Dear Mr. Shoaf: I am writing in response to your request for an interpretation of the allowable floor area ratio for lots within the Astor Subdivision/Planned Unit Development (PUD). Ordinance No. 4, Series of 1994, approved the Astor SubdivisionIPUD. This Ordinance specifically established a PUD to vary the minimum lot area requirement of lots 1, 2 and 3 from the underlying R-6 Zone District's dimensional requirements for duplex use, and for no other reason. Section 4, number 3 of this Ordinance also states, "Nothing in the approvals provided by this Or~inance shall exempt the site specific development plan from subsequent reviews and/or approvals required by this Ordinance or the general rules, regulations or ordinances of the City provided that such reviews or approvals are not inconsistent with the approval granted and vested herein." The subdivision/PUD's vested status expired in 1997. Therefore, lots within the Astor Subdivision/PUD are subject to current R-6 zoning dimensional requirements, including floor area ratio, at the time a development is proposed. The lots within this subdivision/PUD are not exempt from Ordinance No. 56, Series of 2000.
