On May 8, 1989, the Aspen City Council consented to the attached
action by the Planning Director, thereby granting the
insubstantial amendment to the Summit Place townhomes parking
plan.

Findings and Action
Summit Place Insubstantial PUD Amendment
Request: The applicant requests approval of an insubstantial
amendment to the Aspen Mountain PUD with respect to the Summit
Place Townhomes. The request is to permit the parking,
previously approved beneath the units, to be located directly
across Summit Street, on Lot 3 of the PUD, as surface parking.
Rationale: The applicant states that the technical consideration
which could not be anticipated during the review process was the
inability of the applicant to obtain the necessary easement from
a neighbor. Obtaining the easement was a condition of approval
which the applicant is now unable to meet.
Evaluation: The proposal does not exceed any of the review
standards identified in Section 7-907 A 1 through A 8 of the
Aspen Land Use Regulations. The applicant has presented
materials demonstrating that the project will not exceed the
permitted floor area established within the PUD, although the
usable living area within the buildings has increased.
The parking plan is acceptable to the City Engineer, with
conditions, as described in the attached letter from Jay Hammond
dated April 3, 1989. Having visited the site and reviewed the
site plan, we concur that the amendment is acceptable, provided
the conditions below are met.
Recommendation: The insubstantial amendment is approved, subject
to the following conditions being met:
1. The east edge of the parking area shall be locatedat least
10 feet west of the property line.
2. The minimum width of each parking space shall be 8 1/2 feet.
3. The applicant shall submit a document, suitable for
recordation, committing to remove the parking from this
location and agreeing to incorporate it beneath the Summit
Place units, within a parking structure for the Top of Mill
project or at another location satisfactory to the Aspen
City Council. when the parking is relocated, the applicant
shall replace the curb which now exists along this site.
4. The applicant shall submit to the Planning Office revised
elevations and plat drawings for recordation purposes prior
to the issuance of any building permit for the project.
5. No trees shall be removed from the property to accommodate
the parking spaces. The disturbed slope shall be stabilized
to insure that none of the existing trees are undermined.

MEMORANDUM
TO: Aspen City Council

RE: Insubstantial Amendment: Summit Place Townhomes
DATE: April 24, 1989
Staff has been working with the representatives of the Aspen
Mountain PUD project to process an insubstantial amendment to the
Summit Place Townhomes portion of the PUD. The amendment is
required because the applicant has been unable to meet one of the
conditions of the project's approval, which is to obtain an
easement from a neighboring property owner to access the
project's garages, located beneath the units. Therefore, the
applicant has identified an alternative off -site location,
directly across Summit Street, to provide the necessary parking.
A copy of the proposed site plan is attached for your reference.
The applicant requests approval for the parking to be located on
the south side of Summit Street, in a surface parking
configuration. A previous request by the applicant to construct
�a carport in this location was denied by staff for two reasons.
First, we found that development of a new structure exceeded our
authority under the insubstantial amendment criteria. We also
determined that the revised design increased the floor area on
the site beyond that permitted in the PUD agreement. The current
proposal, however, can be approved, since it corrects both of
these problems. Staff's findings and action on this request are
attached to this memo.
While the Code permits the staff to grant final approval to this
change, we felt the need for this item to be placed on the public
record, given the significant public attention given to the
entire project. Therefore, we recommend that Council consent to
the attached findings and staff level approval of the amendment.

Re: Surface Parking at Summit Place
Dear Joe:
I have reviewed the site plan for surface parking on the south
side of Summit Street for the Summit Place development included
with your letter off March 24.
The parking proposal is less than i6eal, creating a continuous
curb cut of some 64 feet. City code would normally require a
single curb cut of about 18 feet though it does allow variation
of this requirement for special conditions at the discretion of
the City Engineer (19.102).
There are several site conditions and representations which
compel me to grant the request for this curb cut.
a. Too ra h - The ground slope in the area points to the
difficulty and adverse impact associated with moving the
parking away from the curb line. The adjacent slope i•rould
mandate exteisive excavation and slope stabilization.
b. aummit Street - Summit Street in this area is an
easement through the Aspen Mountain Subdivision and not a
conventional street right-of-way. It is subject to very
minor traffic volumes, minimizing undesirable conflicts.
C. Temporary__ Nature - I consider your offer of a commitment
to relocate the parking within five years of C.O. a
mandatory aspect of this configuration.
Approval of the parking design is conditioned on several items:
1. Location of the east edge of the parking area at least 10
feet west of the property line.
2. Minimum :;tall width of 8 1/2 feet.

Dear Jay:
As we discussed, I am forwarding a drawing of the revised parking
solution proposed for Summit Place as well as some back-up
information regarding the Insubstantial Amendment request we
filed with the Planning Office a few days ago.
Originally, our request included a new parking garage in the same
location as the surface spaces, but Alan Richman felt that such a
change would have to go back to P&Z and City Council under a full
amendment process.
We are prepared to accept as a condition that within a fide -year
period from issuance of a Certificate of Occupancy for Summit
Place, the parking must either be re -incorporated into the Summit
Place structure, as presently shown on the First Amended Plat, or
approval must be secured from the City for a plan at Top of Mill
incorporating parking for the Summit Place project.
I think Alan is prepared to place our proposed changes on
Council's consent agenda if you can sign -off on the parking
proposal. Let me know at 925-8080 if you need additional
information.

Dear Alan:
The architects have adjusted finish grade for the Summit Place
project and I have rechecked the square footage as redesigned.
According to my calculations (see attached figures), the FAR of
the project is now 7,392 square feet, and the total floor area is
9,989 square feet under the current regulations for calculating
FAR. This is now well within the FAR square footage limitation
established under the First Amended and Restated PUD/Subdivision
Agreement and Plat documents of 7,700 square feet.
Jay has now agreed that the surface parking is acceptable with
the conditions shown in his letter. Our new site plan reflects
the changes that Jay has requested.
