BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the SECOND FLOOR MEETING
ROOM, City Hall, Aspen, Colorado, (or at such other place as the
meeting may be then adjourned) to consider an application filed
with the said Board of Adjustment requesting authority for variance
from the provisions of the Zoning Ordinance, Chapter 24, Official
Code of Aspen. All persons affected by the proposed variance are
invited to appear and state their views, protests or objections.
If you cannot appear personally at such meeting, you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

Re: L'Auberge Application for Variance
Dear Mr. Chairman:
Please consider this letter an Application for Setback Variances as set forth below. This application
and site plan (showing existing and proposed cabins) are submitted as a part of the L'Auberge Historical
Preservation Committee (HPC) approval.
Proposed Variances.
Minimum variances are requested to permit compliance with HPC requirements as follows:
As shown on the attached site plan an eight (8) foot front yard setback variance is
being requested for Cabins 12, 15, 17 and 19. A five (5) foot front yard setback is being
sought for Cabins 11 and 18. A five (5) foot rear yard setback variance is being sought for
Cabin 21. A thirteen (13) foot rear yard setback variance is being sought for the recycle and
trash facilities behind Cabin 7. Setback variances between buildings are requested as shown
on the site plan which vary but are three (3) feet in the closest area. The setbacks in the
District are as follows: front - ten (10) feet; rear - fifteen (15) feet; side - six and seven
tenths (6.7) feet (corner lot setback) and between buildings - ten (10) feet.
The Historical Preservation Committee (HPC) has requested the applicant to promote a unique village
concept, to continue the existing historic set backs on the property which are located inside today's setback
requirements, and to maintain a central open space on the property. The HPC has forwarded to you its
recommendations and reasons for supporting the variance. Due to the uniqueness of this property and desire
to maintain small individual cabins, (a use not contemplated by the office zone setback requirements) a
variance between the buildings is also required. The Planning and Zoning Commission has also approved the
village concept as presented to you.

The above variances requested are not contrary to the public interest, are owing to special
circumstances and the unique conditions of the property, and the literal enforcement of setback regulations
would result in a practical difficulty and unnecessary hardship. In 1959, a variance was granted by the Board
of Adjustment for the front yard setback (see Plat of Perkins Subdivision, Plat Book 10, Page 25, copy
enclosed) supporting the conformance of these historical cabins.
Pursuant to Aspen Code 10-104 (c), in determining whether the applicant's rights would be deprived,
the Board should consider either of the following:
1. This grant of variances is the minimum variance that will make possible the
reasonable use of the parcel inasmuch as these special conditions improved by the HPC are
not applicable to other parcels, structures or buildings in the same zone district and do not
result from the actions of the applicant; or
2. Granting the variance will not confer upon the applicant any special privilege
denied by the Aspen Area Comprehensive plan and the terms of the chapter to other parcels,
buildings or structures in the same zone district.
