Pursuan1 to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the
BASEMENT MEETING ROOM, City Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority
for variance from the provisions of the Zoning Ordinance, Chapter 26, Official Code of Aspen. All persons

Enclosed please find the notice for variance requests for 935 E. Hopkins. Please check to
make sure the variance requests are. A copy of the notice must be mailed to each
. property owner within 300' of the property at least 10 days prior to the pubiic hearing. A
sign must be posted on the property for at least 10 days prior to the hearing as well.
Please retain a copy of the mailing labels and affix to the affidavit of notice that waS'
enclosed with your packet. The case will not be heard without a completed affidavit.
The hearing is scheduled for Thursday, August 10,2(700. There are several items other

SUMMARY: The applicant requests a variance from the required height limit of 25 feet
in order to construct four dormers and extend the lofts that exist on all four units on the
top floor. The property is located in the R-MF zone district. The height of the existing
structure is 26 feet, as measured to the mid-point of the roof, and from the finished grade
of the walk out basements, as the code requires. The ridge height is 29 'l2' feet. The
applicant is requesting a I-foot height variance in order to conform with the height of the
existing structure. The proposed building plans are in conformance with FAR
requirements and with setback requirements.
If a variance is granted, the applicant would be able to add the dormers, despite being
over the allowable height limit, due to the City Land Use Code definition of height. The
code current states height is ",he maximum possible distance, as established by the
underlying zone district, from the natural grade or finished grade, whichever is lower, at
the exterior perimeter of a building '0 ,he highest point or struc'ure within a vertical
plane." Therefore, if the applicant jogs back the addition from the exterior fayade it is
no longer on the vertical plane from the exterior perimeter.
Please refer to the attached drawings and written information provided by the applicant
for a complete presentation of the proposed variance. Staff can provide a more thorough
explanation of how height is measured at the meeting to clarify any questions the Board
may have.

LOCATION:
935 East Hopkins
REVIEW STANDARDS AND STAFF EVALUATION: Pursuant to Section
26.314.040 of the Municipal Code, in order to authorize a variance from the dimensional
requirements of Title 26, the Board of Adjustment shall make a finding that the following
three (3) circumstances exist:
1. Standard: The grant of the variance will be generally consistent with the
purposes, goals, objectives, and policies of the Aspen Area Comprehensive Plan
and this title.
Response: Although not addressed in the Aspen Area Comprehensive Plan,
the Land Use Code stipulates at 25 foot height limit in all residential
neighborhoods, and the non-conformity sections states that non-conforming
structures shall not be expanded or enlarged.
2. Standard: The grant of the variance is the minimum variance that will make
possible the reasonable use of the parcel, building, or structure.
Response: There is already reasonable use of the parcel with twelve existing
condominiums. Floor area could be added to other areas of the building
without needing a variance.
3. Standard: Literal interpretation and enforcement of the terms and provisions of
this title would deprive the applicant of rights commonly enjoyed by other parcels
in the same zone district, and would cause the applicant unnecessary hardship or
practical difficulty. In determining whether an applicant's right would be
deprived, the board shall consider whether either of the following conditions
apply:
a. There are special conditions and circumstances which are unique to the parcel,
building or structure, which are not applicable to other parcels, structures or
buildings in the same zone district and which do not result from the actions of the
applicant; or
b. Granting the variance will not confer upon the applicant any special privilege
denied by the Aspen Area Comprehensive Plan the terms of this title to other
parcels, buildings or structures, in the same zone district.
Response: Staff feels that no hardship exists. As stated above, there is an
existing building with twelve units. The fact that the building was designed
so that dormers and lofts could not be extended on the top floor is not a
hardship on the land or a special condition. Other buildings in the
neighborhood are either non-conforming, and cannot expand, or have had to
comply with the 25 foot height regulation.
ALTERNATIVES: The Board of Adjustment may consider any of the following
alternatives:
. Approve the variance as requested.
. Approve the variance with conditions.
. Table action to request further information be provided by the applicant or interested
parties.
. Deny the variance finding that the review standards are not met.
RECOMMENDATION: Staff recommends denial of the one-foot height variance
request.
RECOMMENDED MOTION: "r move to deny the request for a one height variance to
allow for construction of four dormers at 935 East Hopkins Avenue, finding that the
review standards are not met."

A RESOLUTION OF THE BOARD OF ADJUSTMENT OF THE CITY OF ASPEN
DENYING VARIANCES IN CASE NUMBER 00-09 RELATING TO PROPERTY IN THE
CITY OF ASPEN WITH A STREET ADDRESS OF 935 EAST HOPKINS AND A
LEGAL DESCRIPTION OF LOTS G, H & I, BLOCK 32, ORIGINAL ASPEN
TOWNSITE
WHEREAS, Gavilon Condominium Association made application,
dated July 12, 2000 for a variance from the dimensional
requirements of Chapter 26 of the Aspen Municipal Code; and
WHEREAS, this matter came on for hearing before the Board of
Adjustment on August 10, 2000, and after full deliberations and
consideration of the evidence and testimony presented.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF
THE CITY OF ASPEN, COLORADO:
Section 1. Findings of Fact.
The Board of Adjustment makes the following findings of
fact:
1. The request for variances was initiated on July 12, 2000
by: Gavilon Condominium Association for a property located at
935 East Hopkins, Aspen, Colorado.
2. Notice of the proposed variance has been provided to
surrounding property owners in accordance with Section 26-
304-060(E) (3) of the Aspen Municipal Code. Evidence of such
notice is on file with the City Clerk.
3. The grant of variance will be generally consistent
the purposes, goals, objectives, and policies of the
Aspen Area Comprehensive Plan and Chapter 24 of the
Aspen Municipal Code.

4. The grant of variance is the minimum variance that
will make possible the reasonable use of the parcel,
building or structure.
5. The literal interpretation and enforcement of the
terms of Chapter 26 of the Aspen Municipal Code
would deprive the applicant of rights commonly enjoyed
by other parcels in the same zone district, and would
cause the applicant unnecessary hardship or practical
difficulty. In determining that the applicant's rights
would be deprived absent a variance, the Board
considered certain special conditions and circum-
stances which are unique to the parcel, building or
structure, which are not applicable to other parcels,
structures or buildings in the same zone district and
which do not result from the actions of the applicant.
The Board determined that findings #3, #4 and #5 above were
not satisfied and the variance request was therefore denied
by a vote of _ _
Section 2. Request for Variances Denied.
The Board of Adjustment does hereby deny the applicant an
extension of the following variance from the terms of Chapter 26
of the Aspen Municipal Code:
A one (1) foot height variance for the entire
building to construct two (2) dormers on the north
side and two (2) dormers on the south side of the
building.
