TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held
in the BASEMENT MEETING ROOM, City Hall, Aspen, Colorado, (or at such other place as the
meeting may be then adjourned) to consider an application filed with the said Board of Adjustment
requesting authority for variance from the provisions of the Zoning Ordinance, Chapter 26, Official
Code of Aspen. All persons affected by the proposed variance are invited to appear and state their
views, protests or objections. If you cannot appear personally at such meeting, you are urged to state
your views by letter, particularly if you have objection to such variance, as the Board of Adjustment
will give serious consideration to the opinions of surrounding property owners and others affected in
deciding whether to grant or deny the request for variance.

SUMMARY:
W odehouse and Augello Builders, on behalf of the property owner, are requesting
a setback variance for a newly built garage that encroaches into the rear yard
setback. The garage, including the stone veneer, sits two inches (2") into the five
foot (5') rear yard setback required for a garage within the R-6 Zone District, per
section 26.710.040 (0)(5).
The City approved plans in 2004 (permit 0138.2004.ARBK) for a single family
residence- the garage with a stone veneer was illustrated behind the rear setback
line.
Subsequent to approval by the BOA, the applicant would be required to apply and
gain approval for an Encroachment License through the City Engineer.
ApPLICANT:
Wodehouse-Augello Builders, representing the property owner Kirshon Family
L TO, 307 L ABC, Aspen Colorado.
LOCATION:
105 East Hopkins Avenue, Lots A and B, Block 68, City and Townsite of Aspen,
Colorado.
ZONING:
R-6.
REVIEW PROCEDURE:
Variances may be approved by the City of Aspen Board of Adjustments, pursuant
to Land Use Code Section 26.314.020, utilizing Standards Applicable to
Variances, 26.314.040.
STAFF COMMENTS:
The encroachment into the alley setback did not receive approval. The Land Use
Code clearly defines a setback as[26.1 04.1 00]:
"An area commencing and extending horizontally and vertically from a lot
line, property line, or other boundary which shall be unoccupied and

unobstructed from the ground upward, excepting trees, vegetation, and/or
fences, or other structures or projections as allowed." (i.e. building eaves
and architectural projections)
The Community Development Department does not interpret a stone veneer as
either a building eave or an architectural projectioni.Furthermore, granting a
variance for unapproved construction after completion is not con~istent with the
purposes, goals, objectives and policies of the Aspen Area Community Plan.
Review criteria and Staff Findings have been includcd as Exhibit A.
RECOMMENDATION:
Staff recommends the Board of Adjustments deny the variance request, for reasons
noted in the Staff Findings.
RECOMMENDED MOTION: (ALL MOTIONS WORDED IN THE AFFIRMATIVE)
"I move to approve Resolution No. _' Series of2006, denying a rear yard
setback variance of 2 inches for the property located at 105 East Hopkins Avenue,
finding that the review criteria for the application have been not met."

26.314.040 Standards applicable to variances.
A. In order to authorize a variance from the dimensional requirements of Title 26, the
appropriate decision making body shall make a finding that the followjng three (3)
circumstances exist:
1. The grant of variance will be generally consistent with the purposes, goals, objectives,
and policies of the Aspen Area Community Plan and this Title;
Staff Findinl!: The Aspen Area Community Plan relies on zoning regulations to maintain
the character of the built environment. The statement of "philosophy" under the Chapter,
titled "Design Quality" states: "Zoning, our primary means of shaping the built
environment, must encourage appropriate and lively design." Zoning dimensional
standards, such as setbacks, height, and size, also help to establish a pattern of
development that is appropriate for certain neighborhoods by reinforcing the public realm
and streetscape. This variance would result in the small portion of a garage within the
rear setback. Alleyways are inherent to the dynamic character of Aspen; therefore staff
finds the proposal is not consistent with the purposes, goals, objectives, and policies of
the Aspen Area Community Plan. Staff finds that this circumstance [26.314.040(1)] does
not exist.
2. The grant of variance is the minimum variance that will make possible the reasonable
use of the parcel, building or structure;
Staff Findinl!: Staff finds that the "reasonable use of this parcel" can be achieved
without a variance. Bringing the garage into compliance will not impact the ability to
utilize the garage as a legal parking space; however, the applicant is requesting the
minimum variance to bring the parcel into compliance.
3. Literal interpretation and enforcement of the terms and provisions of this Title would
deprive the applicant of rights commonly enjoyed by other parcels in the same zone
district, and would cause the applicant unnecessary hardship or practical difficulty. In
determining whether an applicant's rights would be deprived, the board shall consider
whether either of the following conditions apply:

a. There are special conditions and circumstances which are unique to the parcel,
building or structure, which are not applicable to other parcels, structures or buildings
in the same zone district and which do not result from the actions of the applicant;
Staff Findinl!: Staff finds that there are not unique features present to the parcel,
building or structure. It is the responsibility of the applicant to adhere to the approved
permit plans and follow the appropriate procedures for deviations from the plans. Staff
finds that this circumstance [26.314.040(3)a] does not exist.
b. Granting the variance will not confer upon the applicant any special privilege denied
by the Aspen Area Community Plan and the terms of this Title to other parcels, buildings,
or structures, in the same zone district.
Staff Findinl!: Rear yard setback variances were not granted during the review process.
Construction must be built according to permits approved by staff. Granting this variance
would confer Ilpon the applicant a special privilege. Staff finds that this circumstance
[26.314.040(3)b] does not exist.

Dear Sara,
The explanation of the variance requested for the above referenced address is detailed in the
following paragraphs;
Wodehouse Augello Builders is requesting a variance be granted at 105 East Hopkins to allow
the existing stone veneer columns on each side of the garage remain as constructed. This 2"
discrepancy came up when we completed the improvement survey in October 2006. At no time
did Wodehouse Augello Builders intend to set the columns 2" over the setback line.
W odehouse Augello Builders feels that the improvements provided at the parcel are consistent
with the goals and objectives of the Aspen Area Community Plan and that it is a major
improvement from the original condition of the lot, thus benefiting the City of Aspen. The
variance would not provide any additional hardship to the surrounding structures or public.
The requested impact is the minimum variance required to make possible the reasonable use of
the building. Granting this variance will not provide any special privilege to the property that
other parcels or building in the same district share.

Variance request for allowing stone veneer on two columns on sides of garage door to
encroach two inches into 5 foot setback between the garage and the alley.
The columns are 20" wide by 11 feet high. There is a driveway apron and a wood fence
and a box from Holy Cross electric of approximately 6 feet square by 6 feet high that
occupy this setback area to the property line which nullifY any possible impact visually or
practically from this stone veneer.
