Community Development Department
This Development Order, hereinafter "Order", is hereby issued pursuant to Section 26.304.070,
"Development Orders", and Section 26.308.010, "Vested Property Rights", of the City of Aspen
Municipal Code. This Order allows development of a site specific development plan pursuant to
the provisions of the land use approvals, described herein. The effective date of this Order shall
also be the initiation date of a three-year vested property right. The vested property right shall
expire on the day after the third anniversazy of the effective date of this Order, unless a building
permit is approved pursuant to Section 26.304.075, or unless an exemption, extension,
reinstatement, or a revocation is issued by City Council pursuant to Section 26.308.010. Afrer
Expiration of vested property rights, this Order shall remain in full force and effect, excluding
any growth management allotments granted pursuant to Section 26.470, but shall be subject to
any amendments to the Land Use Code adopted since the effective date of this Order.

Section 18: Vested Property Rights
The development approvals granted herein shall constitute asite-specific development plan
vested for a period of three (3) yeazs from the date of issuance of a development order.
No later than fourteen (14) days following final approval of all requisite reviews necessary to
obtain a development order as set forth in this ordinance, the City Clerk shall cause to be
published in a newspaper of general circulation within the jurisdictional boundaries of the
City of Aspen, a notice advising the general public of the approval of a site specific
development plan and creation of a vested property right pursuant to this Title. Such notice
shall be substantially in the following form:

Rezoning or text amendment. Whenever the official zoning district map is in
any way to be changed or amended incidental to or as part of a general revision
of this Title, or whenever the text of this Title is to be amended, whether such
revision be made by repeal of this Title and enactment of a new land use

sufficient legal description of, and the notice to and listing of names and

SUMMARY:
Coleman Brothers Construction LLC, on behalf of the property owner, is
requesting a setback variance for the height of a newly built retaining wall and
driveway that encroaches into the rear yard setback. The retaining wall exceeds
the allowance for projections of no more than thirty (30) inches above natural
grade within the required yards.

The City approved plans in 2004 for a single family residence that was in
compliance with zoning. The retaining wall was determined to be a violation at
Building Inspection.
ApPLICANT:
Michael & Ellen Brown, represented by Coleman Brothers Construction LLC and
Gillespie Law Offices.
LOCATION:
1016 East Hopkins Avenue, Lots Nand 0, Block 25, City and Townsite of Aspen,
Colorado.
ZONtNG:
R-15.
REVIEW PROCEDURE:
Variances may be approved by the City of Aspen Board of Adjustments, pursuant
to Land Use Code Section 26.314.020, utilizing Standards Applicable to
Variances, 26.314.040.
STAFF COMMENTS:
The retaining wall is above the required height as stated in the Land Use Code.
The additional height of the retaining wall did not receive approval. The Land
Use Code clearly defines the height of a retaining wall as section 26.575.040.A.5
"Uncovered porches, slabs, patios, walks, retaining walls, steps and
similar structures, which do not exceed thirty (30) inches above or below
natural grade, shall be permitted to project into the yard without
restriction. Projections may exceed thirty (30) inches below grade if
determined to be required by the chief building official for window
egress. "
It is the opinion of the Community Development Department that criteria for a
variance have not been met.
Review criteria and Staff Findings have been included as Exhibit A.
RECOMMENDA TlON:
Staff recommends the Board of Adjustments deny the variance request, for reasons
noted in the Staff Findings.
RECOMMENDED MOTION: (ALL MOTIONS WORDED IN THE AFFIRMATIVE)
"I move to approve Resolution No. 01, Series of2007, denying a rear yard
setback variance for the property located at 1016 East Hopkins A venue, finding

