SUMMARY: The applicant requests a variance from the floor area dimensional
requirement in order to enclose an existing patio with glass windows for privacy
and safety purposes. The enclosure would add approximately 250 square feet
of floor area. The property is located in the L T/R zoning category and is
currently at the maximum allowed FAR. The exact variance required may be
amended due to calculation of subgrade area in the property.
Please refer to the attached drawings and written information provided by the
applicant for a complete presentation of the proposed variance.

REVIEW STANDARDS AND STAFF EVALUATION: Pursuant to Section
26.108.040 of the Municipal Code, in order to authorize a variance from the
dimensional requirements of Title 26, the board of adjustment shall make a
finding that the following three (3) circumstances exist:
1. Standard: The grant of the variance will be generally consistent with the
purposes, goals, objectives, and policies of the Aspen Area
Comprehensive Plan and this title.
Response: Floor area ratio (FAR) is a function used to control the
size and bulk of a building and the maximum limits allowed are
determined by the code. This building is currently at its maximum
FAR and adding additional floor area would cause this building to
become a non-conforming structure in regards to FAR. Staff
generally opposes any FAR variance that increases the size or bulk
of a building. In addition, Ordinance 30 has encouraged creation of
open deck, porch and patio areas.

2. Standard: The grant of the variance is the minimum variance that will
make possible the reasonable use of the parcel, building, or structure.
Response: Staff concludes that a variance granting an increase in
FAR is not the minimum action required in order to address the
issue. Fencing and gating the patio would achieve the same goal,
yet would not increase the FAR of the structure.
3. Standard: Literal interpretation and enforcement of the terms and
provisions of this title would deprive the applicant of rights commonly
enjoyed by other parcels in the same zone district, and would cause the
applicant unnecessary hardship or practical difficulty. In determining
whether an applicant's right would be deprived, the board shall consider
whether either of the following conditions apply:
a. There are special conditions and circumstances which are unique to
the parcel, building or structure, which are not applicable to other parcels,
structures or buildings in the same zone district and which do not result
from the actions of the applicant; or
b. Granting the variance will not confer upon the applicant any special
privilege denied by the Aspen Area Comprehensive Plan the terms of this
title to other parcels, buildings or structures, in the same zone district.
Response: Since there are other options available to the applicant,
in particular, placement of a fence around the patio, staff concludes
that enforcement of the FAR guidelines would not cause the
applicant unnecessary hardship. Although the current owners are
requesting to enclose the area simply for safety purposes, any future
owners may elect to use the space for living quarters. Therefore,
staff concludes that granting the FAR variance allows for future
development, which is not in compliance with the intent of the
current code and would confer special privileges upon the applicant.
ALTERNATIVES: The Board of Adjustment may consider any of the following
alternatives:
. Approve the variance as requested.
. Approve the variance with conditions.

. Table action to request further information be provided by the applicant or
interested parties.
. Deny the variance finding that the review standards are not met.
RECOMMENDATION: Staff recommends that the request for a FAR
variance be denied.
RECOMMENDED MOTION: "I move to deny the request for a FAR variance for
616 S. Galena Street finding that the three review standards are not met."

FAR is a function used to control size and bulk of a building. Maximum limits are set by
code. This building is currently at its maximum FAR. Staff opposes any FAR variance
that increases the size or bulk of a building feeling that any deficiencies with the design
should have been taken into account at the design stage. This building is less than ten
years old. An FAR variance would cause a this building to become a non-conforming
structure in regards to FAR.
My husband and I own ~ condo located next to th& ,ippler. We have had an
on-going problem with people using our patio to continue partying late at
night.
The condos are built in such a way that people come onto the patio and are
partially hidden making it very dangerous when residents some home late at
night. Some of the people I've encountered have been very nice when asked
to leave, others have not been so nice. Some have left the complex,
others have just gone over to another patio to continue partying.
I bought patio furniture for this area, but removed it because uninvited
people we~e using it.
We were having problems with uninvited people using our jacuzzi, so I
emptied the jacuzzi two years ago.
We have left the lights on, we've kept the lights off, we've installed a
light with a motion sensor, none of these tactics have resolved the
problem.
We have had numerous heterosexual couples and a homosexual couple making
out on the patio. Needless to say, this has been extremely embarrassing.
Fortunately, my children have not yet been exposed to such, but I feel
that is only a matter of time unless something is done to close off the
subject area.
In December I removed beer bottles and glasses early one morning from
the patio. Since no one had stayed at the condo the night before, this
was obviously left by someone who was not supposed to be using the patio.
A week and a half later our neighbors were burglarized through their rear
door next to the jacuzzi. They had left the door unlocked, but no one
would have known the door was unlocked unless they were hanging out on the
patio area, as that door is hidden from the street. A copy of the police
report is attached.
I've since been informed someone defecated on their patio next to the
jacuzzi a month or so ago. (Human not animal).
I firmly believe sooner or later someone is going to get hurt...either a
resident or one of the intruders. I've spoken at length to representatives
from our insurance companies discussing our liability in this. As I
understand it, if someone gets hurt, we can be held liable, even though we
are trying to do everything within our powers to prevent this.
The builder can't be held liable. I'm sure they didn't realize when they
built the condos that these problems would exist.
The police can.t do anything, Tippler can.t do anything to prevent this.
They can be held liable if they serve someone too much to drink, but there
is no indication that is the problem.
It appears our only choice is to request an FAR variance.
The proposed would conform aesthetically with the rest of the building.
It would not change the appearance of the building. It would eliminate the
problem and give us the security and protection we need.
I realize it is best if all the condos look alike, and I m sure this can
be accomplished because we are all affected by this problem, we are all
concerned about our safety and liability in this.

