Before the City of Aspen Board of Adjustment
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the
BASEMENT MEETING ROOM, City Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority
for variance from the provisions of the Zoning Ordinance, Chapter 26, Official Code of Aspen. All persons
affected by the proposed variance are invited to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, you are urged to state your views by letter, particularly if you
have objection to such variance, as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to grant or deny the request for
vanance.

Dear Bill:
Tom Reagan is requesting a variance regarding grade change of
greater than 30" with in a rear yard setback. This variance will
allow the driveway to descent from the adjacent alley to a
partially exposed lower level garage. The driveway will be
approximately 30" lower than the alley at the garage and have a
slope of 9% at the steepest point. The lowest elevation of the
driveway is more than 30" below natural grade.
The house is designed with an entry level including the garage,
that is mostly below natural grade and an upper level that is at
natural grade. This allows the house to have less exposed mass,
maintain established grade levels for a prominent corner lot, and
to be well under the allowable height for this site. The location
of the garage on the alley is the most desirable for safety,
neighborhood continuity and visual impact from major streets.
If we were to raise the building so we would be in compliance
with the 30" requirements the result would be a higher building
with more of its mass exposed resulting in an undesirable
impact on the neighborhood.

We are requesting a variance to allow the grade of the proposed driveway to be more than
30" below natural grade within the rear yard setback. The current design locates the
garage facing the alley and is partially above natural grade. The driveway descends from
elevation 98' at the alley to its lowest elevation of 95'-6" at the garage. This grade is less
than a 30" drop in grade and the driveway will have approximately a 9% slope. At the
lowest point, the grade is however approximately 7.5' below the natural grade. The
current design of the driveway will be the only portion of the project to be exposed below
natural grade more than 30" and this will allow for less visual exposure of the garage and
the height of the main ridge of the house to be only 23' above natural grade. Without the
ability to locate the driveway as proposed, our alternative is to raise the building
approximately 5'. This will expose more of the garage, as well as the entire building mass
and negatively impact the neighborhood.

The applicant is requesting a greater than 30 inch below natural grade variance for a slab
for a driveway in the rear yard setback. The board has had numerous request for similar
variances. This portion of the code has not changed. Without the variance, the applicant
has the option of raising the building in order to be in compliance.. Staff would prefer that
this not happen. The topography of this lot causes creates a hardship and staff supports
this variance.

Dear Mr. Drueding:

I received a notice stating that there is a Variance Request for a project at 101 Park Avenue. I own the
entire duplex residences at 126 Park Avenue and over the last nine yeaNi of my owneNihip have had an
active interest in what happens in our neighborhood.
Upon receipt of the Variance Request, [ called Gibson and Reno Architects L.L.c. to gain more
information about the issue. After speaking with them about the 30" grade within setbacks issue and its
impact upon current design, I wish to express my opinion to the Board of Adjustments. It is my opinion
that the current proposed design, which has a lower ridge height than is allowed by guidelines, has less of
an impact on the neighborhood and surrounding views. Specifically, by lowering the overall height of the
building, such action preserves my vision of the Shadow Mountain to Silver Queen areas of Ajax
Mountain for both me and my neighboNi to the NE of the proposed project.
If they are required to raise the building approximately 5' to be in compliance with the proposed driveway,
the neighborhood will be needlessly negatively impacted.
I support their Variance Request as stated and discussed with me, and hope that the Board of Adjustments
will grant this Variance.
