Before the City of Aspen Board of Adjustment
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the
BASEMENT MEETING ROOM, City Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority
for variance from the provisions of the Zoning Ordinance, Chapter 26, Official Code of Aspen. All persons
affected by the proposed variance are invited to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, you are urged to state your views by letter, particularly if you
have objection to such variance, as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to grant or deny the request for
variance.

A RESOLUTION OF THE BOARD OF ADJUSTMENT OF THE CITY OF ASPEN
DENYING AN EXTENSION OF A VARIANCE IN CASE NUMBER 02-01 RELATING
TO PROPERTY IN THE CITY OF ASPEN WITH A STREET ADDRESS OF 701 WEST
FRANCIS AND A LEGAL DESCRIPTION OF BLOCK 16, LOTS H AND I, ASPEN,
COLORADO
WHEREAS, Robert Ritchie made application
for the extension of a variance granted by the Board of Adjustment
December 7, 2000, Case #00-10; and
WHEREAS, this matter came on for hearing before the Board of
Adjustment on January 3, 2002 and after full deliberations and
consideration of the evidence and testimony presented.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF
THE CITY OF ASPEN, COLORADO:
Section 1. Findings of Fact.
The Board of Adjustment makes the following findings of
fact:
1. The request for the extension was initiated on December
3, 2001 by: Robert Ritchie for property located at 701 West
Francis, Aspen, Colorado.
2. Notice of the proposed variance has been provided to
surrounding property owners in accordance with Section 26-
304-060(E) (3) of the Aspen Municipal Code. Evidence of such
notice is on file with the City Clerk.
The Board determined that findings were not satisfied and the
variance request was therefore denied by a vote of 4-1.

Section 2. Request for Variances Denied.
The Board of Adjustment does hereby deny an extension of the
following variance from the terms of Chapter 26 of the Aspen
Municipal Code:
A twelve (12) month extension of a variance
granted on December 7, 2000, for a six (6) foot
side yard setback variance for the east side yard,
a nine (9) foot combined side yard setback
variance, and a five (5) foot front yard setback
variance to modify the existing roof.

SUMMARYIBACKGROUND: The applicant was granted a six (6) foot side yard
setback variance for the east side yard, a nine (9) foot combined side yard setback variance,
and a five (5) foot front yard setback variance to modify the existing roof on December 7,
2000. This variance fUns for a one (1) year period and expired December 7, 2001. The
applicant submitted a request for an extension prior to the expiration date and is
requesting an additional one (1) year period for the variance approval.

REVIEW STANDARDS AND STAFF EVALUATION: Pursuant to Section
263 14.080 of the Municipal Code, the standard for an extension is as follows:
All requests must demonstrate good cause showing that an extension is necessary,
and must demonstrate that the circumstances as set forth in this Chapter are still
applicable.
ALTERNATIVES: The Board of Adjustment may consider any of the following
alternatives:
. Approve the extension of the variance granted.
. Table action to request further information be provided by the applicant or interested
parties,
. Deny the extension finding the criteria has not been met.
RECOMMENDED MOTION: "I move to approve an extension for the following: a six
(6) foot side yard setback variance for the east side yard, a nine (9) foot combined side yard
setback variance, and a five (5) foot front yard setback variance to modify the existing roof,
for a period of twelve (12) months finding that the review standards have been met."

To Whom It May Concern:
We are writing to request an extension of the variance granted to Robert Ritchie for the
residence at 701 West Francis Street, legally described as Lots H & I, Block 16, original
Aspen Town site. The variance allows the homeowner to update his roof design. Due to
the severe economic downturn, Mr. Ritchie asked us to postpone his project. Please call
if you have any questions and let us know if we need to appear before the board.