On 01-01-96 at 18:30 I met with CV/ Mervyn Mandelbaum, DOB 08-22-42, at
his residence at 618 S Galena. Mandelbaum wanted to report the theft of
four jackets out of his residence and explained the following:
At about 01:00 some of the residents were using the hot tub located on
the patio on the south side of the home, when they came in they entered
the home through the south door which they failed to lock. Mandelbaum
found it closed but unlocked this morning.
On the first floor of the home at the east end of the hallway is a
coatrack where the four stolen coats were hanging. At about 05: 00
another resident came home and hung his coat on this same coat rack,
his coat was not stolen.
Mandelbaum believes that someone entered the residence through this
south door and stole the jackets between 01: 00 and 05: 00, he stated
that there were people at home at the time including he and his wife
but they did not hear anything suspicious.
I then spoke to another resident of the home, Jody. She informed me
that at about 03:00 she was walking along Galena Street northbound away
from the residence. She stated that there were two hispanic males
standing in the driveway of The Tippler who were making comments to her
in spanish and following her down the sidewalk. The two then stopped
and turned around, walking southbound towards her residence. Jody did
not know if these were the people who walked into her residence or not,
and could only give a vague description:

DIMENSIONS:
THE PROPOSED FRAMEWORK WITH WINDOW PANES WOULD BE 96" HIGH AND 98" WIDE,
EXTENDING FROM WALL TO WALL, AND FLOOR TO CEILING.
JUSTIFICATION FOR VARIANCE:
WE HAVE HAD AN ON-GOING PROBLEM WITH PEOPLE COMING ONTO OUR PATIO,
ESPECIALLY LATE AT NIGHT. IT APPEARS THEY ARE COMING FROM THE TIPPLER
NIGHTCLUB WHICH IS NEXT TO OUR TOWNEHOUSE.
I CONTACTED THE POLICE DEPART~jENT A COUPLE YEARS AGO REGARDING THE MATTER.
THEY AGREED TO KEEP AN EYE OPEN, BUT EXPLAINED THERE REALLY WASN'T MUCH
THEY COULD DO ABOUT PREVENTING THE PROBLEM.
OUR INSURANCE COMPANY INFORMED US WE COULD BE HELD LIABLE IF SOMEONE IS
HURT ON OUR PROPERTY, EVEN THOUGH THEY ARE NOT OUR GUESTS. SO WE EMPTIED
THE HOT TUB, WHICH ELIMINATED THE USE OF THE TUB, BUT DID NOT RESOLVE THE
PROBLEM, AS PEOPLE CONTINUE COMING INTO THE PATIO AREA.
WE HAVE HAD NUMEROUS HETEROSEXUAL COUPLES AND A HOMOSEXUAL COUPLE MAKING
OUT ON THE PATIO. ON ONE OCCASION I RETURNED HOME LATE AT NIGHT TO
DISCOVER TWO MEN MAKING OUT HEAVILY ON THE PATIO.. .THEY WERE ONLY
PARTIALLY DRESSED. THIS IS NOT SOMETHING I SHOULD HAVE TO CONTEND WITH OR
HAVE MY CHILDREN EXPOSED TO. FORTUNATELY, MY CHILDREN WERE NOT WITH ME AT
THR TIME.
IT IS UNFORTUNATE THE BUILDERS OF THE TOWNEHOUSE DID NOT FORESEE THIS
PROBLEM, OR THAT THE NIGHTCLUB IS SO CLOSE TO US.
SO AS NOT TO RUIN THE APPEARANCE OF THE CONDO, WE PROPOSE THE INSTALLATION
OF WINDOWS EXACTLY MATCHING THE WINDOWS ON THE OTHER SIDE OF THE ENTRY
DOOR. THE SUBJECT AREA IS PARTIALLY BELOW GROUND LEVEL SO THE LIGHT IS
DESPERATELY NEEDED. IT APPEARS THE INSTALLATION OF WINDOWS IS THE ONLY
WAY TO ELIMINATE THE PROBLEM OF UNWANTED GUESTS AND STILL ALLOW THE MUCH
NEEDED LIGHT AND OPEN FEELING.
WE DON'T WANT TO DESTROY THE LOOK OF OUR PATIO AREA, BUT WE DON'T WANT TO
CONTINUE BEING DENIED OUR. PRIVACY AND PEACE OF MIND. WE FEEL THE

