SUMMARY: Planning staff recommends approval of Stream Margin
Exemption for the reconstruction of a deck and stairway on Unit 25
of the Riverview Condominiums, 1028 E. Hopkins.
APPLICANT: Richard and Peggy Krigel, represented .by John Cahill,
Managing Agent for the Riverview Association
BACKGROUND: The applicant seeks Planning Office approval for a
deck and stairway which was rebuilt in June of 1991. The previous
deck was deteriorated and rebuilt apparently without a building
permit. The Krigels have since applied for a building permit. The
Zoning Officer requires approval of Stream Margin Exemption prior
to approval of the building permit (Attachment "A") . According to
the application, the deck was replaced exactly where the previous
deck was located and is the same size as the old deck (Attachment
"B") .
REFERRAL COMMENTS: On 7/22/92 , staff from Planning, Engineering
and Zoning reviewed the application and forward the following
comments:
Zoning: (Bill Drueding)
1. No setback violations occur with the reconstructed
deck/stairway.
2 . The 5/7/92 drawing submitted in the application indicates a
proposed pool reconfiguration. This is not a part of the
Krigel application/review.
3 . Replacement of the previous deck does not affect FAR, site
coverage, etc.
Engineering: (Chuck Roth)
1. The deck is not in the trail easement.
2 . The new deck allows high water to flow through, but does not
retain more debris than other deck.
STAFF COMMENTS: Exemption from full Stream Margin review is
possible when the following standards are met:
1. The development does not add more than 10% to the floor area or
increase exempt floor area by more than 25% .

RESPONSE: The development replaced an existing deck structure. j
No expansion occurred according to the managing agent of the condo
association.
2 . The development does not require the removal of any trees
requiring a removal permit.
RESPONSE: No trees were removed by the reconstruction project.
3 . The development is located such that no portion of the
expansion, remodeling or reconstruction will be any closer to the
high water line than is the existing development.
RESPONSE: The replacement deck is described to be on the same
footprint as the original deck. The drawing shows the deck
approximately 10 ' from the bank of the river.
4 . The development does not fall outside of an approved building
envelope, if one has been designated though a prior review.
RESPONSE: The deck replacement does not fall outside of the
footprint of the previous deck.
5. The expansion, remodeling or reconstruction will cause no
increase in amount of ground coverage of structures within the
Special Flood Hazard Area.
RESPONSE: The deck replacement causes no increase to the amount of
ground coverage within the flood hazard area.
STAFF RECOMMENDATION: Staff recommends approval of Stream Margin
exemption for the Krigel deck and stairway replacement at Unit 25,
Riverview Condominiums with the following conditions:
1. The 5/7/92 drawing submitted in the application indicates a
proposed pool reconfiguration. This is not a part of the
Krigel application/review.
2 . All material representations made by the applicant in the
application shall be adhered to and considered conditions of
approval, unless otherwise amended by other conditions.
I hereby approve the Stream Margin Exemption for the
Krigel deck and stairway reconstruction at Unit 25 of the
Riverview Condominiums with the above two conditions.

Dear Mr. Cahill:
As per our phone conversation, I am rejecting Building Permit No.
2-13, 1028 East Hopkins, 125. As my investigation indicates and
you confirmed, the work applied for has already been completed
without the necessary building permit. The real problem is that
this construction requires a Stream Margin Review, or an exemption
from full review, as the work is within 100 feet of the Roaring
Fork River.
I appreciate your willingness to cooperate and bring this work into
compliance with City of Aspen Building and Zoning codes. Please
contact a City planner to start in motion the necessary Stream
Margin Review process. Kim Johnson or Leslie Lamont, at 920-5090;
are the planners who can help you proceed with this process.

