We believe there is no valid reason for another Board to re-hear this same request again so soon. It rnay be il1approprtalc for the Board of A<ljustment to over rule the prior decision. Since we are not able to be in Aspen to make another presentalion in person for this second public hearing, we have asked Paul Taddune, Esq. to represent u. and we ask that the followine; sl:ltement be read to the Board: This applicant proposes to build a new home with an ADD underground on this very small lot of 3 000 square fecI. The proposed variance would allow the Ownel' to bring the house forward towards Third Street b)' 5 reel, and closer to the north side alley by 5 feet. The city is considering the alley to be the rC3! yard in this case. The ~ull of this requested varilUlC8 will be to ~t enough room at the west side of the home, in the back nearest our bedrooms, to allow stacked unenclosed parking of 3 - 4 vehicles at grade level. The variance would maximize use of the property, not minimize it's use, and could result in more house with less open space on the site An open carport and open outside parking would allow the building of more enclosed floor area for the homc; thus a larger home with more square footage could be built than would be allowed with enclosed parking. With enclosed parking, the house would have a more reasonable ratio to its lot size and not impact the neighbors as much. The applicant has demonstrated no viable proof of need or hardship nor ,!,,-'Cial OOlIditions or circumstances, and the variance should not be aranted. Wc arc the owners ofth" house immediately to the west of this property and fear that the result of the Board grantill$ of this variance will be the creation of an unenclosed parking area just 8 fuet from our bedrooms and 3 feet from the property line, without any additiona1 buffering provided by the applicant. We oppose this parking arrangement because of the noise and fumes that would result. We do not feel it is appropriate to , ,,~~cc a parking area of this size so close to a neighbor's home. An unenclosed parkill$ lot for up to 4 vehicles is just that _ a parking lot. This is not appropriate in Aspen's historic West End premiere residential neighborhood. Granting such a variance would create a special privilege for excess parking and development for the applicant. The home's parking area has been in front of the home accessed from Third Street. The city is now against vehicle parking in the front of the home for aesthetic considerations, but they are willing to support a variance, which would expand and move the vehicle parking behind the house, shifting all the negative impacts to adversely affect the next-door neigllbors. We believe this is unjust! We purchased our home in tho West End anticipating a high quality of life and protection by the city from negative developments. This open parking area as proposed is not in our best interests We believe that the parking lot would lower our property's value and create an ongo~ nuisance. Nowhcre in Aspen's West End are other new homes built with unenclosed multi-car parking areas adjacent to ncighbors' bedroom windows. This would not be proper and would set a bad precedent. The mwer can certainly find another dcsign alternative that will provide parking that is not offensive to their neighbor. We arc adamantly opposed to this variance. We oppose lot line to lot line development. Setbacks are required for the betterment of neighborhoods and should not we waived just to provide parking or more house area for the convince of the applicant. The trees on the site are within the setback area and would be protected without the variance. Page l(a), Variance Description and Justification Cont'. According to the current zoning regulations, the required setbacks for a 3000 s.f. lot in the R6 zone district are as follows: Side Yard: Combined Side Yard: 5 ft. 10 ft. Front Yard: Rear Yard: Combined FrontlRear Yard: 10 ft. 10 ft. (principal buildings) & 5 ft. (accessory buildings) 25 ft. Adhering to these required setbacks will force the proposed residence to be built in the upper left corner of the property and, if built in this location, the proposed residence will be in conflict with, and contradict, the goals and objectives of the Aspen Area Community Plan and Residential Design Standards. Consequently, in order to alleviate and resolve the existing contradictory setback requirements, the applicant is proposing the following setbacks: (See Attachment A & B) Side Yard: 5 ft. Combined Side Yard: 10 ft. Front Yard: 10 ft. Rear Yard: 5 ft. Combined FrontlRear Yard: 15 ft. As Attachment B clearly illustrates, the granting of these two proposed variances will allow this property to comply more fully with the Residential Design Standards, and do so in two significant ways. First, it will allow the applicant to move their parking from the front, where it is now in conflict with the current zoning, to the rear, where it will be in compliance. As the code states, "For all residential uses, parking, garages, and carports shall be accessed from an alley or private road if one exists." Second, it will allow the proposed residence to satisfy and comply with the city's desire to create a consistent "facade line" and requirement to "Build to Lines." as brought forth in Section 26.58.040 of the Residential Design Standards. In short, the applicant's variance request is simple, clear and to the point, and we look forward to your affirmative vote to help us in our efforts to not only satisfy, but comply with the city's Residential Design Standards. - '-" '. Applicant's Responses to Criteria for Variances 26.314.030 Authorized Variances Variances may only be granted from the following requirements of this Title 26: A. Dimensional requirements. B. Permitted uses, but only to allow for the temporary off-site location or storage of materials, structures or equipment pursuant to building construction or construction staging. Response: The applicant is requesting a variance from "A" Dimensional requirements. 26.314.040 Standards Applicable to Variances 1. Standard: The grant of variance will be generally consistent with the purposes, goals, objectives and policies of the Aspen Area Community Plan and this Title. Response: The applicant's variance request is consistent with the AACP and this Title. The applicant's property has inherent and contradictory setback requirements as set forth in the Residential Design Standards. The applicant's proposed variance request will resolve this conflict. (See Attachment A & B). 2. Standard: The granting of the variance is the minimum variance that will make possible the reasonable use of the parcel, building or structure. Response: The applicant's property has an allowable FAR of 2400 s.f. The applicant is proposing a small house with an above grade FAR of 2176 s.f. Granting this variance will allow the applicant to make reasonable use of their allowable FAR as well as provide the (3) required parking spaces. The applicant is also providing a basement ADD. 3. Standard: Literal interpretation and enforcement of the terms and provisions of this title would deprive the applicant of rights commonly enjoyed by other parcels in the same zone district, and would cause the applicant unnecessary hardship or practical difficulty. In determining whether an applicant's right would be deprived, the board shall consider whether either of the following conditions apply: a. There are special conditions and circumstances which are unique to the parcel, building or structures, which are not applicable to other parcels, structures or buildings in the same zone district and which do not result from the actions of the applicant; or Response: The applicant's parcel is very unique. The special conditions and circumstances are inherent with the property and not a result of any actions on the owner's part. In particular, the lot is 50' wide by 60' deep and, per zoning, the front and rear setbacks are perpendicular to each other and not opposite each other as they would be normally. This setback issue creates practical difficulty with the applicant's ability to comply with the city's Residential Design Standards. l"'^' \,....r , Page 2, Applicant's Responses to Criteria for Variances, Cont.' b. Granting the variance will not confer upon the applicant any special privilege denied by the Aspen Area Comprehensive Plan, the terms of this title to other parcels, buildings or structures, in the same zone district. Response: Due to the unique dimensional conditions and setback requirements of this parcel, the applicant is requesting these variances to more fully comply with the AACP and Title 26, and not for any convenience on their part. Granting the two variances will insure compliance with the Residential Design Standards and not confer upon the applicant any special privilege denied to any other parcel in the same zone district. The intent of these design standards is to encourage resi- dential buildings that address the street in a manner which creates a consistent "facade line" and defines the public and semi-public realms.
