TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the
BASEMENT MEETING ROOM, City Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority
for variance from the provisions of the Zoning Ordinance, Chapter 26, Official Code of Aspen. All persons
affected by the proposed variance are invited to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, you are urged to state your views by letter, particularly if you
have objection to such variance, as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to grant or deny the request for
vanance.

Staff feels that setbacks are an important part of the zoning code. Staff further feels that
this building already stretches from side to side on the street scape and further intrusion
into the setback with more bulk is undesirable. Light may be achieved by use of flat
skylights or larger windows in the existing structure.

Dear Bill,
Pursuant to our conversation on Thursday, March 21, regarding the above mentioned Variance
Request this letter is hereby amending the variance request application for a total combined side
yard setback from 15' to 14'.
A copy of our memorandum, dated March 1 8, summarizing this request is attached and a copy has
been forwarded to the Oty Clerks office for inclusion in our submittal package to the Zoning Board
of Adjustments. Please call me if there are any questions regarding this request.

The proposed request for Variance for the above noted property includes and is limited to two
dormers (one south facing, one north facing) and a ridge line extension. (Reference Architectural
Drawings included). The ridge shall be extended 10', the total length of the North and South
Dormers shall be 1 7'.
The proposed alteration is setback 14'- 0" from the West property line and does not encroach into
the minimum 10' side yard setback. The total combined side yard setback does not meet the
minimum 30' requirement for the 8,994 SF, R-6 zoned site.
This variance is requested for the following reasons:
1. The intent of this alteration is to allow natural light into this structure. It is currently
lit by a small, north facing window blocked by large pine trees.
2. The portion of the existing structure where the alteration is proposed, is entirely
within the required 30' total side yard setback, therefore making any alterations
impossible without a variance.
3. Both the East and West portions of the existing building on the lot contain non-
conforming structures within side yard setbacks; 5.5 ft. on the West and 0 ft. on the
East.
In summary, we request a 14' combined side yard required setback.

CONCERNING: Unit A, Dennis Ratner, Variance for setback/dormer
As the owner Of Unit B , the duplex legally described as West Francis Street
Condominiums, I support Dennis Ratner's application for a variance to construct a
dormer. I have taught in the Aspen Public Schools since 1968, resided at this
residence since 1968. and owned half the property described as West Francis
Condominiums since the middle 19705. My support Is a function of the economics of
raising a family on a teacher's salary In a community such as Aspen. Economic
impacts recently have been significant. A 50% increase in property tax this year,
exclusIOn from employee housing by the Aspen School District as I own this property
In Pitkin County. increases in every utility, while school salaries have remained
basically constant for the past decade, have placed our family In significant economic
difficulty. By selling part of our duplex to Mr. Ratner, we will have a generous reduction
in our mortgage Dayment which will place us in an economic situation that is
acceptable. ObviOUSly, this will be beneficial to our family and will permit us a much
better chance of remaining in Aspen as a part of the community where I teach, my wife
works, and my three boys attend school.
For selfish but needed economic relief our family needs this opportunity, Please
consider Dennis Ratner's aDDlicatiOn as something more to our community than a
dormer. Thank you for your consideratiOn.
