A RESOLUTION OF THE BOARD OF ADJUSTMENT OF THE CITY OF ASPEN
GRANTING A VARIANCE WITH CONDITIO~S IN CASE NUMBER 95-11
RELATING TO PROPERTY IN THE CI~ OF ASPEN WITH AN ADDRESS OF
119 East Cooper Avenue, ASPEN,COLORADO.
WHEREAS, Winfield Arms Condominium Association throuqh
counsel, Douqlas Allen, has made application, dated
September 8, 1995 to the Board of Adjustment for a variance
from the dimensional requirements of Chapter 24 of the
Aspen Municipal Code; and
WHEREAS, this matter came on for hearing before the
Board of Adjustment on this date and after full deliberations
and consideration of the evidence and testimony presented.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
ADJUSTMENT OF THE CITY OF ASPEN, COLORADO:

Section 1. Findings of Fact.
The Board of Adjustment makes the following findings of
fact:
1. A development application for a variance was initiated
by: Winfield Arms Condominium Association throuqh
counsel, Law Offices of Douqlas Allen
on: September 8, 1995
for property
with a street address of: 119 East Cooper Avenue
and
legal description of: Block 70, Lots D, E, F and G
Oriqinal Aspen Townsite, Aspen, Colorado.
2. Notice of the proposed variance has been provided to
surrounding property. owners in accordance with
Section 24-6-205(E) (4)b) of the Aspen Municipal Code.
Evidence of such notice is appended hereto as
Exhibit "A" (posting of notice) and Exhibit "B"

Aspen A:rea Comprehensive Plan aIfd. Chapte:r 24 of the
Aspen Municipal Code.
4. The grant of variance is the minimnm va:riance that
w:U.l. make possible the reasonabl.e use of the parcel,
building or structure.
5. The literal interpretation and en:forcement of the
terms of Chapter 24 of the Aspen Mmrl.cipal Code
would deprive the applicant of rights commonly enjoyed
by other parcels in the same zone district. and would
cause the applicant unnecessary ha:rdship or practical
difficulty. In determining that the app1icant's rights
would be deprived absent a variance, the Board
considered certain speciaL conditions and circum-
stances which a:re unique to the parcel. building or
stJ:ucture, which a:re- not applicab1.e to ot.her pa:rce1.s,
structures or bllilri-;~s in the same zone district and
which do not: re's-ult from. t.he acti.ons of the app~i.cant;

Section 2. Variance Granted.
The Board of Adjustment does hereby grant the applicant the
following variace from. ilie terms of Chapter 24 of the Aspen
Municipal Code:
A FAR va:riance of 102. square feet to build a bikeshed.

1:he variance granted by Section 2, above, is specifically
conditioned upon and subj,ect to the following conditions:

1.
Unless vested as part of a development plan pursuant to
Section 24-6-207 of the Aspen Municipal Code, the
variance granted herein shall automatically expire after
twel~e (12) months from the date of approval unless
development has been cnmmpnced as evidencE',d by the
issuance of a bui1ding permit, or an extension granted
by the Board in which case the variance shall expire at
the end of the extension.
2. Applicant shall, prior to filing an application for a
building permit, cause to be recorded with the Clerk
and Recorder's Office of Pitkin County a copy of this
resolution.

TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the SECOND FLOOR MEETING
ROOM, City Hall, Aspen, Colorado, (or at such other place as the
meeting may be then adjourned) to consider an application filed
with the said Board of Adjustment requesting authority for variance
fro~ the provisions of the Zoning Ordinance, Chapter 24, Official

The purpose of this Application is to request a variance to construct an enclosed, secured
bicycle storage shed to be attached to the building known as the Winfield Arms located at 119
East Cooper Avenue, Aspen, Colorado, which will add approximately 102 square feet of FAR
to the existing improvements. The shed is to be constructed in an area currently occupied by
a moveable metal bicycle rack. The metal bicycle rack currently in use is not fully utilized, in
part because tenants of the building are unable to adequately secure their bicycles against theft,
which is a growing problem in the City of Aspen. The ability of the tenants to have a secure
place to store their bicycles will act as an incentive for bicycle use and a disincentive for
automobile use, which will result in a positive environmental impact. The Winfield Arms
building consists of 26 units, the majority of which are 300 square feet in floor area, more or
less. This means that potentially 26 tenants can become bicycle users and not automobile users.
The shed, as designed, will be 12 feet by 8 feet 6 inches with a pitched roof of 10 feet
in height where the shed attaches to the existing improvements to a height of 7 feet on the outer
wall. The shed structure will hold 24 bicycles, suspended from hooks. The structure will not
encroach into the 5-foot setback, is not visible from the Cooper Avenue side of the building and
will not occupy a space greater than the area of ground upon which the existing bicycle rack and
bicycles currently occupy. The shed will be constructed of materials consistent with the existing
improvements on the property and will enhance and improve the appearance of the bicycle
storage area.
The Winfield Arms building was in place on the property long before bicycle travel
became popular. A secured bicycle storage area will allow the tenants to take full advantage of
bicycle transportation over automobile transportation, thereby reducing the automobile congestion
in the area.
Since this bicycle shed will have only positive visual effect and positive effect on to the
environment due to the reduction of automobile traffic, and will not use a space greater than that
currently being used for unsecured bicycle storage, the Board is asked to approve the variance
for this bicycle storage shed.