A RESOLUTION OF THE BOARD OF ADJUSTMENT OF THE CITY OF ASPEN,
CASE NUMBER 01-2007, APPROVING VARIANCES FOR A RET AlNING WALL
AND DRIVEWAY FOR THE PROPERTY LOCATED AT 1016 EAST HOPKINS,
LOTS NAND 0, BLOCK 25, CITY AND TOWNSITE OF ASPEN, COLORADO,
WHEREAS, Michael & Ellen Brown, represented by Coleman Brothers
Construction LLC and Gillespie Law Offices, submitted a request for a variance, dated
October 13, 2006 to the Board of Adjustment as outlined in Section 26.314.050; and
WHEREAS, this matter was heard before the Board of Adjustment on January 11,
2007 where full deliberations and consideration of the evidence and testimony was
presented.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT
OF THE CITY OF ASPEN, COLORADO:
Section 1. Findings of Fact.
The Board of Adjustment makes the following findings offact:
I. A request for the variance was initiated by: Coleman Brothers Construction
LLC, on behalf of Michael & Ellen Brown, c/o Gillespie Law Offices, 210 E.
Hyman Ave #202, Aspen, Colorado.
2. Notice of the proposed variance has been provided to surrounding property
owners in accordance with Section 26-304-060(E)(3) of the Aspen Municipal
Code. Evidence of such notice is on file with the City Clerk.
3. The grant of variance is consistent with the purposes, goals, objectives, and
policies of the Aspen Area Community Plan and Chapter 26 of the Aspen Municipal
Code.
4. The grant of variance is the minimum variance that will make possible the
reasonable use of the parcel, building or structure.
5. The literal interpretation and enforcement of the terms of Chapter 26 of the
Aspen Municipal Code would deprive the applicant of rights commonly enjoyed
by other parcels in the same zone district, and would cause the applicant
unnecessary hardship or practical difficulty. In determining that the applicant's
rights would be deprived absent a variance, the Board found that certain special
conditions and circumstances unique to the parcel, building or structure, which
are not applicable to other parcels, structures or buildings in the same zone district
exist on the subject parcel.
Section 2. Variance Approved.
The Board of Adjustment does hereby approve the applicant the following variance
from the terms of Chapter 26 of the Aspen Municipal Code by a_-_ vote:
I. A retaining wall exceeding 30 inches above natural grade as depicted in the
application.
2. A driveway access exceeding a height of 30 inches above grade within the rear
yard setback.

Accessory buildings and portion of building used solely as a garage: Five (5) feet
26.314,040 Standards applicable to variances,
A. In order to authorize a variance from the dimensional requirements of Title 26, the
appropriate decision making body shall make a finding that the following three (3)
circumstances exist:
I. The grant of variance will be generally consistent with the purposes, goals, objectives,
and policies of the Aspen Area Community Plan and this Title;
Staff Findinl!: The Aspen Area Community Plan relies on zoning regulations to maintain
the character of the built environment. The statement of "philosophy" under the Chapter,
titled "Design Quality" states: "Zoning, our primary means of shaping the built
environment, must encourage appropriate and lively design." Zoning dimensional
standards, such as setbacks, height, and size, also help to establish a pattern of
development that is appropriate for certain neighborhoods by reinforcing the public realm
and streetscape. This variance would result in the placement of a retaining wall within
the rear setback, which is only allowable to the extent that the wall does not exceed 30"
in height. Retaining walls of a greater height might be interpreted as an extension of the
building form rather than the yard area intended to be provided around structures. For
this reason, staff finds that a variance is not appropriate and this criterion is not met.
2. The grant of variance is the minimum variance that will make possible the reasonable
use of the parcel. building or structure;
Staff Findinl!: Staff finds that the "reasonable use of this parcel" can be achieved
without a variance. A retaining wall could be constructed in compliance with the
regulation.
3. Literal interpretation and enforcement of/he terms and provisions of this Title would
deprive the applicant of rights commonly enjoyed by other parcels in the same zone
district, and would cause the applicant unnecessary hardship or practical difficulty. In
determining whether an applicant's rights would be deprived, the board shall consider
whether either of the following conditions apply:
a. There are special conditions and circumstances which are unique to the parcel,
building or structure, which are not applicable to other parcels, structures or buildings
in the same zone district and which do not result from the actions of the applicant,'
Staff Findiol!: Staff finds that there are not unique features present to the parcel,
building or structure. It is the responsibility of the applicant to adhere to the approved
permit plans and follow the appropriate procedures for deviations from the plans. Staff
finds that this criterion is not met.
b, Granting the variance will not confer upon the applicant any special privilege denied
by the Aspen Area Community Plan and the terms of this Title to other parcels, buildings,
or structures, in the same zone district.
Staff Findinl!: The City has established a limit to which grade should be retained within
required 'Setbacks. This variance would allow use of the property in a manner not
permitted for others, therefore granting this variance would confer upon the applicant a
special privilege. Staff finds that this criterion is not met.

