Regular Meeting Aspen Planning and Zoning Commission July 18, 1978
The Aspen Planning and Zoning Commission held a regular meeting on July 18 , 1978,
at 5: 00 PM in the City Council Chambers. Members present were Charles Collins,
Olaf Hedstrom, Donald Ensign and Welton Anderson. Also present were Karen Smith,
Richard Grice, Jolene Vrchota and Curt Stewart of the Planning Office.
Approval of Minutes .Ensign moved to approve the minutes of May 30 and June 20
as amended and the minutes of June 27 as presented, Hedstrom
seconded. All in favor, motion approved.
Manor House Smith noted that this is a continued public hearing on the
Preliminary Plat Manor House Preliminary Plat. She introduced the applica-
tion at the last meeting. They are converting nine units
to apartments. Two conditions of the conceptual approval
were to be addressed by_this _phase: utility and road right
of way easement be clarified on the plat and maximum park-
ing be provided and appear on the plat. Other conditions
included a commitment for one employee unit, 90 day right
of first refusal. She noted positive comments from the
Aspen Metro Sanitation District, Willard Clapper of Rocky
Mountain Natural Gas and George Newell Fire Marshal. Ellis '
concerns were with the utility and road right of way ease-
ments. He suggests this a condition of approval. He rec-
ommends 6 spaces as the optimum number for parking. He
also asks for an updated copy of the title commitment, The
Planning Office recommends approval with these conditions.
Marty Kahn, representing the applicant, explained the
problems with the easements. Smith recommended conditioning
approval on review of the submitted letter by Dave Ellis.
Collins asked if they could provide more than 6 parking
spaces. Kahn noted that they are working with the Alps and
may be able to acquire more spaces at the Homeowner' s meet-
ing in October. Collins asked how many spaces are required.
Kahn noted that this predated the off street parking regula-
tion and they are not required to provide any. Based on
the number of bedrooms, they would be required to provide
15 spaces.
Collins closed the public hearing.
Hedstrom moved to recommend approval of the Manor House
Preliminary Plat inasmuch as the questions concerning
overlapping easements and parking have been resolved to
the commission' s satisfaction, and they suggest that the
easement corrections be submitted to the City Engineer for
his approval and that the parking be worked out to a prac-
tical maximum, Ensign seconded. All in favor, motion ap-
proved.
Hovdesven Grice introduced the application. He noted that this is the
PUD Exemption last undeveloped lot in the N/C zone. The N/C zone has a
mandatory PUD overlay. He noted a memo from Hal Clark in
1977. The applicant has worked with the Building Inspector
and he notes that the building is in compliance. He notes
that they are 632 sqft. deficient in the open space require-
ment. He is requiring that the plans be changed to comply
prior to the issuance of a building permit. Ellis has a
problem with the location of an electric transformer in the
building. He also notes that if they wish to heat the park-
ing area for snowmelt, the drainage does not enter the
right-of-way.
Lenny Oates, representing the applicant, noted that they
will comply with the concerns of the commission. Collins
asked if they will have to put an opening in the Durant
Mall for the underground parking. Oates said yes, there
is plenty of room. Ensign asked if they will hook into
the Durant Mall. Oates said yes, they will hook into the
second floor. Ensign asked how they will comply with the
open space requirement. Hovdesven said they will tighten

the stairwells and work with the Building Inspector.
Hedstrom moved that the Planning and Zoning Commission
determine that the proposed Hovdesven Durant Original
Building on Lots R & S, Block 106, meets the objectives
of a Planned Unit Development and compliance with Sec-
tion 24-8. 1 is not necessary and therefore grants ex-
emption from Planned Unit Development procedures subject
to the following conditions: 1) dedication of an ease-
ment for the replacement of the electric transformer as
may be required by the City of Aspen Electric Department,
2) that a drainage plan for snowmelt approved by the
City Engineer be obtained should the paved parking at the
rear of the building be heated for snowmelt, 3) that the
plans be altered to conform with the open space require-
ments of the N/C zone prior to issuance of a building
permit, Anderson seconded, All in favor, motion approved.
Molny
Smith introduced the application. She showed the loca-

tion on a map. The applicant proposes an addition to
the house to the west. This is within 100 feet of the
river bank. She noted that the floodplain is not a
factor in this application. The Planning Office recom-
mends approval. Collins asked if there were any trail
easement problems. Smith noted that the applicant has
given an easement.
Ensign moved to grant Stream Margin Review approval
for the Molny project, Hedstrom seconded. All in favor,
motion approved.

Smith asked that this be tabled.
Ochs
Grice introduced the application. He noted that the
Subdivision
City Engineer has no problems. Marc Danielson has no

comments since there will be no tenant displacement.
Grice showed a plat of the property. It is on Lot 29 ,
West Aspen Subdivision.
Ensign moved to approve the Ochs Subdivision Exemption
inasmuch as it complies with the intents of the regu-
lations, subject to 6 month minimum lease, Anderson
seconded. All in favor, motion approved,
Francis Street Condos.
Grice introduced the application, There are two

existing single family houses located on two adjacent
lots .
John Kelly, representing the applicant, noted that they
do not meet the legal requirements of a duplex but it
can be condominiumized. Grice noted that there will
be common land. The engineering department notes a need
for a curb, gutter and sidewalk and suggests that approval
be conditioned on the agreement of the applicant to en-
ter into an improvement agreement for a curb, gutter and
sidewalk. Kelly agreed to this. Grice noted that these
units were recently sold. They are undergoing major
renovation and are presently vacant. The Planning Office
recommends approval subject to a 6 month minimum lease
and the provisions of ordinance 53, and agreement to
an improvement district.
Hedstrom moved to recommend exemption of the Francis
Street Condominium proposal, Lots A & B, Block 16, from
strict application of the subdivision regulations inas-
much as the intent and purposes of the regulation have
been satisfied and subject to a 6 month minimum lease
restrictions, Ordinance 53, and subject to the owners
entering into an improvement agreement pertaining to
curb, gutter and sidewalks satisfactory to the City

Engineering Department, Ensign seconded. All in favor,
motion approved.
Ensign moved to adjourn the meeting, Anderson seconded.
All in favor, motion approved. Meeting adjourned at
6: 30 PM.
