CREATING A POLICY FOR SUBMITTAL OF CLARIFICATIONS, OR RESPONSES
TO COMMUNITY DEVELOPMENT DEPARTMENT MEMORANDUM
RESOLUTION #24, SERIES OF 2012
WHEREAS, Section 8.4 of the Home Rule Charter of the City of Aspen provides in part that
"Each board and commission shall operate in accordance with its own rules of procedure except
as otherwise directed by the council;" and
WHEREAS, Section 26.304.060C.6. of the Aspen Municipal Code, General Hearing
Procedures; Other rules to govern, allows the decision-making body to have "adopted rules of
procedure, so long as the same are not in conflict with this Title;" and
WHEREAS, at their regular meeting of October 10, 2012, the Historic Preservation
Commission approved a policy for submittal of clarifications, or responses to the Community
Development Department memorandum by a vote of 5 to 0.
NOW, THEREFORE, BE IT RESOLVED:
That the Aspen Historic Preservation Commission hereby has the following policy:
An applicant must submit all new information that is to be presented to HPC in response
to the staff memo, or as further illustration of the project, no later than 12 p.m. on the day
before the hearing, when it shall be distributed to the board members. This includes
drawings and written material of any kind. No substantive changes may be proposed
after the staff memo is issued. Substantive changes will be reviewed at a later date due to
the requirement that HPC receive a staff recommendation prior to making findings.
APPROVED BY THE COMMISSION at its regular meeting on the 10th day of October,
2012.
