Staff included these "clean-ups" as part of the Youth Center land exchange plat to reflect the as-built condition. No physical changes to the turnaround are proposed or authorized through this Ordinance. (Please see Exhibit A showing the existing and proposed condition.) Through this Ordinance, the City accepts the dedication of right-of-way from Pitkin County (area C), a potion of the right-of-way is vacated to become part of Rio Grande Lot #2 (area D), and a portion of Rio Grande Lot #2 is dedicated as part of the right- of-way (area E). (Please see Exhibit B showing the proposed land transfers.) Pitkin County agreed to the Youth Center Land Transfer, including changes to the right-of-way, and has signed the land transfer plat. If this Ordinance is adopted, the plat may be signed by the Mayor and recorded —the last step in the Youth Center land swap process. If City Council does not proceed with the described amendments to the Galena Street right-of-way, the Youth Center land exchange agreement will be unaffected. Staff will revise the plat to eliminate these additional land transfers. Both the County-owned parcel and the City's parking garage parcel are zoned with a Specially Planned Area (SPA) designation and their particular development rights are set forth by Ordinance adopting a site specific development plan describing all allowable uses and dimensions. Therefore, the dedications and vacations do not affect the build-out potentials, only the area in which development may occur. Staff recommends City Council adopt Ordinance No. 16, Series of 2002. 1 APPLICANT: City of Aspen. PREVIOUS ACTION: City Council was briefed on these right-of-way land exchanges during a joint work session with the Pitkin County BOCC. The BOCC has approved the amendments to the right-of-way through the land transfer plat. City Council adopted this Ordinance, upon first reading, May 13`h RECOMMENDATION: Staff recommends City Council adopt Ordinance No. 16, Series of 2002. Staff has prepared a plat reflecting this "lot line adjustment" between the Rio Grande Subdivision Lot #2 (owned by the City) and Pitkin County Center Subdivision (owned by the County). The plat has previously been reviewed by City Engineering. Staff would like to "clean up" the property and right-of--way boundaries to reflect the Galena Street turnaround. This area was never re-plated after the parking garage, youth center, and turn-around were developed. The elevator for the parking garage is currently within the Galena Street right-of--way and partially on the Pitkin County parcel. (Please see Exhibit A showing the existing and proposed condition.) Staff would like to prepare an Ordinance which: (Please see Exhibit B) ■ Accepts the dedication of right-of-way from Pitkin County (area C) • Vacates a potion of Galena right-of--way to become part of Rio Grande Lot#2 (area D) • Dedicates a portion of Rio Grande Lot#2 as right-of--way (area E). Emergency access for fire fighting, law enforcement, and life saving services; b. Conveyance and distribution of public utilities such as electric power, potable and fire protection water, domestic and commercial sewage, storm runoff and snowmelt runoff, natural gas, and telephone, television and computer communications; c. A public roadway system for private and commercial vehicular circulation and access to private properties; d. A sidewalk and trail system for pedestrian circulation and access to private properties. In operating the public rights-of-way system and acquiring additions thereto, the City shall provide and maintain the highest level of benefit and service to the public as reasonably possible as determined by the City within its sole discretion, subject only to considerations of public health and safety. It is furthermore the policy of the City of Aspen to: VACATE any portion of the public rights-of-way system only if it is clearly demonstrated that the subject portion of the right-of-way is unneeded in the rights-of- way system. Any right-of-way vacation shall be subject to approval by ordinance as enacted by the City Council and shall be consistent with and further the goals of the Aspen Area Community Plan and any regulations adopted pursuant thereto. Policy Goals 1. Provide a reasonable procedure for vacating any portion of the system of public rights-of-way. 2. Preserve all portions of the public rights-of-way system necessary for the public benefit and for the intended functions of the rights-of-way system. Implementation To achieve the goals as set forth above, the following implementation steps shall be undertaken: 1. A written right-of-way vacation procedure shall be established after review by appropriate departments of the City of Aspen and by any other appropriate review agencies, such as the Fire Marshall. 2. The procedure shall be presented to and adopted by the City Council. 3. The final procedure shall he incorporated into the Policy and Procedures Manual of the City of Aspen. Delegation The City Manager may devise and enforce such rules and regulations as may be deemed necessary to further implement the policies and goals as set forth in this public right-of-way vacation plan and policy statement so long as such additional rules and regulations are not inconsistent with the goals and policies set forth herein. 