SUMMARY: The Planning and Zoning Commission and staff recommend
that Council approve Ordinance No. 49, Series of 1989 Rezoning
Parcels A and B from Office "0" to Public "PUB" SPA and Parcel
Exchange from Public "PUB" SPA to Office "0" . The P&Z and staff
also recommend approval of subdivision for this parcel.
Attachment 1 illustrates the parcel exchange.
PREVIOUS COUNCIL ACTION: Council approved the land exchange with
Cap' s as shown in attachment 1 at their March 13, 1989, regular
meeting. Council approved Ordinancegoon 1st Reading on July 10,
1989 .
APPLICANT: City of Aspen
REQUEST: The purpose of this item is to complete the process
requirements for the Cap's land trade with the City which were
part of the Rio Grande Parking Facility Plan. The process
requirements are rezoning and subdivision.
As the attached plat indicates, the City will receive Parcels A
and B which will be rezoned from Office to Public SPA. In
exchange, Cap's will receive the portion labeled "Parcel
Exchange" which will be rezoned from Public SPA to Office. The
net gain to Cap's is approximately 1700 s. f. In addition, Cap's
is being granted easements for access as shown. These easements
are part of the overall land trade. Representatives of Cap's
have reviewed the plat.
LOCATION: Mill Street adjacent to the Rio Grande site.
PARCEL SIZE: 0. 19 ac. (Cap's)
STAFF COMMENTS: Section 7-1101 outlines standards of review for
rezoning. The following is a list of those standards.
STANDARDS
A. Whether the proposed amendment is in with any
applicable portions of this chapter. Staff finds this
request consistent with all applicable portions of this
chapter.
B. Whether the proposed amendment is consistent with all
elements of the Aspen Area Comprehensive Plan. This
request is part of the implementation efforts of the
Transportation Element.
C. Whether the proposed amendment is compatible with
surrounding Zone Districts and land uses, considering
existing land use and neighborhood characteristics.
This request is a reconfiguration of existing zoning
and compatible with surrounding zone districts.
D. The effect of the proposed amendment on traffic
generation and road safety. This request will help
improve the safety of traffic circulation on the site.
E. Whether and the extent to which the proposed amendment
would result in demands on public facilities, and
whether and the extent to which the proposed amendment
would exceed the capacity of such public facilities,
including but not limited to transportation facilities,
sewage facilities, water supply, parks, drainage,
schools, and emergency medical facilities. This
request is part of the overall effort of implementing
the Rio Grande Plan which includes a parking facility.
F. Whether and the extent to which the proposed amendment
would result in significantly adverse impacts on the
natural environment. This is an urban site which has
been developed.
G. Whether the proposed amendment is consistent and
compatible with the community character in the City of
Aspen. This request helps implement the Community's
Transportation Plan.
H. Whether there have been changed conditions affecting
the subject parcel or the surrounding neighborhood
which support the proposed amendment. The Rio Grande
Plan's implementation includes this request.
I. Whether the proposed amendment would be in conflict
with the public interest, and is in harmony with the
purpose and intent of this chapter. The public
interest will be served with this proposal.
This rezoning request is part of an overall solution to the
Community's transportation and parking problem. The P&Z and
Council devoted a large amount of time to the development of
the Rio Grande Parking Facility Plan and as a result staff
finds that this rezoning meets the review standards for

rezoning.
The following addresses the Subdivision section of the Code.
Staff will not review all the subdivision criteria because the
criteria pertains to a true subdivision of land. The Cap's
review resembles a lot line adjustment except for the fact that
the Cap's development potential will not be frozen based on the
original property size. The purpose of the Subdivision section
is to:
Sec. 7-1001. Purpose.
A. Assist in the orderly and efficient development of the
City;
B. Ensure the proper distribution of development;
C. Encourage the well-planned subdivision of land by
establishing standards for the design of a subdivision;
D. Improve land records and survey monuments by establish-
ing standards for surveys and plats;
E. Coordinate the construction of public facilities with
the need for public facilities;
J. Safeguard the interests of the public and the sub-
divider and provide consumer protection for the
purchaser;
K. Acquire and ensure the maintenance of public open space
and parks; and
L. Promote the health, safety and general welfare of the
residents of the City of Aspen.
The review standards for subdivision are summarized as follows:
1. General Requirements.
a. The proposed subdivision shall be consistent
with the Aspen Area Comprehensive Plan.
b. The proposed subdivision shall be consistent
with the character of existing land uses in
the area.
c. The proposed subdivision shall not adversely
affect the future development of surrounding
areas.
d. The proposed subdivision shall be in compli-

ance with all applicable requirements of this
chapter.
Response
The land trade clearly meets all the General Requirements of
the Subdivision section of the Code.

such as: 2 . Suitability of land for subdivision;
Improvements 3 .
(right-of-way, utility) ; 4. Design Standards.
All of these review standards have been addressed as part of
the Parking Facility Plan improvements.
RECOMMENDATION: In conclusion, the Planning and Zoning
Commission and staff find that these rez=oning and -subdivision
requests are in- the- Community's interest and recommend approval
with the condition that the City file a Final Plat to the
satisfaction of the City Engineer. The Engineering Department has
contacted a consultant to develop the Final Plat.
PROPOSED MOTION: I move to approve Ordinance No. 410,
1989 and to approve the subdivision request with th ondition as
stated above.

RE: Cap's Land Trade
DATE: May 9, 1989
The purpose of this memo is to apologize and explain about what
happened regarding the Cap's land trade.
First, I apologize for not beginning the rezoning and subdivision
process for Cap's at an earlier date. I did not focus on the
process and, therefore, realized this needed to be done only
after talking to the Attorney's office.
Second, it was implied that this should have been done during the
SPA process. The SPA process had many variations to it regarding
how the Cap's parcel would ultimately be configured and the final
configuration was not agreed upon until after the SPA process was
complete.
After discussions with Alan, we have decided that we can begin
the process on June 20 with P&Z for subdivision review and
rezoning from Office to Public (SPA) and from Public (SPA) to
Office of the appropriate land parcels. This is a two-step
process with public hearings at both P&Z and City Council.

NOTICE IS HEREBY GIVEN that a public hearing will be held on
June 20, 1989 at a meeting to begin at 4 :30 P.M. before the Aspen
Planning and Zoning Commission, 2nd Floor Meeting Room, 130 South
Galena Street, Aspen, CO 81611 to consider an application
submitted by the City of Aspen requesting rezoning and
subdivision of the property involved in the land trade between
Cap's and the City of Aspen for the purpose of constructing the
public parking facility on the Rio Grande. The City owned land
will be rezoned from Public to Office and the Cap's owned land
well be rezoned from Office to Public. This request will result
in a net increase of approximately 1, 600 sq. ft. of Office zoning.

RE: REZONING AND SUBDIVISION OF CAP'S AND CITY OF ASPEN
LAND ON THE RIO GRANDE SITE
NOTICE IS HEREBY GIVEN that a public hearing will be held on
June 20, 1989 at a meeting to begin at 4 :30 P.M. before the Aspen
Planning and Zoning Commission, 2nd Floor Meeting Room, 130 South
Galena Street, Aspen, CO 81611 to consider an application
submitted by the City of Aspen requesting rezoning and
subdivision of the property involved in the land trade between
Cap 's and the City of Aspen for the purpose of constructing the
public parking facility on the Rio Grande. The City owned land
will be rezoned from Public to Office and the Cap's owned land
well be rezoned from Office to Public. This request will result
in a net increase of approximately 1, 600 sq. ft. of Office zoning.