Variance Description
In order for the Brown's contractor, Coleman Brother's Construction, to obtain
proper drainage, a stone retaining wall approximately 34 to 42 inches in height and 16
feet in length was constructed along the northerly property line. In a small area
approximately 8 feet in length, the wall is approximately 6 inches taller than is permitted
outside the setback by the City of Aspen Zoning office. The issue has been discussed
with all the adjoining neighbors who find the height of the wall to be acceptable.
We hereby ask for a variance to tolerate the height of the wall outside the setback.

NOTICE IS HEREBY GIVEN that a public hearing will be held on Thursday,
December 7, 2006 at a meeting to begin at 4:00 p.m. before the Aspen Board of
Adjustment in the Council Chambers, City Hall, Aspen, Colorado, 130 South Galena
Street, Aspen, to consider an application requesting approval for variance from the
provisions of the Land Use Chapter 26, of the Municipal Code. All persons affected by
the proposed variance may appear and state their views and opinions. If you cannot

Things to do
• Post in a conspicuous location on the property. (The posters are located on the third floor of City Hall:
note that letters need to be 1 inch tall. Take a picture of the posting on the property and attach to the
affidavit.) Also, it is important to laminate the poster to prevent it from disintegrating in the weather.
Need to mail to people within 300 feet of property.
Get mailing labels from the GIS dept. 920-5453, it takes a little while to get the labels, so call them
ASAP. (Make a copy of labels before sending and attach to affidavit)
• Get affidavit with attachments notarized prior to the BOA meeting to be entered into the record.
• This needs to be complete 15 days prior to the public hearing (1217) and posting on the property
remains visible until the hearing.

I am writing regarding the application for a variance to retaining wall and driveway height at 1016
East Hopkins and to request that the application be denied.
I live at the Riverview Condominiums, 1020 E. Hopkins, Apt. #1. This building of the complex is
directly behind the house at 1016 E. Hopkins, and my unit is on the ground floor most
immediately behind the house. My bedroom window directly faces the referenced driveway and
retaining wall which is on the property line, and therefore quite close to my building and window.
Before this house went up there was a small house on the lot. When the property sold and it
became evident that a large house was going up on it, 1 was concerned about its size and its
impact on quality of life in that it would block light and space, leading to a much more closed in
feeling. tt would also add to density, noise, and traffic. I was told by various officials at the
building department that as long as it was to code there was nothing that could be done. I tried to
verify that the house was within code limits (especially height and setbacks) and was told that it
was. The house is built all the way to the setbacks and does appear quite large in scale. The
wall and driveway only add to the massive appearance of the property, and its impact on my unit.
1 am also impacted by car lights shining into my bedroom window at night It has been known for
some time that the driveway and wall height exceeded code. The variance is being requested
after the fact.
Further, the application notes that all neighbors had been consulted in this matter and did not
object. In fact, I had not been contacted in any manner about this at all by either the owner or his
representative, and was not aware of the application until receipt of the public notice.
I feel strongly that code should not be allowed to be exceeded, and that the variance should not
be granted.
