Dear Mr. Cantrup,
I am in receipt of your application for rezoning of Lots 7-12 ,
Block 4 , Eames Addition. There are several additional pieces of
information which I will need to certify this application as complete
and to set it for a Planning Commission agenda.
First , I request that you provide me with a copy of your option
contract to purchase the lots in question. Having talked to both
Peter Forsch and Art Daily, I am aware of the existence of this
contract. Nevertheless, I must have proof in writing that you have a
legal interest in this property . Furthermore , you must gain the
concurrence of the owner of the property, the Aspen Skiing Company, by
providing a letter in favor of the proposal signed by them.
Second, you have submitted no information in support of your
request . I attach Section 24-12 .5 (d) of the Aspen Municipal Code ,
which provides criteria for the review of a rezoning application.
Please articulate the factual basis in support of your request by
providing us with information on the relevant criteria . If you do
not , it will be up to the Planning Office to address these criteria on
its own, and your position may not be adequately conveyed to the
Planning Commission until you come before them. For example, I am
aware that there are commitments by the Aspen Skiing Company in the
Aspen Mountain Ski Area Master Plan with respect to the current
parking on the site. Please let us know how you propose to address
these commitments if you are successful in rezoning this site.
Please let me know if you need any assistance in responding to
these requirements of the Code . I await your response in this regard.

Balderson, Bent and Cabell, a Joint Venture ( "Covenantor" ) for (,
itself, successors and assigns, in consideration of the granting of
revision to the 1985 conditional use application by the Planning and Y_
Zoning Commission dated April 22, 1986, and as an inducement to the
granting thereof, hereby convenant with the City of Aspen, Pitkin
County, Colorado, to restrict such property, and hereby does restrict
such property as follows:
1. Covenantor is the owner of the following described property
(the "Property" ) together with the improvements thereon situated in
the City of Aspen, Pitkin County, State of Colorado:
Lot 6 , 7, 8 and 9, Block 3 , Eames Addition to the City and
Townsite of Aspen, Colorado, which property is also described
as Lots 6, 7, 8 and 9 , Block 3 , Eames Addition to the City
and Townsite of Aspen and also that part of Lots 6, 7, 8 and
9 within the City and Townsite of Aspen, County of Pitkin,
State of Colorado.
2. In the event of any municipal improvement or improvements of
the kind contemplated in Section 20-16 of the Municipal Code of the
City of Aspen, as amended, become, in the sole judgment or discretion
of the City Council of the City of Aspen, necessary or desireable to
the area of the subject property, Covenantor will make no objection to
any special assessment or special tax or proceeding therefor on the
basis that the property is adequately served by existing improvements
and/or on the basis that the premises will not be served or benefited
by the improvement or improvements proposed. Covenantor further
agrees to join, upon the City' s demand therefor, any improvement
district formed for construction of such improvements ( including,
without limitation, drainage, underground utilities, paving, curbs,
gutters, sidewalks, street lights, etc. ) in the area of the property
or to reimburse the City of Aspen directly upon demand therefor if the
City should choose to construct these improvements without the for-
mation of such a district.

3. Covenantor warrants that this is the title owner of the subject
property with full authority to restrict the property as aforesaid and
that there are no persons or entities who have an interest in the sub-
ject property who have not agreed and consented to the aforesaid
restrictions.
4. None of the covenants contained herein shall be released or
waived in any respect without the prior consent of the City of Aspen,
reflected by resolution of the City Council of the City of Aspen.

Re: Rezoning Application of Lots 7-12,
Block 4, Eames Addition
Dear Alan:
Please accept this letter as waiver on the part of the applicant of
the Planning and Zoning Commission requirement of a hearing during the
month of October on his rezoning request. The applicant does request
that under the unified procedure of the Planning Office for properties
in the City of Aspen that the rezoning question be considered
simultaneously with the growth management application.
We would like to follow this procedure because if your office has
available the overall development plan at the time of application for
a growth management allocation it will much more graphically show the
public benefit and necessity for rezoning of the subject tract which
is bordered on both the north and south property lines by land now
zoned L-2. Would you kindly confirm the acceptability of this
procedure either by indicating on a copy of this letter or on a
separate letter that the above method of handling this zoning change
request is acceptable.
