A flat fee is collected by Community Development forapplications which normallytake a minimal and predictable amount of staff time to process. Review fees for other City Departments reviewing the application (referral departments) will also be collected when necessary. Flat fees are cumulative - meaning an application with multiple flat fees must be pay the sum of those flat fee. Flat fees are not refundable. A review fee deposit is collected by Community Development when more extensive staff time is required. Actual stafftime spent will be charged against the deposit. Various City staff may also charge theirtime spent on the case in addition to the case planner. Deposit amount may be reduces if, in the opinion of the Community Development Director, the project is expected to take significantly less time to process than the deposit indicates. A determination on the deposit amount shall be made during the pre-application conference by the case planner. Hourly billing shall still apply. All applications must include an Agreement to Pay Application Fees. One payment including the deposit for Planning and referral agency fees must be submitted with each land use application, made payable to the City of Aspen. Applications will not be accepted for processing without the required fee. The Community Development Department shall keep an accurate record of the actual time required for the processing of a land use application requiring a deposit. The City can provide a summary report of fees due at the applicant's request. The applicant will be billed for the additional costs incurred bythe City when the processing of an application bythe Community Development Departmenttakes more time or expense than is covered by the deposit. Any direct costs attributable to a project review shall be billed to the applicant with no additional administrative charge. In the event the processing of an application takes less time than provided for bythe deposit, the department shall refund the unused portion of the deposited fee to the applicant. Fees shall be due regardless of whether an applicant receives approval. Unless otherwise combined bythe Director for simplicity of billing, all applications for conceptual, final and recordation of approval documents shall be handled as individual cases forthe purpose of billing. Upon conceptual approval all billing shall be reconciled and past due invoices shall be paid prior to the Director accepting an application for final review. Final review shall require a new deposit at the rate in effect atthe time of final submission. Upon final approval all billing shall be again reconciled prior to the Director accepting an application for review of technical documents for recordation. The Community Development Director may cease processing of a land use application for which an unpaid invoice is 30 or more days past due. Unpaid invoices of 90 days or more past due may be assessed a late fee of 1.7% per month. An unpaid invoice of 120 days or more may be subject to additional actions as may be assigned bythe Municipal Court Judge. All payment information is public domain. All invoices shall be paid priorto issuance of a Development Order or recordation of development agreements and plats. The City will not accept a building permit for a property until all invoices are paid in full. For permits already accepted, and unpaid invoice of 90 days or more days may result in cessation of building permit processing or issuance of a stop work order until full payment is made. The property owner of record is the party responsible for payment of all costs associated with a land use application for the property. Submit Development Application. Based on your pre-application meeting, you should respond to the application package and submit the requested number of copies of the complete application and the application and the appropriate processing fee to the Community Development Department. 3. Determination of Completeness. Galena St. I (970) 920 5090 6SGM MEMORANDUM TO: Ben Anderson, Planner FROM: Alex Ewers, PE, CFM DATE: August 16, 2018 RE: 700 E Main Street Response to The City of Aspen Land Use Code Section 26.435.040 This memorandum is to present our satisfaction of the City of Aspen Land Use Code concerning 700 E Main St., also known as River Park. Proiect Summary The primary purpose of this project is to replace the existing greenroof at The River Park Condominiums. Secondary improvements and repairs include repairing and replacing all onsite snowmelt, repairing storm drain systems, adding a hot tub and improving stormwater runoff quality. As seen on the existing conditions survey, the existing building and many proposed and existing site improvements are located within the 100' setback from the high-water line of the Roaring Fork River. For the purpose of this review, the high-water line is conservatively being defined as the effective 100-year floodplain. The Top of Bank, as shown in the attached survey, as per section E, was determined by SGM and approved by City of Aspen (COA) Engineer, Jack Danneberg. Alex Ewers (SGM) spoke with Ben Anderson by phone on May 211 2018 and was advised by Ben to respond to sections 26.435.040.C.8, 26.435.040.C.9, possibly 26.435.040.C.10, 26.435.040.E.1 and 26.435.040.E.2 of the COA Land Use Code. Top of Bank Special Review (26.435.040 El&2) SGM staked the top of bank in March of 2018 and met with Jack Danneberg of the City of Aspen Engineering Department onsite to discuss. Jack approved the staked top of bank and the top of bank line was then surveyed by SGM. The collected survey data is reflected in the attached existing conditions survey. Improvements Below the Top of Bank (26.435.040 C 8) No improvements are being added below the established top of bank. The only existing improvement below the top of bank is an 8" PVC pipe outfall. This pipe serves as the stormwater outfall for most of the site and is shown on the existing conditions survey accompanying this memo. This outfall appears to be functioning properly. This pipe sticks out a couple feet beyond the surrounding rocks. In order to improve aesthetics from the Roaring Fork River, SGM is proposing to use a hand saw and cut off the excess length from the pipe. This will not affect the performance of this drain, will not h#xe a construction impacts and is only being done to improve aesthetics. RUCEIVED SEP 1 2 2018 CITY OF ASPEN nAA"£4 NITY DEVELOPMENT .LE Proposed Improvements Within the 15' Top of Bank Setback (26.435.040 C 81 Existing improvements within the 15' Top of Bank Setback include a fence and drywell near the pool. The existing fence is shown in the existing conditions survey and the estimated location of the existing drywell is shown in the drainage plan. The drywell is not shown in this location in the original construction documents and was discovered when a camera was run through the associated storm drain pipe. The drywell location was estimated by the camera crew at All Valley Resource, LLC. The camera crew also estimated this drywell to be "large" and the invert in to be about 9' deep. The drains associated with this drywell have been blocked and are being rerouted to the proposed rain gardens. Due to this existing drywell's estimated depth, location near the top of bank and existing trees, we propose to abandon this drywell in place to prevent unnecessary construction disturbance at this area. This project is proposing two rain gardens within 15' of the established Top of Bank. These improvements are shown on the proposed drainage and grading sheets. These improvements are being made to help the project meet the City of Aspen Urban Runoff Management Plan Major Project requirements and to restore the natural riparian habitat. No disturbance will occur below the top of bank or within the 100-year floodplain other than the pipe cut mentioned in the section above. All planting information is presented on the accompanying Landscape Architecture Plans and will conform to stream margin vegetation requirements. Rain gardens are a preferred water quality treatment method of the City of Aspen Engineering Department and we believe this project provides an appropriate opportunity to create two rain gardens to treat some of the stormwater runoff on the property. The proposed rain gardens will be a very natural way to treat the stormwater runoff and will appear very natural from the river. To create the rain gardens, grading must occur to either add or remove surface soil. The proposed grading plan balances the natural grade of the bank without raisingthe finished grade in a way that is out of place and without removing excessive soil from within the dripline of the adjacent trees. Proposed Improvements Outside the 15' Top of Bank Setback (26.435.040 C 9) All proposed development outside the fifteen-foot setback from the top of slope will not exceed a height delineated by a line drawn at a forty-five degree angle from the ground level at the top of slope. The majority of these improvements are at or below existing grades with restoration to such grades. Proposed improvements outside of the 15' top of bank setback, but within the 100' offset from the high- water line, will not be any closerto the high water line than the existing development. Improvements in this category include repairing all snowmelt, repairing storm drain systems, adding a hot tub, and replacing the greenroof. Exterior Lighting (26.435.040 C 10) All proposed exterior lighting is low and downcast with no lights directed toward the river or located down the slope and is in compliance with Section 26.575.150.
