I am the current homeowner of Clasen-Pejack subdivison Lot 1. I am writing this letter to
request the vacation of a 30' ingress/egress easement that runs through the western lot
line of my property.
The reason for this vacation of the easement is to add the allowable F.A.R. to my lot
which is 15,430 S.F. Currently, my floor area is 1564', I have a wife and two children
going to the elementary school and rniddle school in Aspen and we desire to increase our
living space. Originally, under the old zoning R-15 I was allowed .16 floor area to lot
ratio, apparantely for some reason we were re-zoned and lumped together with other lots
Our FAR was reduced to .13 of our Lot size. We would like to request the .16 FAR floor
to Lot ratio.
In in fact we cannot be granted the .16 ratio, the.13 ratio allows us for an additional 442
square feet that would make a big difference in our living space. Our house sits right on
Hwy 82 seperated only by a birm, it would be a great benefit to our family if we can
vacate this easement and build our allowable FAR as desired.
I would be happy to meet with a representative from the planning department if necessary
to walk through my property.

RE: Vacation of 80' Road Easernent through Lot I, Clasen-Pecjak Subdivision to
Gann Subdivision
Dear Peter & Debbie:
Last year I prepared a Zoning Review (Dated 8/19/99) for your property Lot I,
Clasen-Pecjak Subdivision. Due to an existing "80 Ft. Ingress and Egress Ease~nt"
through your property along the western lot line, you are unable to utilize the full lot
square footage for additional floor area use. Please see attached copy of deed recorded
October II, 1961, Book 195 and page 878 provided by Stewart Title Co.
In summary, your current house floor area is 1,564- s.f. (Main & upper level)
accompanied by an existing garage of 508.5 S.F. (Per Pitkin County Tax Assessor
report, 8/12/99). Under the old zoning ofR-15, your floor area ratio times the lot area
was .16. Since the Clasen-Pecjak Subdivision (four lots) were rezoned with the adjacent
larger parcels of80,000 S.F. known as the Aspen Tennis Club Sulxlivision, your floor
area ratio has been reduced to .111. Hence ,Ill (Floor Area Ratio) x 15,1-.'10 S.F. (lot area)
= 2,006 S.F. (ma.ximum allowable floor area) - 1,564- S.F. = 142 S.F. remaining. If you
did not have this existing road easement you would be able to develop this additional
142 S.F. of floor area.
The process to vacate the current road easement through your property is called
a Sulxlivision Exemption for a Major Plat Amendment (see attached). We also talked
about applying for a variance to the 77'-0" setback from Highway 82 in order to relocate
your current garage to the north, which can have up to 750 S.F. In addition you would
need to apply for a variance to add additional square footage to provide a new double-
lock entry at the west elevation, a new kitchen at the old garage area and infill at the
current north facing entry for a reconfigured master bedroom. My notes indicate that
this total additional area above your allowed maximum is approximately 14-0 S.F. You
would have to prove a hardship for this additional square feet.

I am reminded again by earlier notes that CDOT will be improving the
intersection at Highway 82, Maroon Court and the entrance to the Golf
Course/Truscott Place with turn lanes and a new signalized light in spring of 2001.
Carol Farino (your neighbor in the Tennis Club Subdivision) believes that your
neighbors' driveways to the east may be combined and go across the north side of your
property to reach this new intersection. I have not been able to confirm this '\1rith
anyone nor with current designs recently picked up at the Community Development
Department (see attached). In the meantime I am awaiting to hear from Tamara Pregl,
the planner with the County, as to the status of pursuing your application information
from last fall.
