TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the SECOND FLOOR MEETING
ROOM, City Hall, Aspen, Colorado, (or at such other place as the
meeting may be then adjourned) to consider an application filed
with the said Board of Adjustment requesting authority for variance
from the provisions of the Zoning Ordinance, Chapter 24, Official
Code of Aspen. All persons affected by the proposed variance are
invited to appear and state their views, protests or objections.
If you cannot appear personally at such meeting, you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

The applicants, Mr. and Mrs. Guy Saussus request that a
setback variance be granted on the above mentioned property,
an existing two story single family residence, to allow a
new attached one-car garage to be constructed along the
northerly side of the house as shown on the attached
drawings labeled Exhibit A.
~plicable Standards
"A. The grant of variance will be generally consistent with
the purposes, goals, objectives, and policies of the
Aspen Area Comprehensive Plan and this Chapter,"
This application meets this standard.
"B. The grant of variance is the ml.nl.Inum variance that will
make possible the reasonable use of the parcel,
building or structure."
This application requests a six-food front yard setback
variance for approximately 31.5 square feet of the
proposed 326 square foot garage to encroach into the 25
foot front yard setback space. This lot is in the R-15
Zone District and the building envelope meets the
zone's front setback requirements. The Black B~rch
Estate Subdivision side and rear setbacks are 15 feet
along the south side, 50 feet along the northerly side
and 75 feet along the rear (east). The Black Birch
Estates Architectural Control Committee has granted
approval for the proposed garage addition. (See
attached Letter of Approval dated May 16, 1994 labeled
Exhibit B).
Their approval was granted after consideration of
impacts to the adjacent properties regarding location,
height, topography and practicality of use. The
proposed structure will be a one story, flat roofed
garage that will be approximately 8 feet above existing
grade, with materials and detailing to match the
existing structure. The location of the proposed
garage was determined by the least impacts possible to
grades, existing utility locations and view planes from
surrounding properties.

Also attached is a letter from the Black Birch Estates
Homeowners labeled Exhibit C dated August 3, 1994
showing their approval for the applicant's request for
the setback variance.
"C. Literal interpretation and enforcement of the terms and
provisions of this chapter would deprive the applicant
of rights commonly enjoyed by other parcels in the same
Zone District, and would cause the applicant
unnecessary hardship or practical difficulty. In
determining whether an applicant's rights would be
deprived, the Board shall consider whether either of
the following conditions apply:
1. There are special conditions and circumstances
which are unique to the parcel, building or structure,
which are not applicable to other parcels, structures
or buildings in the same Zone District and which do not
result from actions of the applicant;"
The applicant's property was originally developed by a
previous owner who was apparently encouraged by the
Black Birch Estate Homeowners Association to locate the
house to the extreme northerly portion of the building
envelope due to impacts on the view planes of the
adjacent properties, As can be seen on the attached
survey drawing, there is a ten foot offset in the west
(front) property line which results in an unusual
setback condition at the northwest corner of the
building envelope. Had the property line continued the
alignment of the southerly portion of this line, no
variance would be required, and since the existing side
and rear setbacks are extremely more restrictive than
the City Zone District's standard requirements, a
situation of practical difficulty exists.
The proposed garage location creates the least impacts
possible regarding setbacks, view planes, topography,
utility relocation and garage-to-house circulation and
massing.

BACKGROUND: Two site plans are enclosed: one showing the
proposed single car garage to be attached to the Saussus
existing house on Lot 6; the other showing the proposed
addition to the Morrow residence on Lot 12.
The Black Birch Estates HOA Architectural Control Com-
mittee (ACC), comprised of Joyce Gruenberg, Sandra Johnson
and Felix Pogliano, has already granted variances to the
setback encroachments shown on the pla~s, Rationale: the
Lot 6 encroachments are minimal and the garage Toof will
be only 7.5 feet above ground level; on Lot 12 a signifi-
cant portion of the setback encroachments result only from
roof overhangs.
However, it has been brought to our attention that,
whereas Section XI of the Black Birch Protective Covenants
empowers the ACC to waive height limitations in writing,
there is no similar specific statement with regard to waiv-
ing setback encroachments. The decisions of the ACe, there-
fore, may require approval by 80% of Black Birch homeowners.
ACTION REQUIRED: Your Board of Directors recommends that
you ratify the decisions of the ACC by completinc the form
at the bottom of the extra copy of this letter and returning
it as soon as possible in the postage-paid envelope pro-
vided. If a reply is not received by Monday, July )1 it
will be deemed that you have approved the decisions of the ACC.
