SUMMARY: The Planning Office and Planning Commission recommend approval of the rezoning request. First Reading was held on Oct. 8 and approved by a 4-1 vote. COUNCIL GOALS: This rezoning will place the Ice Garden facility in a position of conformity with its zone district. This in turn allows this recreational resource to upgrade and maintain its place in the community, Goal #7. BACKGROUND: The Ice Garden has been in its location for 26 years. The current zoning designation is R-15. This non- conformity will jeopardize future renovation projects. Please see Attachment "A" , Staff memo to the Planning and Zoning Commission for detailed discussion of rezoning standards. PROBLEM DISCUSSION: As the facility will not change it ' s operations as a result of this rezoning, new impacts are not anticipated. Prior to the Planning and Zoning public hearing, the Planning Office received three inquiries from neighbors. All callers had no problem with the request. ADVISORY COMMITTEE VOTE: The Planning and Zoning Commission approved this request by a vote of 8-0 at their regular meeting on August 21, 1990. KEY ISSUES: This proposal generated no Commission concerns. RECOMMENDATION: The Planning Office concurs with the Planning Commission's recommendation to rezone the Ice Garden parcel to PUBLIC (PUB) . ALTERNATIVES: The parcel could remain R-15. The Ice Garden would remain a non-conforming use. PROPOSED MOTION: I move to have Second Reading of Ordinance 68 approving rezoning of Lots A-I, Block 54 from R-15 to PUBLIC (PUB) . CITY MANAGER COMMENTS: / ,`'' Attachment "A" - Planning Commission Memo dated August 14, 1990 • jtkvj/ice.ccmemo 2 MEMORANDUM TO: Planning and Zoning Commission FROM: Kim Johnson, Planner RE: Aspen Ice Garden Rezoning from R-15 to PUBLIC (PUB) DATE: August 14, 1990 SUMMARY: The Planning Office recommends approval of the rezoning of the Ice Garden parcel to PUBLIC (PUB) . APPLICANT: The City of Aspen, represented by George Pucak, Ice Garden Manager. LOCATION: 233 W. Hyman (Lots A-I, Block 54) The nine lots total 27, 000 s.f. See Attachment "A" . ZONING: Current Zoning is R-15. Requested zoning is PUBLIC (PUB) . APPLICANT'S REQUEST:, The rezoning would bring the Ice Garden use into a conforming status regarding zone districts. Without this conformity, future facility improvements might be jeopardized due to zoning conflicts. REFERRAL COMMENTS: The City Attorney's Office reviewed the application and forwarded no comments. STAFF COMMENTS: The proposal is to allow the rezoning of the Aspen Ice Garden parcel from its R-15 designation to PUBLIC (PUB) . This community recreation facility as it exists is not a permitted use in the R-15 zone, but is listed as a permitted use in the PUB zone. Given a rezoning of this parcel, the use of the property will not change. It will remain the City owned and operated skating facility. The plans for the Ice Garden include facilities improvements. As a non-conforming use in the R-15 zone, future improvements might not be permitted. The following are standards from Section 7-1002 which must be addressed when considering a Map Amendment (rezoning) : 1. Whether the proposed amendment is in conflict with any applicable portions of this chapter. response: This proposal will legitimize a land use which has been in existence since 1964. The R-15 zone designation was applied since construction of the facility. Land uses in the neighborhood surrounding this site include single and multi- family residential, lodges, and vacant Park property. 2. Whether the proposed amendment is consistent with all elements of the Aspen Area Comprehensive Plan. response: ..► The Comp Plan Map shows this area to be mixed residential, adjacent to trail and transit routes. The Recreation/Parks/Trails element of the Plan states as goals the need to "whenever possible.. utilize land already owned by the city" for recreational development, "continue to develop multi- use sports facilities", and "maintain a community balance between active, intense recreational parks and passive parks." To maintain and improve this facility as the Plan suggests will require it to be in conformance with its zoning. 3. Whether the proposed zoning amendment is compatible with surrounding Zone Districts and land uses, considering existing land use and neighborhood characteristics. response: As mentioned above, much of the mixed character of the neighborhood has developed around the Ice Garden. The building is a public facility and has always enjoyed a good operating relationship with the neighborhood, according to the Manager George Pucak. Rezoning the property will not increase any impact on the area. 4. The effect of the proposed amendment on traffic generation and road safety. response: The change will not affect the level of activity at the property. 5. Whether the proposal will result -in increased demand on public facilities. response: No changes in public facilities needs will result from this rezoning. 6. Whether the proposed amendment will result in impacts on the natural environment. response: There will be no further impacts resulting from the rezoning. 7. Whether the proposal is consistent and compatible with the community character in the City of Aspen. response: The Ice Garden has been a part of the community since 1964. This rezoning will allow it to continue to serve the local population and tourists alike. Response: No, the proposed amendment would not be in conflict with any applicable portion of the Public Zone District. Question B - Whether the proposed amendment is consistent with all elements of the Aspen Area Comprehensive Plan. Response: Yes, the proposed amendment is consistent with all elements of the Aspen Area Comprehensive Plan. Question C - Whether the proposed amendment is compatible with surrounding Zone Districts and land uses, considering existing land use and neighborhood characteristics. Response: The Aspen Ice Garden was constructed in 1964 and has operated continuously in the same location for 26 years. Most of the zoning, land uses and neighborhood development have come into place since its construction. The building is a public recreation facility and has always enjoyed a good operating relationship with the surrounding neighborhood. Question D - The effect of the proposed amendment on traffic generation and road safety. Response: Since the Ice Garden is already in existence, there will be no change in traffic generation or road safety. Attachment 4 Page 2 Question E - Whether and the extent to which the proposed amendment would result in demands on public facilities, and whether and the extent to which the proposed amendment would exceed the capacity of such public facilities, including but not limited to transportation facilities, sewage facilities, water supply, parks, drainage, schools and emergency medical facilities. Response: Again, the Ice Garden is already in existence and operating. No change is anticipated in transportation requirements, sewage requirements, water supplies and drainage re- quirements. I t will not change with respect to its relation- ship to parks, schools or emergency medical facilities. Question F - Whether and the extent to which the proposed amendment would result in significantly adverse impacts on the natural environment. Response: The proposed amendment will have no adverse impacts on the natural environment. Question G - Whether the proposed amendment is consistent and compatible with the community character in the City of Aspen. Response: Yes, the Aspen Ice Garden has been a part of the Aspen Community since 1 964. I t serves the recreational skating needs of adults and children for both visitors and the local population. Amendment 4 Page 3 Question H - Whether there have been changed conditions affecting the subject parcel or the surrounding neighborhood which support the proposed amendment. Response: The Ice Garden is currently a non-conforming use in a non conforming zoning. In order for the City to improve, remodel or upgrade the facility, it must be first placed into the correct zoning category. Question I - Whether the proposed amendment would be in conflict with the public interest, and is in harmony with the purpose and intent of this chapter. Response: No, this rezoning would not be in conflict with the public interest. I t would place the Aspen Ice Garden into the proper zoning category, i.e. that of a community recreation facility in the Public Zone.