DESCRIPTION OF PROPOSAL
The scope of work to be undertaken at Riverview Condominiums
includes the removal of an existing sauna and hot tub . A new hot
tub will be relocated as shown on the accompanying drawings
(exhibit A) . The existing concrete deck will be repaired and
receive new concrete topping as needed . Refer to exhibit A for
a detailed description of additional minor construction to be
undertaken in the spa pool area. The existing mechanical room
will remain in its present location . No other changes are
anticipated to the pool spa area at this time .
The proposed development complies with all of the margin review
standards as set forth in attachment 4 ( 1-5) with the exception
of number 5 . The proposed construction lies within one hundred
feet of the high water line of the Roaring Fork River. However,
all the proposed changes lie within the existing pool spa area
which is situated within the condominium complex away from the
river (see exhibit B ) .

SUMMARY: A stream margin exemption review is necessary for the
renovations to the pool area of the River View Condominiums because
the changes are within 100 feet of the high water line of the
Roaring Fork River.
Staff recommends approval of the stream margin exemption.

APPLICANT'S REQUEST: Stream Margin Exemption for the demolition
of a sauna house and relocation of the hot tub.
REFERRAL COMMENTS: Please see attached referral from the
Engineering Department.
STAFF COMMENTS: Pursuant to Section 7-504 B. the expansion,
remodeling or reconstruction of an existing development shall be
exempt from stream margin review if the development:
a. does not add more than 10% to the floor area;
b. does not require the removal of any tree;
c. is located such that no portion of the expansion, remodeling
or reconstruction will be any closer to the high water line
than is the existing development;
d. does not fall outside of an approved building envelope; and
e. is located completely outside of the Special Flood Hazard Area
and more than one hundred feet from the high water line of the
Roaring Fork River or the expansion, remodeling or
reconstruction will not cause an increase to the amount of
ground coverage of structures within the Special Flood Hazard
Area.
The applicant's proposal is to remove an existing sauna building
and relocate the hot tub. All renovation shall take place within
the existing pool area. No work will occur outside of the fenced
pool area and no trees shall be removed. All work complies with
the standards for an exemption.
RECOMMENDATION: Staff recommends approval of the River View stream
margin exemption for the removal of the sauna building and
relocation of the hot tub within the existing pool area with the
condition that no runoff from the rain or snowmelt be permitted to
drain to the river from contact with disturbed earth.
I hereby approve the Stream Margin
Exemption pursuant to Section 7-504
B. of the Aspen Land Use Code.

DESCRIPTION OF PROPOSAL
The scope of work to be undertaken at Riverview Condominiums
includes the removal of an existing sauna and hot tub . A new hot
tub will be relocated as shown on the accompanying drawings
(exhibit A) . The existing concrete deck will be repaired and
receive new concrete topping as needed . Refer to exhibit A for
a .detailed description of additional minor construction to be
undertaken in the spa pool area. The existing mechanical room
will remain in its present location . No other changes are
anticipated to the pool spa area at this time .
The proposed development complies with all of the margin review
standards as set forth in attachment 4 ( 1-5) with the exception
of number 5. The proposed construction lies within one hundred
feet of the high water line of the Roaring Fork River . However,
all the proposed changes lie within the existing pool spa area
which is situated within the condominium complex away from the
river (see exhibit B ) .

Review Standards: Development Application
for Exemption from Stream Margin Review
The expansion, remodeling or reconstruction of an existing
development shall be exempt from stream margin review if the
following standards are met:
1. The development does not add more than ten percent
(10%) to the floor area of the existing structure
or increase the amount of building area exempt
from floor area calculations by more than twenty-
five percent (25%) ; and
2 . The development does not require the removal of
any tree for which a permit would be required
pursuant to Section 13-76 or the applicant
receives a permit pursuant to said subsection; and
3 . The development is located such that no portion of
the expansion, remodeling or reconstruction will
be any closer to the high water line than is the
existing development; and
4 . The development does not fall outside of an
approved building envelope, if one has been
designated through a prior review; and
5. The development is located completely outside of
the Special Flood Hazard Area and more than one
hundred feet (100 ' ) measured horizontally, from
the high water line of the Roaring Fork River and
its tributary streams or the expansion, remodeling
or reconstruction will cause no increase to the
amount of ground coverage of structures within the
Special Flood Hazard Area.
