SUMMARY: The Applicant has requested an Insubstantial SPA Amendment and an Exemption to Stream Margin in order to construct a pump house and a restroom facility. The restroom is proposed to be centrally located in the Park and out of the Stream Margin area. The pump house is proposed to be located near the river, within the Stream Margin Area. Both are subject to an SPA Amendment, but only the pump house is subject to Stream Margin Review. The Parks Department reviewed the location and plans with City Council prior to moving forward with this land use application and the building permit. City Council reviewed and gave the Parks Department direction to move forward with the proposed location and design. The restroom building is located so as to not disturb the trail alignment, water ponds, or existing field. It will include separate men's and women's facilities connected by a breezeway. The toilets will be composting toilets. The restroom will measure 17 feet 11 inches from finished floor to the peak of the roof on the restroom facilities. The footprint is 739 square feet. The pump house is being built into the ground near the river. Essentially, only the east elevation will be seen. The structure measures 13 feet 4 inches from finished floor to the top of the parapet. The footprint is 224 square feet. STAFF EVALUATION: Staff finds that the request meets the requirements of an Insubstantial SPA Amendment and an Exemption to Stream Margin. The proposal locates the two structures to minimize impact on the park activities, while placing them in locations to serve their functions. The pump house is located to ensure gravity can assist the irrigation function. The restroom building is centrally located to serve users of the park without impacting the existing trail or field facilities. These facilities represent a minimal increase in ground coverage. Exemptions. 1. Construction of pedestrian or automobile bridges, public trails or structures for irrigation, drainage, flood control or water diversion, bank stabilization, provided plans and specifications are submitted to the City engineer demonstrating that the structure is engineered to prevent blockage of drainage channels during peak flows and the Community Development Director determines the proposed structure complies, to the extent practical, with the stream margin review standards. The proposed pump house is for irrigation purposes. It is located to enable gravity to assist in the irrigation function and has been minimized in size to the extent practical. The proposal complies, to the extent practical with the stream margin review exemption standards, including not requiring removal of trees, not adding more than 10% floor area to the site. Stafffinds the pump house meets this exemption criterion. Sec. 26.440.090.Amendment to development order. (Specially Planned Area) A. An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director. The following shall not be considered an insubstantial amendment: 1. A change in the use or character of the development. The proposal is consistent with the existing and approved character of the park. The proposed pump house and restroom are located so as to not disturb the existing trail and field junctions. The pump house is located to ensure maximum efficiency by utilizing gravity to assist with irrigation. The restroom is centrally located in the park to ensure ease of use by all park visitors. Each structure is consistent with the existing character and use of the park. Stafffinds this criterion is met. 2. An increase by greater than three percent (3%) in the overall coverage of structures on the land. The proposal will not increase the overall coverage of structures on the land by more than 3%. Stafffinds this criterion is met. 3. Any amendment that substantially increases trip generation rates of the proposed development or the demand for public facilities. The proposal will not increase trip generation. The restrooms serve existing visitors and will not draw new trips. The pump house is not open to the public and will not increase trips. Staff.finds this criterion is met. pg. 3 4. A reduction by greater than three percent (3%) of the approved open space. The proposal will not decrease the amount of open space by more than 3%. Stafffinds this criterion is met. 5. A reduction by greater than one percent (1%) of the off-street parking and loading space. The proposal does not impact off-street parking. Stafffinds this criterion is met. 6. A reduction in required pavement widths or rights-of-way for streets and easements. The proposal does not impact rights-of-ways or easements. Stafffinds this criterion is met. 7. An increase of greater than two percent (2%) in the approved gross leasable floor area of commercial buildings. The proposal has no impact on commercial leasable floor area. Staff finds this criterion is met. 8. An increase by greater than one percent (1%) in the approved residential density of the development. There are no residential units on the property. Staff finds this criterion is not applicable. 9. Any change which is inconsistent with a condition or representation of the project's original approval or which requires granting of a further variation from the project's approved use or dimensional requirements. The proposal is consistent with the previous approvals. Because of these challenges I will support a variance to our stream margin requirements. However, as a recommendation, I am still suggesting that you try everything to locate the pump house outside of the 15 foot stream margin buffer area. The program requirements of the restroom building and pump house space dictated that we had to split the building programs early this year in order to fit the restroom structure with the existing field, trail alignment, and water quality pond alignment needs. We have proposed the pump house location as submitted for the following reasons: The pump equipment we're utilizing for the park irrigation has to be lower than the intake point (to eliminate cavitation or priming issues with the pump system). The intake point will be at the bottom of Pond 5 (cleanest water), and we need to establish an 8' minimum water depth above the intake point. The regular pond elevation of Pond 5 (7865.0) very much dictates the location of the pump house. 