A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN,
COLORADO, APPROVING CONTRACT AMENDMENT #21 BETWEEN THE
CITY OF ASPEN AND OZ ARCHITECTURE AUTHORIZING THE CITY
MANAGER TO EXECUTE SAID CONTRACT AMENDMENT #21 ON
BEHALF OF THE CITY OF ASPEN, COLORADO.
WHEREAS, there has been submitted to the City Council contract
amendment #21 between the City of Aspen and OZ Architecture, a true and
accurate copy of which is attached hereto as Exhibit "A";
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO,
That the City Council of the City of Aspen hereby approves contract
amendment #21 between the City of Aspen and OZ Architecture, a copy of which
is annexed hereto and incorporated herein, and does hereby authorize the City
Manager to execute said agreement on behalf of the City of Aspen.

The purpose of this memo is to recommend additional fee for additional civil design work performed by
Alpine Engineering who are a subconsultant to OZ Architecture.
The memo should be read in conjunction with the OZ Architecture Proposed Contract Amendment#21,
(dated April 12; 2013). This was discussed with Alpine and CoA staff on March 5, 2013.
Background
The original 2009 OZ proposal for Burlingame totaled $1,675,686, broken down as follows:

To date, the first two"base services" phases have been approved by the City Council.
The$474,670 for Construction Phase Services was initially planned for a single construction phase of all
167 units and this has been partially awarded, reflecting the phased construction approach.
Amendment 8 was accepted by City Council in April 2012 for Access and Infrastructure construction
administration (CA)for$207,211 and Amendment 20 for$315,594. The construction phase is now
anticipated to be significantly longer than the initially proposed single phase and this means that the
overall project CA phase observation fees will be"drawn out" over a longer duration, given the less
intensive building construction phases.

Given the project packaging Alpine had to do redesign work to the A/I project documents and also more
design work to the vertical civils. The fact that both A/I and vertical had some storm structures, utilities,
hardscape and grading meant than when the overall Master Drainage Report was approved, this affected
two other design packages. The design effort by Alpine is detailed in the attached, and they partially
offset this total fee with CA expenditures which weren't fully expended in January, February and March.

Budget Status
The approved 2013 budget is in good shape, and contingency is currently over 70% more than the
November 2012 budget-given we have seen savings to the construction contract and some other
smaller design contracts. Also, some of these design changes have actually reduced construction costs
(such as in AS115)which in the macro view, ultimately offsets some of this design cost.
Recommendation
RLB recommend that OZ Amendment#21 for$30,817 of additional design work is accepted. This cost
can be absorbed by the current 2013 Owners project contingency and does not require any additional
budget allocation. The project budget remains in good shape.
