PUBLIC HEARING:
FLECK CONDITIONAL USE FOR ADU
Bob Nevins stated the applicant's representative, Jan Derrington,1■withdrew their
application. He said Derrington will provide the written request.
MOTION: Hunt moved to remove the Fleck Conditional Use for an
ADU from the agenda at the applicants request. Tygre seconded. ALL
IN FAVOR, MOTION PASSED.
NEW BUSINESS:
SMALL LODGE LOTTERY
Stan Clauson stated 5 proposals were received and since that number did not
exceed the 1996 allocations, a lottery was not necessary. The following
applications were requested: Brass Bed 6 2-Bedroom Units, Bell Mountain 3 4-
Bedroom Units and 7,250 sf Commercial Conversion, Crestahaus wanted a 10
Unit expansion and Fireside 4 4-Bedroom Units.
J Clauson stated the Commercial Conversion was 4,000 sf and thought it would be
possible to borrow from future years. Sara Garton asked Clauson about the P & Z
recommendation on Small Lodges to Council for 2 years at 4,000 feet a year and it
came back from Council at 3 years. Clauson said he did not get a clear
understanding if that was an error or not. Gideon Kaufman, Public, recalled a
larger quota over the three year period. Garton asked if once the 12,000 sf was
reached then there would be no more commercial conversions. Clauson said it
could be reauthorized.
MOTION: Roger Hunt moved that the Small Lodge Conversion/
Expansion Application Lottery has been satisfied with applications
less than this year's allotments. The projects that are allowed to go
forward with an application through the system are the Brass Bed,
Bell Mountain, Crestahaus and Fireside Lodges. Jasmine Tygre
seconded. ALL IN FAVOR with one abstention (Steve Buettow).
MOTION PASSED.

OLD REPUBLIC NATIONAL TITLE INSURANCE COMPANY, a Minnesota corporation, herein called the Company, for a
* * valuable consideration, hereby commits to issue its policy or policies of title insurance, as identified in Schedule A, in favor
* of the proposed Insured named in Schedule A, as owner or mortgagee of the estate or interest covered hereby in the land

Schedule A and B and to the Conditions and Stipulations hereof.
This Commitment shall be effective only when the identity of the proposed Insured and the amount of the policy or

* Commitment or by subsequent endorsement.
* This Commitment is preliminary to the issuance of such policy or policies of title insurance and all liability and obligations

shall issue, whichever first occurs, provided that the failure to issue such policy or policies is not the fault of the Company.
CONDITIONS AND STIPULATIONS
1. The term "mortgage", when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other
matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and shall fail to disclose such knowledge
to the Company in wnting, the Company shall be relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced
by failure of the proposed Insured to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if the Company otherwise acquires
actual knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company at its option may amend Schedule B of this Commitment accordingly, but
such amendment shall not relieve the Company from liability previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties
included under the definition of Insured in the form of policy or policies committed for and only for actual loss incurred in reliance hereon in undertaking in good faith (al to
comply with the requirements hereof or lb) to eliminate exceptions shown in Schedule B, or lc) to acquire or create the estate or interest or mortgage thereon covered by this
Commitment. In no event shall such liability exceed the amount stated in Schedule A for the policy or policies committed for and such liability is subject to the insuring
provisions and the Conditions and Stipulations and the Exclusions from Coverage of the form of policy or policies committed for in favor of the proposed Insured which are
hereby incorporated by reference and made a part of this Commitment except as expressly modified herein.
4. Any action or actions or rights of action that the proposed Insured may have or may bring against the Company
arising out of the status of the title to the estate or interest or the status of the mortgage thereon covered by this Commitment must be based on and are subject to the
provisions of this Commitment.
STANDARD EXCEPTIONS
In addition to the matters contained in the Conditions and Stipulations and Exclusions from Coverage above
referred to, this Commitment is also subject to the following:
1. Rights or claims of parties in possession not shown by the public records.
2. Easements, or claims of easements, not shown by the public records.
3. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, and any facts which a correct
survey and inspection of the premises would disclose and which are not shown by the public records.
4. Any lien, or right to a lien, for services, labor or material theretofore or hereafter furnished, imposed by law
and not shown by the public records.
5. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first appearing in the public records
or attaching subsequent to the effective date hereof but prior to the date the proposed insured acquires of record for value the estate or interest or mortgage thereon covered by this
Commitment.

A. Existing Conditions
The Brass Bed Lodge is located at 926 East Durant Street, Aspen,
Colorado. The lot consists of 13,800 square feet. Underlying zoning is
RMF with an LP Overlay.
The lodge originally received approval for the development of 29 lodge
units including 4 kitchens and 3 employee units. Construction on the
existing structure was begun in 1988 and ceased on or about 1991. The
existing structure currently consists of 15,356 s.f. The property has been
uninhabited and has not been in operation since 1988. At this time, the
structure is nearly complete on the exterior while the interior is only
partially constructed. All finish work as well as landscaping has yet to be
completed.
B. Proposed Change in Use Development
The Applicant proposes to convert the lodge structure to residential use by
means of a Change in Use application to the City of Aspen in compliance
with the recently approved Small Lodge Change in Use process. The
development shall consist of six (6) free market condominium units in two
(2) bedroom configuration. Additional housing will be provided for three
(3) employees on site. As the structure is in existence, this development
will represent a remodel/completion of the existing structure rather than
new development. The following Development Data table outlines the
specific parameters of the proposed development.

C. Affordable Housing
The Brass Bed Lodge was originally approved with 29 lodge units and a
requirement to house 3 employees. The proposed change in use to 6
residential units does not appear to require employee mitigation as no
employee generation is specified, pursuant to the Land Use Code and
supported by conversation with Stan Clausen, Director, Community _
Development Department. Additionally, the 6 residential units clearly
represent a significantly lower impact to the community. The residential
employee impact is significantly less than the lodge yet the same number of
employees will be provided housing. These employees shall be employed
seasonally by the Applicant, but housed, on site, on a year round basis as
part of the management of the project.
