Vos Caudill, Pitkin County, CO A RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION (HPC) APPROVING MINOR DEVELOPMENT FOR 419 E. HYMAN AVENUE, UNIT 8 OF THE PARAGON BUILDING CONDOMINIUMS, BLOCK 89, CITY AND TOWNSITY OF ASPEN, COLORADO RESOLUTION#1, SERIES OF 2013 PARCEL ID: 2737-182-16-048 WHEREAS, the applicant, Paragon Penthouse, LLC, represented by Haas Land Planning, requested Minor Development approval for 419 E. Hyman Avenue, Unit 8 of the Paragon Building Condominiums, Block 89, City and Townsite of Aspen. The property is a designated landmark; and WHEREAS, Section 26.415.070 of the Municipal Code states that "no building or structure shall be erected, constructed, enlarged, altered, repaired, relocated or improved involving a designated historic property or district until plans or sufficient information have been submitted to the Community Development Director and approved in accordance with the procedures established for their review;" and WHEREAS, for Minor Development Review, the HPC must review the application, a staff analysis report and the evidence presented at a hearing to determine the project's conformance with the City of Aspen Historic Preservation Design Guidelines per Section 26.415.070.0 of the Municipal Code and other applicable Code Sections. The HPC may approve, disapprove, approve with conditions or continue the application to obtain additional information necessary to make a decision to approve or deny; and WHEREAS, Amy Guthrie, in her staff report dated January 9, 2013, performed an analysis of the application based on the standards, and found that the review standards, the "City of Aspen Historic Preservation Design Guidelines" were met, with conditions; and WHEREAS, during a duly noticed public hearing on January 9, 2013, the Historic Preservation Commission considered the application, found the application was consistent with the applicable review standards and approved the application, with conditions, by a vote of 6 to 0. NOW, THEREFORE, BE IT RESOLVED: That HPC hereby approves Minor Development for the property located at 419 E. Hyman Avenue, Unit 8 of the Paragon Building Condominiums, Block 89, City and Townsite of Aspen, Colorado, with the following conditions: 1. The skylight, raised garden, deck, hot tub, fire pit, outdoor kitchen, and snowmelt cabinet are approved as designed. HPC Resolution No. 1, Series of 2013 419 E. Hyman Avenue Page 1 of 2 2. The trellis and retractable awning do not meet the guidelines and are not approved as originally designed. An alternative retractable awning, depicted in a photo labeled Exhibit III, presented by the applicant at the HPC meeting, is approved. 3. The applicant is required to remove the 8 radiant heaters installed along the parapet within 15 days of the Council action on the height variance request. After the removal, any damage caused by the wall brackets will be repaired in a proper manner to protect the integrity of the brick.
