Dear Sirs„
The Butcher 's Block of Aspen, Inc. plans to operate a retail meat
market at 11.5 South Spring Street. We have a lease with the owners, Perry
Pollock and Ray Kashinski, for unit '6 of The Viking situated at the north-
west corner of the intersection of Durant and Spring streets in the city
of Aspen.
The Butcher's Block will be a full service, custom cut meat market
offering the finest quality meat and poultry products that we can obtain.
We will encourage telephone orders and plan to offer delivery service.
The exterior and interior, remodeling design will he in k(-ping with Aspens
Victorian tradition while satisfying all sanitation regulations. We plan
to landscape the property with flower boxes, flower gardens, hanging flower
pots and grass to make the exterior as attractive as we can.
Equipment to be installed will be a large walk-in cooler, a walk-in
freezer, a meat saw, grinder, slicer and tenderizer, none of which pollutes
any of the senses. Our remodeling of the space will not alter any dimensions
of the building.
Our objectives are to build our business with the local trade by
providing the residents of Aspen the finest quality and service in the
old fashioned specialty store tradition.
We respectfully request that you grant us permission for this use
and that you grant our landlords the necessary remodeling, permit so that
we may pursue our venture with expediency.necessary

Gentlemen: - - -
Mr . Clayton Myering, City Building Inspector, has verbally
indicated a refusal to issue three building permits pursuant
to applications filed on behalf of the Continental Inn. Such
refusal is based on the grounds that the provisions of Ordinance
19 are applicable to the proposed work. It is our position that
the provisions of the ordinance do not apply to the proposed
work.
The proposed work, including that for which permits have
not yet been applied for has the following features :
(1) No significant expansion of facilities is involved .
(2) Public areas only are affected .
(3) Only repairs , redecoration or relocation of existing
facilities is involved .
(4) No increase of uses or densities is involved .
(5) The intent is to merely upgrade the appearance and
functional aspect of the lobby, bar, pT 5Ef; mechai cal
room and ski- storage room.
In support of these statements , details of the proposed
work are attached .
In addition, we believe that remodelling is not within
the scope or intent of Ordinance 19 as written . To substantiage
such we direct your attention to the language of Ordinance 19
which,_ in part , reads as follows :
"WHEREAS, the objectives and purposes of the anticipated
lands use changes will be defeated if building permits issue
for future structures and uses inconsistent with the commission
recommen a -ions prior To—acdo ion of new zoning code and zoning
district map; and the issuance of permits only in accordance
with anticipated changes will aid in the orderly and efficient
adoption of a new code and map. "

"Section 1 .
Purposes . The purpose of this ordinance is to promote
the health, safety, order, convenience , prosperity and general
welfare of the residents of the City of Aspen by establishing
a building permit review procedure which will allow the issuance
of permits for structures and uses consistent with the land
use changes recommended to the City of Aspen by the Aspen City

is to remain in effect for a period of time -sufficient to in- -
corporate the recommendations into the Aspen Zoning Code and
Zoning District Map. "
It is apparent that Ordinance 19 is enacted only to assure
no changes in Uses which would be inconsistent with the master
plan up-date . -17-the present instance uses are in no way
affected by the proposed work, and Ordinance 19 is thus in-
applicable.
You will note that under Section 2. III E. 2. (relating to
Mixed Residential zones) it is stated :
"2. The remodelling of existing lodges is not subject to
review where such construction result in an in-
crease in guest capacity . "
One might argue that such section is not applicable to
Recreations-Accommodations zoning. We think differently :
1 . The Mixed Residential zone prohibits new lodges . The
intent of the section was merely to identify the exemption
for remodelling where there is no increase in density for
uses (lodges) no longer permitted.
2, The City Council, in enacting Ordinance 19 did so with
the belief that there was no need to apply the provisions
with respect to remodelling of existing lodges to zones
where lodges are permitted .-
3 . There is no need to apply P&Z review for the protection
of the public welfare .
Mr. Myering has already issued three permits for a portion
of the proposed work, including a demolition permit for an area
in which permits for improvement are sought .
To refuse to issue a building permit for completion of re-
novation work for which a demolition permit was issued rings
of harassment . Although uTicier fe Thui_iding code he has no
authority to do so, Mr. Myering has expressly denied the ap-
plication sought .

