TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will
be held in the BASEMENT MEETING ROOM, City Hall, Aspen, Colorado, (or at such
other place as the meeting may be then adjourned) to consider an application filed with the
said Board of Adjustment requesting authority for variance from the provisions of the
Zoning Ordinance, Chapter 26, Official Code of Aspen. All persons affected by the
proposed variance are invited to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, you are urged to state your views by letter,
particularly if you have objection to such variance, as the Board of Adjustment will give
serious consideration to the opinions of surrounding property owners and others affected in

MEMORANDUM

SUMMARY:
Theodore and Isabella Dalenson, owners of the property at 637 W. North Street
Unit A, are requesting a setback variance for an extant building that encroaches
into the rear yard setback. The building currently sits approximately 14 or 15
inches into the alleyway, and the applicant is requesting a variance of 18 inches
from the five foot rear yard setback required for an accessory building within the
R-6 Zone District, per section 26.710.040 (D)(5).
The city approved permit plans for the new construction on the property, which
did not illustrate an encroachment into the rear yard setback. The applicant
assumes responsibility for the mistake and legal proof is provided that the
encroachment was an unintentional error by the surveyor.
Subsequent to approval by the BOA, the applicant would be required to apply and
gain approval for an Encroachment License through the City Engineer.

REVIEW PROCEDURE:
Variances may be approved by the City of Aspen Board of Adjustments, pursuant to
Land Use Code Section 26.314.020, utilizing Standards Applicable to Variances,

STAFF COMMENTS:
The encroachment into the alley did not receive approval. Granting a variance for
unapproved construction after completion is not consistent with the purposes, goals,
objectives and policies of the Aspen Area Community Plan.

26.314.040 Standards applicable to variances.
A. In order to authorize a variance from the dimensional requirements of Title 26, the
appropriate decision making body shall make a finding that the following three (3)

I. The grant of variance will be generally consistent with the purposes, goals, objectives,
and policies of the Aspen Area Community Plan and this Title;
Staff Findinl!:: The Aspen Area Community Plan relies on zoning regulations to maintain
the character of the built environment. The statement of "philosophy" under the Chapter,
titled "Design Quality" states: "Zoning, our primary means of shaping the built
envITonment, must encourage appropriate and lively design." Zoning dimensional
standards, such as setbacks, height, and size, also help to establish a pattern of
development that is appropriate for certain neighborhoods by reinforcing the public realm
and streetscape. This variance would result in the portion of a garage within the rear
setback. Alleyways are inherent to the dynamic character of Aspen; therefore staff fmds
the proposal is not consistent with the purposes, goals, objectives, and policies of the
Aspen Area Community Plan. Stafffmds that this circumstance [26.314.040(1)] does not
exist.
2. The grant of variance is the minimum variance that will make possible the reasonable
use of the parcel, building or structure;
Staff Findinl!:: Staff fmds that the "reasonable use of this parcel" can be achieved
without a variance. Bringing the garage into compliance will not impact the ability to
utilize the garage as a legal parking space
3. Literal interpretation and enforcement of the terms and provisions of this Title would
deprive the applicant of rights commonly enjoyed by other parcels in the same zone
district, and would cause the applicant unnecessary hardship or practical difficulty. In
determining whether an applicant's rights would be deprived, the board shall consider
whether either of the following conditions apply:

Dear Board Members,
My husband and I live directly behind the Dalenson's on Smuggler
Street and share the alley with them. We reviewed the variance request
with them and their architect Scott Lindenau of Studio B Architects and
have no grievance towards what they are requesting.
In fact, before the project was constructed, there was an unsightly utility
pole that served both their property and ours that was located partially
in the alley. With the construction of this project, it was relocated further
down the alley away from sight and has made the alleyway safer and
less obstructed.
They have managed to preserve many trees on the site and the minor
encroachment into the alley setback does not in any way negatively
impact services in the alley, snow plowing nor our property.

Dear Todd:
Please consider this letter an application pursuant to S 26.314.050(A), City of
Aspen Municipal Code, for a variance for an encroachment of approximately 14 or 15
inches into the five-foot alley setback for an existing garage for the property described as
Unit A, Nove I Duplex Condominiums (the "Property"), according to the plat thereof
recorded in Plat Book 76 at Page 71 as Reception No. 518384 ofthe Pitkin County
Records (the "Plat").
Our office represents and is authorized to file this application on behalf of
Theodore and Isabella Dalenson ("Owners"). The address and telephone number for the
Owners are care of me at this office. The physical address for the Property is 637 W.
North St., Aspen, CO; and the Parcel No. for the Property is 2735112116002. For your
reference, a copy of the first and second pages of the Plat are attached which show the
variance requested. I have not included the other pages of the Plat which relate to the
other condominium unit and elevations and are not relevant for purposes ofthis variance
application.
I am an attorney licensed in Colorado and authorized to give opinions as to
property ownership. The Owners own the Property and it is not subject to any
encumbrances, except for a Declaration of Condominium and the rights and obligations
described therein. The Vicinity Map and other mapping requirements for this application
are shown on the attached pages of the Plat.
The Property was developed by Nove I, LLC, a Colorado limited liability
company. Scott Lindenau is the Manager of Nove 1. Attached is an Affidavit signed by
Scott, in which he indicates that the encroachment was an unintentional error. The
developer hired a surveyor to mark the setback prior to construction and used good faith

efforts to locate the garage outside of the five-foot setback. The developer became aware
of the error for the first time when a different surveyor prepared the Condominium Map
for the Property.
The request for a variance satisfies the criteria of S 26.314.040A, City Code.
I. The grant of variance will be generally consistent with the purposes, goals,
objectives, and policies of the Aspen Area Community Plan and the Code;
2. The grant of variance is the minimum variance that will make possible the
reasonable use of the structure; and
3. Literal interpretation and enforcement of the terms and provisions ofthe Code
would deprive the Owners of rights commonly enjoyed by other parcels in the same zone
district, and would cause the applicant unnecessary hardship or practical difficulty.
Based on scaling the distance of the encroachment on the Plat, I believe the
encroachment is 14 or 15 inches into the setback. In order to be safe, we respectfully request
that the Board of Adjustment grant a setback variance of 18 inches from the five-foot alley
setback at the Property in accordance with S 26.314.050D of the Code.
I will obtain mailing labels from the City GIS department for all owners within 300
feet of the Parcels. As soon as you provide a copy of the public notice, we will make sure it
is mailed. Also, enclosed is a check in the amount of $258.00 as the filing fee. Please let me
know if you need any additional information.

1. I am the Manager of Nove I, LLC, a Colorado limited liability company.
2. Nove I, LLC built the residence known as Unit A, Nove I Duplex
Condominiums (the "House"), including all aspects of the construction thereof.
3. Prior to construction of the House, Nove I, LLC hired a surveyor licensed
in Colorado to mark all boundaries and setbacks for construction.
4. After construction of the House on the property, Nove I, LLC hired a
different surveyor licensed in Colorado to prepare a Condominium Map for the property.
At that time and for the first time, Nove I, LLC was informed and discovered that the
garage of the House encroaches approximately 14 or 15 inches into the five-foot alley
setback. Construction of the garage in the setback was not intentional.
