HomeMy WebLinkAboutresolution.hpc.007-2019 RESOLUTION #7, SERIES OF 2019 A RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION DENYING A REQUEST FOR MINOR DEVELOPMENT FOR THE PROPERTY LOCATED AT 302 E. HOPKINS AVENUE, LEGALLY DESCRIBED AS LOT K, BLOCK 80, CITY AND TOWNSITE OF ASPEN, COLORADO PARCEL ID: 2737-073-29-005 WHEREAS, the applicant, Hillstone Restaurant Group, a Delaware corporation, ("Hillstone"), represented by Bendon Adams, requested HPC approval for Minor Development for the property located at 302 E. Hopkins Avenue, legally described as Lot K, Block 80, City and Townsite of Aspen, Colorado; and WHEREAS, Section 26.415.070 of the Municipal Code states that "no building or structure shall be erected, constructed, enlarged, altered, repaired, relocated or improved involving a designated historic property or district until plans or sufficient information have been submitted to the Community Development Director and approved in accordance with the procedures established for their review"; and WHEREAS, for Minor Development Review, the HPC must review the application, a staff analysis report and the evidence presented at a hearing to determine the project's conformance with the City of Aspen Historic Preservation Design Guidelines per Section 26.415.070.C.3.b of the Municipal Code, and other applicable Code Sections. The HPC may approve, disapprove, approve with conditions or continue the application to obtain additional information necessary to make a decision to approve or deny; and WHEREAS, Kevin Rayes, in his staff report recommended HPC deny the application as proposed and, WHEREAS, HPC reviewed the project on April 10, 2019 and considered the application, the staff memo and public comments. HPC found, by a 6 to 0 vote, that the criteria for Minor Development were not met. NOW, THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION COMMISSION OF THE CITY OF ASPEN, COLORADO THAT THE REQUEST FOR MINOR DEVELOPMENT IS DENIED. Section 1: Minor Development Review- Synthetic Grass HPC hereby denies Minor Development for 302 E. Hopkins Avenue for the installation of synthetic grass in the front yard of the property with the following requirements: 1. The synthetic grass, which is already in place will be removed and natural sod will be laid by June 14th, or the applicant will propose alternative landscape materials to staff and monitor. Vos Caudill, Pitkin County, CO Section 2: Minor Development Review- Utility Meters HPC hereby denies Minor Development for 302 E. Hopkins Avenue for the the relocation of gas utility meters between the historic shed and the rear of the non-historic addition with the following requirements: 1. If the applicant wishes to further pursue gas meters on this site, staff and monitor must review and may approve an alternative location for the utility meters. Locating the meters between the historic shed and the rear of the principal dwelling is prohibited. 2. This alternative location requires review and approval by the Building Department. Section 3: Existing Litigation This Resolution shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior ordinances. Section 4: Severability If any section, subsection, sentence, clause, phrase, or portion of this Resolution is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof.