FAR is a function used to control size and bulk of a building. Maximum limits are set by
code. This building is currently at its maximum FAR. Staff opposes any FAR variance
that increases the size or bulk of a building feeling that any deficiencies with the design
should have been taken into account at the design stage. This building is less than ten
years old. An FAR variance would cause a this building to become a non-conforrning
structure in regards to FAR.

The condos are built in such a way that people come onto the patio and are
partially hidden making it very dangerous when residents some home late at
night. Some of the people I've encountered have been very nice when asked
to leave, others have not been so nice. Some have left the comple><,
others have just gone over to another patio to continue partying.
I bought patio furniture for this area, but ,"emoved it because uninvited
people were using it.
We were having problems with uninvited people using our jacuzzi, so I
emptied the jacuzzi two years ago.
We have left the lights on, we've kept the lights off, we've installed a
light with a motion sensor, none of these tactics have resolved the
problem.
We have had numerous heterose><ual couples and a homose><ual couple making
out on the patio. Needless to say, this,has been e><tremely embarrassing.
Fortunately, my children have not yet been exposed to such, but I feel
that is only a matter of time unless something is done to close off the
subject area.
In December I removed-beer bottles and glasses early one morning from
the patio. Since no one had stayed at the condo the night before, this
was obviously left by someone who was not supposed to be using the patio.
A week and a half later our neighbors were burglarized through their rear
door ne><t to the jacuzzi. They had left the door unlocked, but no one
would have known the door was' unlocked unless they were hanging out on the
patio area, as that door is hidden from the street. A copy of the police
report is attached.
I've since been informed someone defecated on their patio ne><t to the
jacuzzi a month or so ago. (Human not animal).
I firmly believe sooner or later someone is going to get hurt...either a
resident or one of the intruders. I've spoken at length to representatives
from our insurance companies discussing our liability in this. As I
under-stand it, if someone gets hurt., we can be held liable, even though we
are trying to do everything within our powers to prevent this.
The builder can.t be held liable. I'm sure they didn't realize when they
built the condos that these problems would e><ist.
The police can.t do anything, Tippler can.t do anything to prevent this.
They can be held liable if they serve someone too much to drink, but there
is no indication that is the problem.
It appears our only choice is to request an FAR variance.
The proposed would conform aesthetically with the rest of the building.
It would not change the appearance of the building. It would eliminate the
problem and give us the security and protection we need.
I realize it is best if all the condos look alike, and I'm sure this can
be accomplished because we are all affected by this problem, we are all
concerned about our safety and liability in this.

On 01-01-96 at 18:30 I met with CV/ Mervyn Mandelbaum, DOB 08-22-42, at
his residence at 618 S Galena. Mandelbaum wanted to report the theft of
four jackets out of his residence and explained the following:
At about 01:00 some of the residents were using the hot tub located on
the patio on the south side of the home, when they came in they entered
the home through the south door which they failed to lock. Mandelbaum
found it closed but unlocked this morning.
On the first floor of the home at the east end of the hallway is a
coatrack where the four stolen coats were hanging. At about 05: 00
another resident came home and hung his coat on this same coat rack,
his coat was not stolen.
Mandelbaum believes that someone entered the residence, through this
south door and stole the jackets between 01: 00 and 05: 00, he stated,
that there were people at home at the time including he and his wife
but they did not hear anything suspicious.
I then spoke to another resident of the home, Jody. She informed me
that at about 03:00 she was walking along Galena Street northbound away
from the residence. She stated that there were two hispanic males
standing in the driveway of The Tippler who were making comments to her
in spanish and following her down the sidewalk. The two then stopped
and turned around, I walking southbound towards her residence. Jody did
not know if these.'were the people who walked into her residence or not,
and could onlylgive a vague description:
