DESCRlBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the
BASEMENT MEETING ROOM, City Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority
for variance from the provisions of the Zoning Ordinance, Chapter 26, Official Code of Aspen. All persons
affected by the proposed variance are invited to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, you are urged to state your views by letter, particularly if you
have objection to such variance, as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to grant or deny the request for
vanance.

A RESOLUTION OF THE BOARD OF ADJUSTMENT OF THE CITY OF ASPEN
GRANTING A VARIANCE WITH CONDITIONS IN CASE NUMBER 01-01 RELATING
TO A PROPERTY IN THE CITY OF ASPEN WITH AN ADDRESS OF 1540
SILVERKING DRIVE, ASPEN, COLORADO.
WHEREAS, James Knowlton made application, dated January 29,
2001 to the Board of Adjustment for a variance from the
dimensional requirements of Chapter 26 of the Aspen Municipal
Code; and
WHEREAS, this matter came for hearing before the Board of
Adjustment on March 8, 2001, where full deliberations and
consideration of the evidence and testimony was presented.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF
THE CITY OF ASPEN, COLORADO:
Section 1. Findings of Fact.
The Board of Adjustment makes the following findings of
fact:
1. The request for appeal was initiated by: Don James
Knowl ton on January 29, 2001 for property with a street
address of 1540 Silverking Drive, Aspen, Colorado.
2. Notice of the proposed variance has been provided to
the appellant and by publication to all other affected
parties in accordance with Section 26-304-060 (E) (3) of the
Aspen Municipal Code. Evidence of such notice is on file with
the City Clerk.

The grant of variance will be generally consistent with
purposes, goals, objectives, and policies of the Aspen
Community Plan and Chapter 26 of the Aspen Municipal
4. The grant of the variance is the minimum variance that
will make possible the reasonable use of the parcel, building
or structure.
5. The literal interpretation and enforcement of the terms
of Chapter 26 of the Aspen Municipal Code would deprive the
applicant of rights commonly enjoyed by other parcels in the
same zone district, and would cause the applicant unnecessary
hardship or practical difficulty. In determining the that
applicant's rights would be deprived absent a variance, the
Board considered certain special conditions and circumstances
which are unique to the parcel, building or structure, which
are not applicable to other parcels, structures or buildings
in the same zone district and which do not result from
actions of the applicant.
Section 2. Request for Variances Approved.
The Board of Adjustment does hereby grant the applicant
the following variance form the terms of Chapter 26 of the
Aspen Municipal Code by a 5 to 0 vote:
A ten (1) foot side yard setback variance on the east
side yard and a seven (7) foot, four (4) inch below
natural grade required yard projection variance for the
construction of a six (6) foot tall retaining wall,

1,249.38 square feet less because of the steep slope,
To recognize the impact of steep slopes for building size and not to recognize it for
driveways appears inconsistent,
. Avariance for driveways on lots with steep slopes is supported by the grade and
configuration of the driveways of neighbors who are similarly situated, A list of our
neighbors and the grade of their driveways are listed below. Pictures of the driveways
are attached.

approving the design of the driveway or the approval was based on a mistaken

For instances, if the lot were flat, the requirement of a 25 foot front yard set back would
pose no problem when it comes time to build a driveway according to Sec. 16, 16,06O(h).
However, when compliance with the 25 foot front yard set back requires a building to be
built higher up on a hill side, then there should be flexibility in allowing the driveway to
reach the house.
Similarly, the requirement of Sec. 26.410.040 C 2, (b) that a garage be 10 feet "further

allow access to a garage that is required by Code to be located up a hillside with a grade

Each duplex has a driveway, which supports the independence of each unit, A suggestion
for a single driveway serving both units would compromise the visual aesthetics of the

David Schott, Jim Iglehart, Howard DeLuca, Mark Hesselschwerdt and Rick Head

Case 01-01- Jamie Knowlton -1540 Silverkinl! Drive - Variance
Charles Paterson, Chairman, opened the public hearing for Case #01-0 I, Paterson
explained that the property was located at 1540 Silverking Drive, The variances
requested were a five foot (5') east side yard setback variance and a six foot (6')
variance from the thirty inch (30") excavation requirement in the setback per section
26,575,040(A) (5) for the construction of a retaining wall, James Lindt stated that the
variance request was for an already built retaining wall. Lindt said that there were 2
standards, which needed to be met; one of which was that the retaining wall could not
be 30 inches below grade within the setback and the other was that a retaining wall
could not be located in the setback.
Lindt stated that variance review standards were not met because staff believed that
the applicant created their own hardship in that they could have built the retaining
wall where the existing patio was located rather than going into the setback. The
applicant built the maximum FAR on the property,
Jamie Knowlton stated that he felt that they complied with the variance being a
hardship, He said that it was a typical site to build a duplex on and their contractor
said that for safety the wall should be built. Knowlton stated that it was a very small
part of the whole lot. Knowlton said that there was a neighbor, Bert Fingerhut, who
provided a letter in favor ofthe variance (in the packet). Knowlton said that the wall
was not visible from any place, Paterson asked if Mr. Knowlton could elaborate on a
situation of practical difficulty when he was building the wall; something that was
present at this site that was not present at other sites in the neighborhood, Knowlton
replied that there were site constraints that he regarded as a hardship,

Discussions included the side yard setback having better fire access now and that the
neighbors do not mind the variance request. The question was asked ifthe applicant
created the hardship, The board agreed that this was a minimum variance request.

STAFF RECOMMENDATION: Staff recommends denial ofthe variance request

REVIEW STANDARDS AND STAFF EVALUATION: Pursuant to Section
26.314.040 of the Municipal Code, in order to authorize a variance from the dimensional
requirements of Title 26, the Board of Adjustment shall make a finding that the following
three (3) circumstances exist:
1. Standard: The grant of the variance will be generally consistent with the
purposes. goals, objectives, and policies of the Aspen Area Community Plan and
this title,
Response: The Aspen Area Community Plan does not specifically address
this parcel. however it does allow for residential development in this area of
the City.
2. Standard: The granting of the variance is the minimum variance that will make
possible the reasonable use of the parcel, building, or structure.
Response: The applicant is requesting the minimum variance possible to
keep an already built retaining wall. Since the retaining wall was built to
prevent rock fall for the safety of the residence and the inhabitants of the
residence. the reasonable use of this parcel as a residence is enhanced by
keeping the retaining wall.
3. Standard: Literal interpretation and enforcement of the terms and provisions of
this title would deprive the applicant of rights commonly enjoyed by other parcels
in the same zone district. and would cause the applicant unnecessary hardship or
practical difficulty. In determining whether an applicant's right would be
deprived, the board shall consider whether either of the following conditions
apply:
a. There are special conditions and circumstances which are unique to the parcel.
building or structure, which are not applicable to other parcels. structures or
buildings in the same zone district and which do not result from the actions of the
applicant; or
b. Granting the variance will not confer upon the applicant any special privilege
denied by the Aspen Area Community Plan the terms of this title to other
parcels, buildings or structures, in the same zone district,
Response: 1540 Silverking Drive abuts Red Butte to the north. Red Butte
provides an unstable obstacle in regards to excavating and grading the build
able lots directly south of the butte. However, staff feels that applicant's
excavation has created the special circumstances which have led to the
hardship. Because staff feels that the applicant has created the unnecessary
hardship, staff cannot support the setback variance for the retaining wall.
Staff feels that the existing retaining wall can be removed and replaced
within the required side yard setback of ten (10) feet,
AL TERNA TIVES: The Board of Adjustment may consider any of the following
alternatives:
. Approve the variance as requested,
. Approve the variance with conditions.
. Table action to request further information be provided by the applicant or interested
parties,
. Deny the variance finding that the review standards are not met.