Therefore , the Continental Inn, without waiving any rights
to appeal the decisions of the Building Inspector to other
agencies of the City of Aspen or the Courts of the State of
Colorado, requests (1) that the Aspen Planning Commission
determine that the provisions of Ordinance 19 are inapplicable
to this work or (2) if such is not so determined , recommend
to City Council that an exemption from Ordinance 19 be granted
or (3) If none of the above action is taken consider this an
application for review under Ordinance 19 .
There is considerable financial hardship facing the owner
if he is not permitted to immediately continue the work com-
menced under issued permits an un er permits applied for.
Our construction of the Ordinance and its inapplicability
to the proposed work is clearly reasonable . If a contrary
construction is otherwise found to be reasonable , the Ordinance
is then vague and for that reason, alone , unconstitutional .

Chairman Adams stated that he felt parking districts
should be formed.
Coac hlight Ms . Baer stated that the previous conditions for approval
/Chalet - given at the conceptual stage have been agreed upon. Fur-
Preliminary and ther stated that construction had already begun, but did.
Final Approval not think that a building permit had been issued.
Ms . Baer pointed out that the Advisory Board recommended
approval of the project.
Bryan Johnson arrived .
Gillis questioned the Planning Office on punitive measures
that might be taken against the owner for beginning con-
struction without a building permit.
Chairman Adams stated that the Commission could not take
action, that the Building Department would be the en--
forcing body.
Ms . Baer pointed out the owner had agreed to add a parking
place on the east side of the building and sidewalks .
Vidal maee a motion to recommend approval , seconded by
Gillis . All in favor, with the exception of Johnson,
who abstained. Motion carried.
ORDINANCE t19 REVIEW CONCEPTUAL PRESENTATIONS
Goomba ' s Ms . Baer pointed out that the Engineering Department had
Restaurant recommended that no use be made of the alley -- not a de-
sirable access . Stated that this was a request for a
take-out/delivery restaurant and would require an inter-
ior remodel.
Ms. Baer stated that the Planning Office was recommending
that three parking spaces .
Ron Garfield, Attorney representing Tom Ianoco, stated
that if the Commission was talking about: principal use ,
they were only required to provide one parking space.
Garfield further pointed out that the applicant could
provide parking on the property, and that he was entitled
to 1 12--foot curb cut.
Ms. Baer stated that the applicant , should they choose to
buy the parking, would be required to go to the Board of
Adjustment.
Garfield stated that the project would consist of approxi -
mately 622 square feet of principal Use'.

Johnson made a. motion to deny the proposal , seconded by
Jenkins . All- in -favor_ ; motion carried.
Bruce Kistler, attorney representing the developer, was
present and requested the Commission clarify the grounds
for denial .
Chairman Adams stated that the use doesn' t conform with
the Land Use Map.
Ms . Baer stated that the Planning Office felt it was a
tourist use in a mixed residential area.
Kistler asked the Commission if they would classify mixed-
residential as a land use which would prohibit second homes .
Chairman Adams stated that they were applying the definition
of permanent resident housing.
Ms . Baer expressed the Council ' s concern for permanent
housing.
Chairman Adams stated that the second home takes up space
in an area which he doesn ' t want to see devoted to that
use.
Bartel stated that Ordinance f1l9 requires that disapproval
be in writing and sent by the Building Inspector.
Johnson made a motion that the Commission recommend the
Planning Office write a Resolution giving the reasons
for denial of the project and that this Resolution be
returned to the Commission for approval . Motion seconded
by Jenkins . All in favor, motion carried.

Chalet unit on the second floor of an existing lodge. Pointed
out that this is mixed residential ,
Chairman Adams stated that he objected to any lodge ex---
pansi_on in that area. Felt it would be inconsistent to
not allow Stein Gantzel to build on to his lodge and al-
low this expansion.
Mr. E_yemere ' s brother was present and stated that this
addition had been approved by the Board of Adjustment and
the Advisory Board had reconimendc d approval .
Chairman Adams pointed out that this was fairly far-re-
moved from the core area and would create a transporta-
tion problem.
Gillis stated. that sidewalks need to be considered for
that area.
Gillis made a motion to deny the project. Motion failed
for lack of a second .
Johnson made a motion to approve the project. Motion
failed for leek of a second .

Further pointed out that the Brown Ice Palace was quite
a tourist attraction, and that the Commission should con-
sider this expansion absolute miniumum.
Johnson made a motion to approve the project, seconded by
Jenkins. Johnson, aye; Jenkins , aye; Gillis , abstain;
Adams, nay. MOtion passed.
Ms. Baer pointed out that preliminary and final approval
would be at next regular meeting.
Commission decided to hold a special meeting on Tuesday,
October 23rd at 5 : 00 p,m.
Gillis made a motion to adjourn, seconded by Jenkins . All
in favor, motion carried. Meeting adjourned at 8 : 00 p.m.
