approve the minutes of 15 February 1977 ,
Minutes 22 February 1977, and 5 July 1977 with corrections.
Schuhmacher seconded the motion. All in favor, motion
• passed.

Moore Building Kane stated that this was a requested use for an educational
toy store in the Moore Building in the space previously
occupied by World Savings Co. The toy store would be a
higher use than World Savings. The theory of conformity
and non-conformity should be applied to an entire building.
When the Planning Office rezoned that block C-1 we decided
to deal with each building on a case-by-case basis. Nuttall .
stated that the P&Z could only act in an advisory role on
this case. '
Hunt did not feel that the code gave sufficient latitude
to permit certain uses within •an ' area. Kane said that there
has to be some prescribed word as to what is allowed in
certain districts.

Hunt moved to affirm the use of the Moore Building for a
toy store as the proposed use represented a lesser use
• or less intense. Hedstrom seconded. All in favor; motion
passed.
Holy Cross and Kane discussed the proposal to locate an old steel truss
Rio Grande bridge between the Rio Grande property and the Holy Cross
bridge property. The bridge ,is currently 121 feet long. We
propose to cut 2 sections out of it so that it will fit
across the Rio Grande. at that point, It will be high enough
to convey the 100 year flood. The County would assist
the City. The Stream Margin Review requires that P&Z
review -this proposal. Kane' said that any motion would
require vegetaion.
Collins abstained from the discussion, Hunt said that
it would be nice to cover up the .abutments with boulders. '
Hunt moved to approve the Stream Margin Review of the Rio
Grande bridge where it crosses between the Rio Grande proper_'
• to the Holy Cross property provided that concrete
abutments are returned to their vegetative or covered
with boulders upon completion. Hedstrom seconded. All
in favor; motion passed.
Condominiumization Stuller highlighted the changes she had made in the new
Public Hearing draft of the ordinance. Kane asked that the public . .
hearing -begin as there was no need for further explanation.
Bob George Bob . George, from Mason and Morse, felt rather distressed .
with the 'quota system. The timing of applications and the
information process is not correct. One could go through
the whole process without knowing if there is a building
allotment. Detailed plans .are' asked for which:will not be
approved unless they include moderate or low income
housing . half of the building .season is blown if the
. schedule in the ordinance is adhered to, Essential
government buildings are included in the quota - why?
• Stuller answered that if the government builds a,: commerci.a.i
building, then it should be recogn.ized in subsequent years:.

RE: Rio Grande Bridge Steam Margin,Review
DATE: July 15, 1977
The attached memorandum from George Ochs, County Manager, details the
proposal to locate a bridge on city owned land at the. Rio Grande and
Holy Cross properties. At their July 11th meeting , the City Council
voted to accept the gift of the bridge from Pitkin County and its
location as shown.
The Planning Office supports this proposal primarily because of its
contribution in furtherance of objectives of the Trails Master Plan
and in the developing work on the Rio Grande Master Plan. Not only
will the bridge serve to connect two sites which are being desinned
for use as key public places (ie. a public art center and park) ;
the bridge will also serve as an important pedestrian , bicycle, and
equestrian link between the town and the employee population of the
Silverking and Smuggler areas. Aesthetically, we believe the bridge
can contribute to coordinating public and mainly green and open
spaces; the individual 's transportation experience whether for •
commuting or recreational purposes. Overall urban design objectives
will furthermore be supported.
We recommend approval of stream margin review after finding that the
purposes of review specified in Section 24-6.3.c can be met if the
project is managed as represented in the application. For example,
vegetational disturbances will be minimized by use of crane or wench
to place the bridge structure. The purpose that the bridge will
serve is totally consistent with the Roaring Fork Greenway Plan.
Any motion to approve might be conditioned on the applicant's repre-
sentations that the bridge cross-section will be located so as to
accommodate the entire project flood and that infill around the
bridge abutment be minimal so as not to affect the flood channel .
We suggest one further condition of revegetation as soon as possible.

0 On Monday, ,July 11, the City Council voted to accept the
gift of a bridge from Pitkin County. The bridge is to be placed •
Ubetween the Rio Grande and Holy Cross properties on land owned
by the City. It will be located in a position consistent with
dV the Rio Grande •and Trails Master Plans and will serve as a cross-
Ttown pedestrian link between the North (Silverking) and South
Y (downtown) sides of Aspen.
The County is planning to move the bridge from its existing
site in Carbondale to the Rio Grande Property this summer. The.
bridge was originally constructed in 1911 to span 122 feet. Both
the County and the Planning Office feel the bridge will best fit
the scale of the river if this length is reduced to 98 feet by
removing two of the bridge's seven sections. •
In accordance with the provisions of Section 24-6.3 of the
Municipal Code, we are requesting consideration for approval of
. this structure within the stream margin. Following are some con-
siderations to the issues set forth in the Code:
• "24-6. 3 b. Plan Specifications
(1) Boundary of the property .
Both properties are contiguous and belong
to the City of Aspen.
. (2) Provide a contour map
•
See the accompanying topo as supplied by
the City of Aspen from Cooper aerial
surveys.
. (3) Existing and proposed improvements
See site and area plans.
(4) . Construction procedure to be used
An absolute minimum of cutting and filling
will be used. Once bridge abutments are
in place the bridge will be craned or
winched into place. . .

No trees will be disturbed. Minor willow .
, ; brush will be removed on the Holy Cross
property to provide pad area and access ramp.