VARIANCE REQUEST FOR 1530 SILVERKlNG DRIVE
Owner requests a variance to allow below grade structural support within a side yard set
back. There are no structures from the natural grade up. There is no yard.
The structural support is noted as a planter on the Improvements Survey attached to this
application. Also attached is a letter from the building contractor, Trautner-Long Inc.,
stating the reason for the structural support is safety.
The special condition and circumstances necessitating a variance is the steep grade of the
parcel (approximately 32%) and a talus slope. Please refer to cross-section of the
property accompanying the improvements survey.
The most effective and least intrusive measures for ensuring the safety of the building
and its inhabitants is the construction of a tiered 6 foot high curvilinear walls, 7-4 feet
below the 32 percent natural grade of the lot for a distance of approximately 13 feet
(8%) of the total length of the lot which is 146.72 feet long.
The variance does not increase the allowable floor area, height or other dimensional
requirements of the R-15 Zoning. Granting the requested variance extends no special
privileges.
Strict enforcement of the 5 foot set back requirement presents a hardship that is
unnecessary and one that can be easily and practically avoided thereby preserving the
right of peaceful enjoyment of the parcel.
Granting the variance is consistent with the purposes, goals, objectives and policies of the
Aspen Area Community Plan ("AACP"). Design Quality is one feature of the updated
AACP. A statement in the "Philosophy" of Design Quality applies to our variance in
that it supports design flexibility in order to the cope with the natura! terrain, in this case,
a steep grade and talus slope. The pertinent language is found at page 43 of the updated
AACP:
"We wish to encourage creativity that results in design solutions that are
fresh and innovative, yet are net additions to the built environment by
being contextually appropriate and harmonious without being copies of
that which already exists."
A tiered curvilinear wall is contextually appropriate because it provides a creative
solution to the problem of additional support for a steep grade and protection of the talus
slope. It makes possible the reasonable use of the existing structure.

VARIANCE REQUEST FOR 1530 SILVERKING DRIVE
Owner requests a variance to allow below grade structural support within a side yard set
back. There are no structures from the natural grade up. There is no yard.
The structural support is noted as a planter on the Improvements Survey attached to this
application. Also attached is a letter from the building contractor, Trautner-Long Inc.,
stating the reason for the structural support is safety.
The special condition and circumstances necessitating a variance is the steep grade of the
parcel (approximately 32%) and a talus slope. Please refer to cross-section of the
property accompanying the improvements survey.
The most effective and least intrusive measures for ensuring the safety of the building
and its inhabitants is the construction of a tiered 6 foot high curvilinear walls, 7-4 feet
below the 32 percent natural grade of the lot for a distance of approximately 13 feet
(8%) of the total length of the lot which is 146.72 feet long.
The variance does not increase the allowable floor area., height or other dimensional
requirements of the R-15 Zoning. Granting the requested variance extends no special
privileges.
Strict enforcement of the 5 foot set back requirement presents a hardship that is
unnecessary and one that can be easily and practically avoided thereby preserving the
right of peaceful enjoyment of the parcel.
Granting the variance is consistent with the purposes, goals, objectives and policies of the
Aspen Area Community Plan ("AACP"), Design Quality is one feature of the updated
AACP. A statement in the "Philosophy" of Design Quality applies to our variance in
that it supports design flexibility in order to the cope with the natural terrain, in this case,
a steep grade and talus slope. The pertinent language is found at page 43 of the updated
AACP:
"We wish to encourage creativity that results in design solutions that are
fresh and innovative, yet are net additions to the built environment by
being contextually appropriate and harmonious without being copies of
that which already exists"
A tiered curvilinear wall is contextually appropriate because it provides a creative
solution to the problem of additional support for a steep grade and protection of the talus
slope. It makes possible the reasonable use of the existing structure.

Dear Jamie and Gwyn,
The retaining wall to the east of 'Side B' was constructed because when the base of the
talus slope was exposed during excavation it was realized that it presented a safety issue.
It was necessary to temporarily retain it with soil nailing during construction for the
safety of the workers on the project. After construction the permanent wall was
necessary to protect the house and occupants from the unstable rocks above.
