An amendment to the approved fee ordinance is required in order to correct the zoning fee scale. City Council has the authority to approve an amendment to the City of Aspen Fees. Staff recommends that City Council approve the requested amendment to the City of Aspen Zoning Fees. APPLICANT: City of Aspen Community Development Department. BACKGROUND: Ordinance 57, series of 2000 approved new building plan check fees by zoning. It was brought to the attention of the Community Development Director that the new fees were in error. The zoning fees are based on the square footage of a proposed structure that is being reviewed for a building permit. It was found that the new fees that were approved were incorrect in that as the square footage increased over certain thresholds on the fee scale, the fees would decrease rather than increase. The Community Development Staff wishes to correct the zoning fee scale so that as the square footage of a proposed building increases, the fee will as well. Staff also recommends an amendment to include a zoning fee of $25.00 and a plan check fee of $25.00 to pay for the cost of reviewing bear trash containers as is required pursuant to Ordinance 30, Series of 1999. STAFF COMMENTS: A fee ordinance amendment is necessary to correct an error in the zoning plan check fees for building permits. The proposed zoning plan check fees are attached in Exhibit A. The current zoning plan check fees are attached as Exhibit B. Staff offers the following example to illustrate the problem in the current fee schedule. We compare a 3,500 square foot house to a 3,501 square foot house. Pursuant to the approved fees the 3,500 square foot structure would be $890.00 and the fee for the 3,501 square foot structure would be $490.00. The proposed zoning plan check fees would correct this error. The fee ordinance amendment to include a zoning and building plan check fee for bear proof trash containers will help staff pay for the cost of reviewing building permits required for bear proof trash containers. RECOMMENDATION: The Community Development Department recommends that Council approve the amendment to fee ordinance to allow for the correction of zoning plan check fees as proposed in Exhibit A. RECOMMENDED MOTION: "I move to approve Ordinance No. jjZ, Series of 2001, allowing the fee ordinance to be amended to correct the zoning plan check fee scale and to include a building and zoning plan check fee for the review of building permits applications for bear proof trash containers". NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ASPEN, COLORADO: Rectinn 1 That Section 26.04.080 of the Municipal Code of the City of Aspen, Colorado, which section establishes zoning fees, is hereby amended to read as follows: 26.04.080 Zoning fees. Zoning shall be charged the following fees for the services listed: I. Building plan checks by zoning (a $100.00 deposit shall be collected at building permit application submittal): A. Section 3 r 0 This ordinance shall not have any effect on existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances amended as herein provided, and the same shall be construed and concluded under such prior ordinances. Section 4 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions hereof. Two 6-month periods are established for the Business Vehicle Permit: Winter Season, November 1 through April 30, and Summer Season, May 1 through October 31. IV. Miscellaneous Parking Fees. (a) When a tenant applies for electric service at a new location, the applicant shall be required to place a cash deposit in the following manner: Residential service: one hundred dollars ($100.00). Commercial service: (1) An amount equal to the service bills for the subject property for the three (3) highest months of usage during the prior year, if the applied -for use of the property is similar to the prior use; or (2) If there is no similar prior space or use on which to compute the amount provided in subsection (a)(1), then an amount to be determined by the Utilities Director within his sole discretion, and based on a reasonable estimate of three (3) months' service for a space and use similar to the subject property. (b) Subject to the approval of the Utilities Director based on previous credit history with the City of Aspen Utilities, the owner of the premises on which the electricity is used may approve waiver of their tenant's deposit requirement by completing an application which informs the owner of the possibility of a lien upon the premises for unpaid bills, pursuant to section 25.04.090. (c) Deposits shall be held by the Director of Finance until service is discontinued and final service bills paid and will accrue interest at five (5) percent per annum starting thirty (30) 9 days after receipt of the monies until the date of disconnection. Return of the unused portion of the deposit plus interest will be made within forty-five (45) days from date the final bill is issued. Section 8. That Section 25.16.090 of the Municipal Code of the City of Aspen, Colorado, which section establishes deposits for water service, is hereby amended to read as follows: Section 25.16.090 Deposit for water service. (a) When applying for water service at a new location, each applicant shall be required to place a cash deposit in the following manner: Residential service: fifty dollars ($50.00). The zoning fee would be the minimum (I think -- maybe verify with Sarah or James), plan check and permits fees based on valuation of work. I don't think for these little structures we should charge the $50.00 GIS fee, but I'm not the one to decide (Stephen, what do you think?). Custom fields would probably be square footage, census code which would be "ms", detailed or limited, and any of "the "boiler plate" fields you would usually include."