1- * * * * * * The procedure for requesting and considering a vacation of public right(s)-of-way is set forth in this document. This document explains submission requirements and review criteria for applications to vacate portions of the public right(s)-of-way in the City of Aspen. Vacating portions of the public right(s)-of-way shall be subject to approval by the City Council by ordinance following a public hearing during a regularly scheduled meeting. All vacation requests shall meet the requirements as set forth below prior to further consideration by the City. SUBMITTAL REQUIREMENTS - Applications for vacations shall be submitted to the City of Aspen Engineering Department, shall be accompanied by a fee, and shall include the following: A. Letter of Application - All applications shall include a letter of application addressing the following: i) Name and address of applicant and representative. ii) Written description of portion of right(s)-of-way for which vacation is being requested. iii) An explanation of the nature of the request to vacate the public right(s)- of-way and the need or hardship. State the rationale for the City to consider vacating the right(s)-of-way. B. Site Survey - All applications shall include one copy of a survey prepared by a Colorado registered land surveyor showing the following: i) One inch equals 400 feet scale vicinity map showing the area for which the vacation is being requested. ii) Property boundaries of all properties abutting the area of the requested vacation. iii) Existing structures, improvements and landscaping features, including trees greater than six (6) inches in diameter, in the area of the requested vacation. Show all existing fences, irrigation and drainage improvements, curbs, gutters, and sidewalks. iv) Show the boundary of the vacation including bearings and dimensions with adequate ties to existing monuments to permit the legal definition of the vacation for exhibit purposes. Show what portions of the proposed vacation accrue to which properties. v) Show all existing utility lines in the right(s)-of-way in which the vacation is requested together with a statement by the surveyor that all utility companies have been contacted and all utilities are indicated. vi) Include the surveyor's certificate, signature and seal, date of preparation, scale, including bar type or graphical scale, and true north arrow. vii) The survey shall be prepared on 24"x36" mylar and on a 3 1/2" disc in a CAD .dxf transfer file with the survey tied to the State Plane Coordinate System . A blueprint of the survey shall be submitted together with a reduced copy on 8 1/2" x 11" paper. C. Processing Fee - A $320 processing fee is required upon submission of an application for a vacation request. D. Filing Fee - If the vacation is approved by City Council, a $5.00 per page fee for agreements, and $10.00 per plat sheet recording fee payable to the Pitkin County Clerk & Recorder is required for the City Clerk to record the document with the County Clerk and Recorder. A photocopy of the recorded document will be EXHIBIT "A" Public Hearing Notice Requirements Public hearing notice requirements include three forms of notice, these being notice by publication in the newspaper, notice by posting of the property, and notice by mail to surrounding landowners. City Council will hear the first reading of the proposed ordinance to vacate. The public hearing will be scheduled for the second reading of the ordinance. The following is a summary of the notice requirements, including identifying who is responsible for completing the notice. 1. Publication - Publication of notice in a paper of general circulation in the City of Aspen is to be done at least fifteen (15) days prior to the hearing. The legal notice will be written by the Engineering Department Administrative Assistant, and that individual will place the notice in the paper within the appropriate deadline. 2. Posting - Posting of a sign in a conspicuous place on the property is to be done ten (10) days prior to the hearing. It is the applicant's responsibility to obtain a copy of the sign from the Engineering Department,to fill it in correctly, and to bring proof, a photograph, to the hearing that posting took place. 3. Mailing - Mailing of notice is to be made to all owners of property within 300 feet of all boundaries of the right(s)-of-way being requested for vacation. It is the applicant's responsibility to obtain a copy of the notice from the Engineering Department, to mail it according to the following standards, and to bring proof to the hearing in the form of a signed affidavit that the mailing took place. Standards for notice shall be as follows: I. Any federal agency, state, county or municipal government service district or quasi governmental agency that owns property within 300 feet of the subject property must he mailed notice fifteen (15) days prior to the hearing. 2.