1 The pump house footp... t has been minimized to 224 sq. fe_ -, but still needed to be sited in a location that had long term vehicular access for maintenance needs of the pump and fertigation system (future replacement). This operations requirement meant that we had to site the structure near/adjacent to one of the trails in the park. The pump system needed to be sited in a relatively central location relative to the east and west sides of the park to equalize the irrigation distribution network as much as possible. We are maximizing the basin areas for Pond 5, Pond 6 and the connecting water bodies for the Mill Street water quality goals. We don't have the ideal capacity on the west side of the park for the Mill Street system, which is why we're going to be maximizing the potential water quality benefit of Pond 6, meaning the park area west-northwest of Pond 5 will be basically utilized for water quality needs, or the re-aligned trail. The pump house is obviously a very utilitarian use/need for the park. That utilitarian/need at the park will generate a fair bit of noise when the pump system is running. The program requirements of the restroom building and pump house space dictated that we had to split the building programs early this year in order to fit the restroom structure with the existing field, trail alignment, and water quality pond alignment needs. We have proposed the pump house location as submitted for the following reasons: • The pump equipment we're utilizing for the park irrigation has to be lower than the intake point (to eliminate cavitation or priming issues with the pump system). The intake point will be at the bottom of Pond 5 (cleanest water), and we need to establish an 8' minimum water depth above the intake point. The regular pond elevation of Pond 5 (7865.0) very much dictates the location of the pump house. • The pump house footprint has been minimized to 224 sq. feet, but still needed to be sited in a location that had long term vehicular access for maintenance needs of the pump and fertigation system (future replacement). This operations requirement meant that we had to site the structure near/adjacent to one of the trails in the park. • The pump system needed to be sited in a relatively central location relative to the east and west sides of the park to equalize the irrigation distribution network as much as possible. • We are maximizing the basin areas for Pond 5, Pond 6 and the connecting water bodies for the Mill Street water quality goals. The structure has been sited within an area of the park that allows gravity to assist in the function of the irrigation pump system and allows the opportunity to build the structure into an existing slope. The 'bunker' type design allows the visual and audible impacts of the pump house building to be minimized from various perspectives. The overall footprint of the structure has been reduced to be most efficient and still meet the operational needs of the pump system. Exemptions. The Community Development Director may exempt the following types of development within the stream margin review area: 1. Construction of pedestrian or automobile bridges, public trails, or structures for irrigation, drainage, flood control or water diversion, bank stabilization, provided plans and specifications are submitted to the City engineer demonstrating that the structure is engineered to prevent blockage of drainage channels during peak flows and the Community Development Director determines the proposed structure complies, to the extent practical, with the stream margin review standards. Response: The proposed irrigation pump house structure's purpose is for housing an irrigation pump system necessary to irrigate all of the green space and playing field area within Rio Grande Park, aka 'structure for irrigation, ' as referenced above. The pump system and associated pump house structure are necessary to eliminate the use of potable water for irrigation purposes at Rio Grande Park. 3.c The development is located such that no portion of the expansion, remodeling or reconstruction will be any closer to the high water line than is the existing development; Response: The proposed restroom building is further away from the high water line than the existing nearby theatre tent structure (development). The proposed restroom building location ranges between 264' to 317' from the 100-yearflood plain/highwater line along the Roaring Fork River. 3.e The expansion, remodeling or reconstruction will cause no increase to the amount of ground coverage of structures within the 100-year fiood plain. Response: The proposed restroom building development is outside of the 100-year flood plain area and as such does not increase the base flood elevation. An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director. Response: The proposed restroom building and proposed irrigation pump house building do not change the use or character of Rio Grande Park. Irrigation of the park currently occurs with potable water and irrigation times are scheduled to minimize conflict with park use. The proposed non-potable irrigation pump system and structure will enable irrigation water to be applied more efficiently, thereby reducing the potential conflict between park irrigation and park use. Portable, temporary restroom facilities are currently present at Rio Grande Park, but are generally insufficient for the levels offacility use resultingfrom the public. 2. An increase by greater than three percent (3%) in the overall coverage of structures on the land. Response: The overall area of theparkis 563,904 squarefeet. The currentoverall coverage of structures on the park currently is 7,000 square feet (1.2% coverage area), created by the theatre tent and lobby structure. The proposed restroom and pump house buildings will add 963 square feet of structure coverage which is a 0.2% , increase in overall coverage of structures on Rio Grande Park, resulting in a total of 4 1.4% total coverage area. 3. Any amendment that substantially increases trip generation rates of the proposed development of the demand for public facilities. Response: The proposed restroom building and proposed irrigation pump house building will not substantially increase trip generation rates to Rio Grande Park. The restroom building willaddress the current need for a public restroomfacility. City o f Aspen intends to place a restroom building on property located at 460 Rio Grande Place and a pump house at 480 Rio Grande Place. The parcels upon which the restroom building and pump house will sit were acquired by the City of Aspen pursuant to three separate transactions and are now all part of the Rio Grande Park.
