Dear Chris, As requested, we submit this letter as an application for an amendment to Resolution No 13, Series of 2010 approving a special review stream margin review for 69 Shady Lane, City of Aspen, Colorado. The Applicant submitted a building permit application on April 17, 2012. As a result of review and requirements by the Parks Department, the design of a proposed residence was modified to avoid the elimination of four large evergreens in the Development Area The new location on site (approved by parks) requires the back-out from the garage to extend beyond the Development Area. See attached site plan. Per the Resolution, Section 1, item #4, "Development on the river-side of this development boundary shall be limited to at-grade type work which will not raise the base flood elevation...any development activity including landscaping shall be subject to the approval of the Community Development Director and the City Engineer". Both the Engineer and the Community Development Director have agreed to the back-out on the river-side of the Development Area with conditions: 1. Minimal re-grading occurs in addition to no retaining walls beyond the development area envelope. 2. The back out needs to be designed of a permeable material. 3. Snow removal is an issue, unless monitored, snow will be pushed off the back out into the Hunter Creek drainage, negating the point of protecting water quality. 4. Drainage, any drainage off the surface of the back out will need to be directed away from Hunter Creek drainage. The Applicant agrees to meet these conditions and asks that an Amendment be granted by means of a new development order. We also ask that the small on-grade terrace with firepit located on the South side of the Development boundary be included in this development order.
